LEAVE AND LICENSE AGREEMENT

THIS AGREEMENT FOR LEAVE AND LICENSE is made on the 24th day
of March 2022.

BETWEEN

1) SMT. GIRJA DEVI SHRIMALI, W/O Sri Kantilal Shrimali 2) SHREE


KANTILAL SHRIMALI, S/O SHREE RATANLAL SHRIMALI, residing at
3rd floor, Flat No. 302, Rabindra Niwash 1/B, K.N. Chatterjee St.,
Belur, P.S.- Belur, Dist- Howrah-711204, hereinafter called and
referred to as the LICENSOR (which expression shall unless
excluded by or repugnant to the context be deemed to mean and
include his heirs, executors, administrators, representatives and
legal assigns) of the FIRST PART.
AND

BIRENDRA PANDEY, S/o-Barmeswar Pandey, Resident of 281/27, G. T. Road, P.S.-


Liluah, Dist-Howrah-711204, hereinafter called the LICENSEE (which term shall
include, unless the context otherwise requires, his heirs, successors, legal
representatives and assigns) of the OTHER PART.

WHEREAS the licensor is the owner and lawful occupier of a flat on 3rd floor, Flat
No. 302, Rabindra Niwash measuring an area more or less of about 740 sq.ft. lying
and situated at 1/B, K.N. Chatterjee St., Belur, P.S.- Belur, Dist- Howrah-711204.

AND WHEREAS the licensor was interested to grant license to any person for use
and occupancy for Residential purpose for temporary period of 11 (Eleven) months
for an area measuring about 740 sq.ft on the 3rd floor, Flat No. 302, Rabindra
Niwash lying and situated at 1/B, K.N. Chatterjee St., Belur, P.S.- Belur, Dist-
Howrah-711204, which is fully described in schedule below and for the sake of
convenience it will be referred as “LICENSED PORTION”.

AND WHEREAS after knowing the intention of licensor the licensee approached to
licensor and offered to take the licensed portion as described in schedule below for
use of residential purpose on the leave and license basis for the temporary period
of 11 (eleven) months effect from 10th day of march 2022.

AND WHEREAS the LICENSOR accepted the offer of the licensee subjected to terms
and condition written herein below and agreed by both the parties.

AND WHEREAS both the parties agreed to write down the terms and conditions as
agreed by both the parties to avoid future disputes and differences.

NOW THESE PRESENTS WITNESSETH and the parties hereby agree as follows:

1. That the licensee shall use and occupy the licensed portion as described in
schedule herein below only for residential purpose for the temporary period
of 11 (eleven) months.
2. That the licensee shall pay Rs 50,000/-( Fifty Thousand Only) as security
deposit to the licensor which will be Refundable at the time of handover of
the licensed portion, and also pay Rs 7,500/- (Seven Thousand Five Hundred
Only) per month including Rs 330/- per month as maintenance charge
within 10th day of every succeeding month and/or shall pay maintenance
charges as applicable to other flat owners of the building, as and when it
shall be revised.
3. That the license shall automatically stand revoked after expiry of aforesaid
licensed period and after expiry of the licensed period if the licensee wants
to extend the licensed period, then the licensor shall extend the licensed
period with mutual discussion and the rent shall be increased subsequently
at the rate of 10% upon the present licensed fee, after expiry of this license
period.
4. That the licensee may vacate the licensed portion before the expiry of
licensed portion by giving two months advance notice to the licensor.
5. That the licensor may revoke this licensee agreement after giving two-
month prior notice to the licensee if it will be found that the licensee has
violated any terms of this agreement.
6. The licensee shall use the electric meter which is in the name of licensor and
the licensee will pay the electric charges as per the bill raised by the CESC
Ltd.
7. That licensee shall neither tamper with the said electric meter nor use any
unauthorised connection with the said meter.
8. That the licensee shall not change the nature and character of the licensed
portion without written consent of the licensor and any damage save and
except normal wear and tear shall be compensated by licensee.
9. That the licensee shall not transfer, sublet and assign any right, title and
interest in the schedule licensed portion to any person even by executing
any partnership or any power of attorney to any third person.
10.That licensee shall pay the license fee timely and punctually and if the
licensee fails to pay the same for a continuous term of three months, then
the licensor shall have right to revoke the license, and the licensee shall
handover and deliver the peaceful possession of the licensed portion to the
licensor.
11.That the licensee shall not carry out any illegal acts/act at the licensee
portion and she will keep the licensed portion neat and clean.
12.That the licensee shall not cause any nuisance of any manner whatsoever to
the other occupiers in and around the licensed portion.

THE SCHEDULE ABOVE REFERRED TO

All that peace and parcel of flat, on 3rd floor, Flat No. 302, Rabindra Niwash
measuring an area of about 740 sq.ft. lying and situated at 1/B, K.N.
Chatterjee St., Belur, P.S.- Belur, Dist- Howrah-711204., which is butted and
bounded as follows: -
