LEAVE AND LICENSE AGREEMENT

THIS AGREEMENT FOR LEAVE AND LICENSE is made on the 1st Day of
April 2021 BETWEEN SHIB PRASAD GHOSH, s/o- Late Gour Hari Ghosh,
Residing at 232/B G.T.Road, Police Station- Belur, Post Office-
Belurmath, District-Howrah-711202, hereinafter called and referred to
as the LICENSOR (which expression shall unless excluded by or repugnant
to the context be deemed to mean and include his heirs, executors
administrators, representatives and legal assigns) of the first part.

AND

PURNIMA DEY, S/o-Late Abinash Chandra Dey, Residing At 5/6, Dinanath


Ghosh Street, p.s- Belur, Dist-Howrah, hereinafter called the LICENSEE (which
term shall include, unless the context otherwise requires, her heirs, successors,
legal representatives and assigns) of the OTHER PART.

WHEREAS the licensor is the owner and lawful occupier of a flat on Second
floor measuring an area of about 850 Sq.ft being flat no- 2C, lying and situated
at 232/B G.T.Road, Police Station- Belur, Post Office- Belurmath, District-
Howrah-711202.

AND WHEREAS the licensor was interested to grant license to any person for
use and occupancy for Residential purpose for temporary period of 11 (eleven)
months for an area measuring about 850 sq.ft on the 2 ND floor, being flat no-
2C, lying and situated at 232/B G.T.Road, Police Station- Belur, Post Office-
Belurmath, District-Howrah-711202, which is fully described in schedule below
and for the sake of convenience it will be referred as “LICENSED PORTION”.

AND WHEREAS after knowing the intention of licensor the licensee approached
to licensor and offer to take the licensed portion as described in schedule below
for use of residential purpose on the leave and license basis for the temporary
period of 11 (eleven) months.

AND WHEREAS the LICENSOR accepted the offer of the licensee subjected to
terms and condition written herein below and agreed by both the parties.

AND WHEREAS both the parties agreed to write down the terms and
conditions as agreed by both the parties to avoid future disputes and
differences.

NOW THESE PRESENTS WITNESSETH and the parties hereby agree as follows:

1. That the license shall use and occupy the licensed portion as described in
schedule herein below only for residential purpose for the temporary
period of 11 (eleven) months and this licensee agreement shall effect
from 1ST day of April 2021.
2. That the license shall pay Rs 30,000/- as security deposit to the licensor
which will be refundable after adjusting if any dues and arrear or
damage charges may be receivable by the licensor and also pay Rs
10,000/- per month as license fees within 5 th day of every succeeding
month.
3. That the license shall automatically stand revoked after expiry of
aforesaid licensed period and after revocation, the licensee shall hand
over and deliver the peaceful possession of the licensed portion to the
licensor after vacating the same and after expiry of licensee period if the
licensee intends to extend the period for further period in that event it
totally depends upon the licensor.

4. That the licensee may vacate the licensed portion before the expiry of
licensed portion by giving three months advance notice to the licensor.
5. That the licensor may revoke this licensee agreement after giving three
month prior notice to the licensee if it will be found that the licensee has
violated any terms of this agreement.
6. The licensee shall use the electric meter which is in the name of licensor
and the licensee will pay the electric charges as per the bill raised by the
CESC ltd. The licensee shall be sole responsible for any bill raised by the
CESC Ltd either for consumption or for fine or penalty for the licensed
portion.
7. That license shall neither temper the said electric meter nor use any
unauthorised connection with the said meter.
8. That the licensee shall not change the nature and character of the
licensed portion without written consent of the licensor.
9. That the licensee shall not transfer, sublet and assign any right, title and
interest in the schedule licensed portion to any person even by executing
any partnership or any power of attorney to any third person.
10.That licensee shall pay the licensee fee timely and punctually and if
licensee fails to pay the same for continuous three month then licensor
shall have right to revoke the license and licensee shall handover and
deliver the peaceful vacate position of the license portion to the licensor.
11.That the licensee shall have no greater interest than that of a bare
licensee and the licensee shall never claim herself as premises licensee
within the meaning of the west Bengal premises tenancy act 1997.
12.That the licensee shall not carry out any illegal acts/act at the licensee
portion and he will keep the licensee portion neat and clean.

13.That the licensee shall not cause any nuisance to any manner
whatsoever to the other occupiers in and around the licensed portion.

THE SCHEDULE ABOVE REFERRED TO

All that peace and parcel of flat, measuring 850 Sq.ft on the 2 nd floor being flat
no- 2C, lying and situated at 232/B G.T.Road, Police Station- Belur, Post Office-
Belurmath, District-Howrah-711202, under HMC ward no- 56, which is butted
and bounded as follows:-
