DEED OF LEASE

THIS DEED OF LEASE is made and executed on this the 7th


day of January 2014 at Bangalore.

BETWEEN:

Sri. R.Srinidhi,
S/o. Sri. Raja Ram,
Aged about 33 Years,
R/at:#30, 2 Cross, Green Park Layout
Doddabanasawadi
Bangalore -560043

Hereinafter called the ‘LESSOR’ of the ONE PART,

AND:

Sri. K.Rajaram,
S/o. late Narayanappa,
Aged 42 years,
R/at. No.21, 3rd Phase,
J.P.Nagar,
Bengaluru – 560 078

Hereinafter called the ‘LESSEE’ of the SECOND PART:

(The term ‘LESSOR’ and the ‘LESSEE’ shall mean and include
their respective heirs, representatives, assigns, agents, attorneys,
successors in interest and title etc.)

WHEREAS the Lessor is the sole and absolute owner of the


immovable property bearing site old No.989, New No, 50, Khatha
Property No. 989/50, 2nd Main Road, Hosahalli extension, Vijayanagar,
ward No. 123, Vijaya Nagar Division PID No. 33-4-50 Bangalore
Measuring East to West Northern Side (20+21)/2 Feet, North to South
60 feet in total 1230 Sq.Ft. of 4000 sq.ft. commercial complex in
Ground and First Floor having five shops each and second floor full
roofed hall out of which the shop no.32 of the ground floor which is
going to be let out to the lessee which is more fully and particularly

described in the schedule given hereunder and hereinafter referred to


as the Schedule Premises.

WHEREAS the Lessor desirous of leasing out the schedule


premises to the Lessee who has accepted to take the schedule property
on lease. Both the parties have agreed to the terms and conditions set
out here in below and Lessee has agreed to take the leasehold property
more fully defined in the schedule for a period of 11 months and
accordingly the Lessor and the Lessee have mutually agreed for this
deed.

NOW THIS INDENTURE OF LEASE DEED WITNESSETH AS


FOLLOWS:-

1. The Lessor shall deliver the vacant possession of the above said
premises to the Lessee on the 7th day of January 2014 for the
purpose of running his business only on lease.

2. The Lessee shall have the leasehold rights over the schedule
property on payment of the below mentioned lease amount for a period
of 11 months commencing from this day i.e. 7th day of January 2014
and shall have the right to possess and enjoy the schedule property
as Lessee during the said period.

3. The Lessee shall pay a monthly rent of Rs.7,250/- (Rupees


Seven Thousand Two Hundred Fifty Only) exclusive of electricity
and water charges. The Lessee shall pay enhanced rent at the rate of
5% every year commencing from 7-1-2014.

4. The tenancy shall be a month-to-month one commencing from


the 1st day of each English calendar month and ending on the last day
of the same month.

5. The Lessee shall pay the rent on or before 5th of each English
calendar month promptly and regularly without committing any
default and shall obtain receipt for having paid the rents.

6. The Lessee during the tenure of the lease shall pay the electricity
and water charges of the schedule premises.

7. The Lessee shall keep the schedule premises in good and


tenantable condition during the subsistence of the lease period
barring reasonable wear and tear.

8. The Lessee shall effect painting to the shop and keep the shop
in tenantable condition during the tenure of the lease period.

9. The Lessee shall permit the Lessor or their duly authorized


agent/agents to enter the premises at all convenient time for
periodical inspection of the schedule premises with prior notice by
the Lessor in that regard.

10. The Lessee covenants with the Lessor that during the
subsistence of lease period, they will not sub-let the premises or use
the same for other than the purpose for which the schedule
premises is leased out to them.

11. The Lessee shall not commit two consecutive defaults in the
matter of payment of monthly rents. In the event of the Lessee
committing such default, the Lessor shall be entitled to determine this
lease and enter vacant possession of the schedule premises without
any prior notice to the Lessor either in writing or otherwise.

12. If either of the party is to terminate/vacate the schedule


premises, two months prior notice shall be given to the other party
and such notice shall be sent to the address of the respective parties

referred to above and notice so sent to and received at such address


shall be treated as sufficient.

13. Subject to fulfillment of the terms and conditions of these


presents and at the sole option of the Lessor, the lease may be
further extended after expiry of the lease period. Upon such renewal
the Lessee shall pay enhanced rent at the rate of 5% once in a year on
the then existing rate of rent.

14. The Lessor shall bear and pay all rates, taxes, assessments
and outgoings, which may hereinafter be imposed or assessed by the
concerned authorities/BBMP.

15. The Lessor shall not interfere or meddle with the schedule
premises during the subsistence of this lease period and shall permit
the Lessee to use and enjoy the same peacefully and in the manner he
likes and for the purpose for which it was leased out. The Lessee shall
not make any construction/s, alteration/s or make any addition/s on
the schedule premises except with the written permission of the
Lessor during the subsistence of the lease period.

16. The Lessee has agreed to deposit a sum of Rs. 2.00,000/-


(Rupees two Lakhs only) with the Lessor out of which Rs. 1,00,000/-
(Rupees one lakh only) paid on this day by way of cash and remaining
amount of Rs.1,00,000/-(Rupees one lakh only) shall be paid within
four months from today.

SCHEDULE PROPERTY

All that piece and parcel of the shop premises bearing No.32
situated in ground floor site bearing old No.989, New No, 50, Khatha
Property No. 989/50, 2nd Main Road, Hosahalli extension,
Vijayanagara, ward No. 123, Vijaya Nagar Division PID No. 33-4-50
Bangalore and bounded on:

East by : Manjegowda’s property


West by : Diwakar’s property
North by : Road
South : Bhadrappa’s property

IN WITNESS WHEREOF, the parties have subscribed their


respective signatures to this Deed of Lease on the day, month and year
mentioned above.
