AGREEMENT

This agreement is made on …. Day of Jan, 2022 BETWEEN 1) SRI SAMIR KUMAR
CHATTERJEE, 2) TARUN CHATERJEE both sons of Late BIJALI BHUSAN
CHATTERJEE both residing at 6/1, Hari Charan Banerjee Lane P.S. Belur District- Howrah,
hereinafter called the party of the FIRST PART.

AND
TAPASH SEN son of Late TUSHAR KANTI SEN residing at 5, Hari Charan Banerjee Road
P.S. Belur District- Howrah, hereinafter called party of the OTHER PART.

Whereas, FIRST PART is the joint Owner of Municipal holding no-6 Hari Charan Banerjee
Road P.S. Belur District- Howrah, and whereas, the FIRST PART is going to develop their
aforesaid Holding by constructing multi-storied building through DEVELOPER. And
whereas, OTHER PART is the owner of Municipal Holding No. 5, Hari Charan Banerjee
Road P.S. Belur District- Howrah and Whereas, both the holdings of both the parties are
attached to each other and there is no common passage between the two holdings. And
whereas it is necessary for the FIRST PARTY to obtain the consent of the OTHER PART
for their smooth construction work. As such, the FIRST PART approached to the OTHER
PART and request him to provide his consent. Whereas, OTHER PART keeping in mind
the old relations between the parties agreed to provide his consent after due negotiations, and
a per the terms and conditions enumerated herein below and agreed by both the parties.

NOW BOTH THE PARTIES AGREED AS FOLOWS:


A. That the FIRST PARTY or their appointed DEVELOPER shall carry
out the construction work as per the pan sanctioned by competent
authority.
B. That the FIRST PARTY or their appointed DEVELOPER shall
indemnify and compensate to the OTHER PART if, any damage to the
life/limb and property of the OTHER PART shall be made due to any
Act/Omission of the proposed construction work by the FIRST PART.
C. That OTHER PART shall have right to obtain prohibitory Order from
the Competent Court if the FIRST PART or their nominated
DEVELOPER carry out the construction work by violating any
Rules/Regulations of Competent Authorities.
D. That this document will be treated as ‘NO-OBJECTION’ from the
OTHER PART subject to compliance of the Terms and Conditions
agreed herein between the parties.
IN WITNESS whereof both the parties state and subscribe their respective
hands on the Day, Month and Year mentioned herein above.
