Preparation for the Dialogue with Teresita Yusay
08 July 2021

Official start time is 2:12 PM, with Leomar introducing the flow of the meeting including the person/s in-
charge of the presentation.

The dialogue with Teresita Yusay will be on 13 July 2021.

Dante Caparida will present the rationale and background of the meeting.

Mrs. Yusay called Kaisahan through the Dagyaw program phone number. She visited the office and
presented the history and several issues and concerns regarding her property.

She claimed she did not have any plans to apply for VOS under the CARP. She also inquired about the 33
hectares that have been classified as having an erroneously issued NOC. She has also applied for the
conversion of a parcel of land that she and her husband has applied for.

She also asked how DAR identifies the farmer beneficiaries and she questioned why Bulgan was included
as he is not one of his workers.
One of her concerns is the low valuation of the 16 hectares that have already been awarded to the
beneficiary.

Teresita Yusay verbally stated to us that once she understands the issues she presented, she would be
willing to give way to the implementation of the program.

Yusay also presented a document from the DAR Central Office which informs her that the application for
conversion for the +9 hectares has already been approved.

To summarize:

1. She did not apply for VOS, she just signed some documents
2. According to PARO Mabunay, 33 hectares has been declared erroneously issued
3. Low valuation for 16 hectares
4. How DAR identifies DAR Beneficiaries as Bulgan is not one of his workers
5. No development for the 16 hectares that has already been awarded
6. Status of the 10 titled lots that have already been granted exemption equivalent to +9 hectares

After the presentation, DAR will respond and clarify the concerns presented, with MARO Doming as the
presenter.

1. Before it was compulsory acquisition but it was Yusay that decided to shift to VOS
a. She was represented by the council
2. 14 LH Erroneous NOC because the title is Felix Yusay married to Teresita Aguilar, the NOC issued
to Heirs of Felix Yusay
3. Valuation proceeding to PARAD questioning the value of the land, must be addressed to LBP
4. DAR sorted the application for FB, following the requirements and qualifications submitted by
the farmers; Bulgan has been qualified as farmworker – based on the qualifications of the
guidelines
5. There is already an order granting the exemption for the 10 titled lots
a. Question: is the 10 titles included in the initial 33 hectares that have been classified
erroneous
b. The remaining 5 landholdings with approved conversion orders
c. 3 landholdings have been processed through VOS
d. Order to develop within 5 years, which Yusay has already replied to

Response from Bulgan

1. NOC issued 1993 for the lot with conversion order
2. No development after 5 years for the landholding
3. Exemption order received 2020

1. Kaisahan to furnish copy of documents to DARPO South

2. Yusay presented a petition they filed to central office, DARCO provided certification that Yusay
applied
3. Only a notice of order has been issued last 14 February 2020
4. PARO is not available on the 13th of July, Yusay is not available on the 12 th
 5. Next schedule is on the 23rd July, 9:00 AM at DARPO South
6. DAR to have lawyer/s present and have Yusay sign an agreement

Response from Reymond

1. Yusay presented the same issues repeatedly before and almost nothing new has changed
2. After the dialogues with CARPO Milma, she offered lands for swapping but it was not amenable
for the beneficiaries
3. She has visited SAC office before numerous times, she doesn’t want the beneficiaries to occupy
the area directly behind her rest house

Additional notes from Bulgan

1. Bulgan has been working at the hacienda of yusay since he was 14
2. He was a worker at a different lot and was included in the masterlist which was not covered yet
