I- Introduction

The report below presents methods for improving and developing employee relations. The report
consists of 6 main parts. The first part is a general introduction about Mobile World company. The
second part is Explanation on why the relations with trade union and each individual employee are
important for the company. The third part is The key methods to manage employee relations and
evaluation on these methods. The fourth part is The key elements of Vietnam Labor Code 2019 that
impact on the decisions of the upper methods and the evaluation on the impacts of the upper key
elements of Vietnam Labor Code. The fifth part is The HRM plan to carry out the upper methods.
And the last part is The rationale to explain why carrying out such methods will be beneficial for the
company.

supermarkets, 2038 green electronics supermarkets, 2144 green department stores and many other

III- Explanation on why the relations with trade union and each individual employee are
important for the company.
1. The importance of the relations with trade union for the company

The role of trade unions in uniting, protecting and improving the quality of workers has a positive
impact on businesses. When an enterprise changes its structure, rearranges labor and personnel, or
improves investment, technology, and equipment for production and business activities, the Trade
Union can take the place of the business owner to capture the heart of the business. interests and
aspirations of workers and employees; Reflecting encouraging opinions, encouraging employees to
be self-conscious and conscious in labor and production. Thereby helping the Enterprise in arranging
labor in a reasonable way to maximize the efficiency of resources, as well as terminating labor
contracts in cases that do not meet the requirements of the Enterprise. (Anh, 2019) They help
management in the recruitment of employees. Trade unions have also started to conduct various
training and development activities for the employees. They help in unifying employees coming from
diverse social and economic backgrounds by helping them get used to the work conditions in the
company. As a result, workers are more aware of the rules and policies in the company. This gives
the employees the requisite tools to succeed in their job. With efficient employees, companies can
achieve their goals and grow at a faster rate. (UKESSAYS, n.d.)

Trade unions are the bridge in resolving conflicts and conflicts between employees and employers
such as strikes, complaints, lawsuits, etc. When there is a dispute such as unilateral termination of the
labor contract, labor discipline, strike, etc. The trade union will hold a dialogue to reconcile the
interests of the employee with the employer in their capacity. is an independent entity, mediating labor
dispute resolution. This helps to prevent workers or employees from voluntarily quitting their jobs,
not working with full responsibility, not respecting commitments, labor agreements, etc. (Anh, 2019)

Thereby affirming the role of trade unions in enterprises is very important. If it is effectively promoted,
production and business activities in the Enterprise are promoted, employees are automatically
protected for their rights and enjoy other benefits from the superior Trade Union. Thereby will bring
practical benefits to businesses as well as employees. At the same time, it creates a driving force for
enterprises to develop sustainably and to build a strong workforce, contributing to improving the
competitiveness, reputation, image and brand of the enterprise in the market. (Anh, 2019)

Even so, since its inception, Mobile World has not had a union. This increases the pressure on the HR
department when it comes to dealing with employees' complaints about working time, salary and

bonus, etc. In the long run, it will greatly affect the productivity of the HR department as well as the
fact that employees cannot find a voice when there is no intermediary to solve their problems and
problems. Therefore, the success of the union soon will help reduce work pressure on the human
resources department. At the same time, it helps to solve problems between employees and the
company, minimizing human resource problems for the company.

2. The importance of the employee relations for the company

Employees are the crucial asset of any organization and play a substantial role in the success of a
business therefore the importance of employee relation is pertinent for the accomplishment of any
organization. However, it depends upon the management that how they polish skills and encourages
the potential of their employees. If the management of a business works on developing good relations
and trust with their employee, the staff of the organization will also work hard and remain loyal to
their employers. Nonetheless, the situation would be reversed if the relationship between employee
and employer is not good. (admin, 2021)

People often say "happy employees are the most productive employees" or "satisfied employees bring
satisfaction to customers". The mobile world is well aware of this when President Nguyen Duc Tai
once said: “People can only give what they have to others. Therefore, the mobile world must bring
joy to employees, let employees find work interesting, then they can share joy and excitement with
others. (Tình, 2017)

Satisfied and happy employees hold the potential to take the business to new heights of success. In
general, companies with good employee relationships find it easier to engage, motivate, understand
and keep their employees. Some of the benefits of building positive employee relationships in the
workplace include:

Employee engagement: It can be defined as the extent to which the employees feel passionate about
their jobs and workplaces. A research study shows that 90% of the leaders have the idea of how
important employee engagement is however, only 50% of these employers actually know how it can
be expressed. Here, employee relations play a crucial role. It has been proven that companies with
better employee communications have much higher rates of employee engagement.

Employee satisfaction: Employee engagement also leads towards employee satisfaction. Employees
that are more engaged tend to experience employee satisfaction at a higher level and vice versa.

Employee productivity: Similarly, employee engagement and employee satisfaction are both crucial
for ensuring employee productivity. Increased employee productivity ensures increased profit and
revenue to the business.

Employee retention: It has been observed that more employees are switching jobs these days. It
happens when employees feel isolated and frustrated in the company. Fortunately, employee
retentions can be ignored by adopting several ways, and developing good relations with employees is
one such example. With enhanced mutual relations, employees shall feel satisfied and would not
consider other opportunities. Therefore, realizing the importance of employee relations will also lead
towards employee retention.

Employee advocacy: The contact and social circle of the employee can open new avenues of success
to the organization. However, the connections of employees can only be reached if the employee has
the feeling of ownership of the company. It can only be ensured if the management keeps their
employees in the loop and share important content and details with them.

The employee experience: Employee experience is very similar to employee satisfaction in its context.
Employee experience is mandatory to provide a healthy workplace. A better employee experience can
be made sure by promoting transparent and open communication between management and
employees.

Employee empowerment: The employees of business organizations want to own the company they
work for. Also, they want to have a certain level of say in the decision-making process of the company.
This refers to employee empowerment which requires the employees to be able to take their own
decisions to achieve their goals as well as fulfill their responsibility in their own ways. A good
communication strategy and employee relations are all that are required to provide employee
empowerment. (admin, 2021)

IV- The key methods to manage employee relations and evaluation on these methods.
1. Method 1: Ensuring fair treatment.

At Mobile World, all employees are treated equally and opportunities for career advancement are
shared equally. Any act of unfair treatment, discrimination or abuse of power is condemned by the
company and protects the rights of employees. The interests of employees are always concerned and
prioritized to create high human cohesion in the Mobile World. Financial problems are more or less
only a part, protecting and fighting for them when there is a conflict is important to show priority and

increase employee engagement with the organization. Employees are placed second, higher than
shareholders, just after customers. When there is a conflict of interest between an employee and a
shareholder or a supplier, the employee will be protected first even if it is controversial with the
shareholder. (Tình, 2017)

a. Advantages

When employees are treated equally and have the same promotion opportunities at work, they will
feel secure to work and develop their jobs. Employees who earn respect from management as well as
the company will want to stay longer than where they are not respected. Thereby helping to maintain
the stability in terms of personnel at work. They will also work more actively and effectively
contributing to the success of the company.

b. Disadvantages

The fact that employees feel unfairly treated or disrespected at work will negatively affect their
psychology. They will feel depressed, lose enthusiasm in work. That directly affects their working
efficiency as well as the company's revenue. Besides, feeling disrespected leads to stoppage of work.
This negatively affects those around the company as well as candidates who want to work at the
company. Thereby adversely affecting the reputation as well as the recruitment work of the company.

2. Method 2: Salary and bonus system

In addition to fair treatment and respect, so that employees can rest assured to work and stick with the
company for a long time, Mobile World also needs a reasonable and clear salary and bonus system.
Mobile World's compensation system is also a highly praised topic, belonging to one of the companies
with the best remuneration in Vietnam. The average salary of Mobile World has reached nearly 12
million VND/month, much higher than other businesses in the same industry. Meanwhile, the year-
end bonus at Mobile World is up to 3 months of income (For Supermarket employees) and 3-9 months
of income (For KPI staff). Besides, the salary of each position is divided into many different levels.
For example, the salary of a salesperson if only fulfill the responsibility will have a salary of 7 million
VND/month, the sales staff who complete the job well and solve the problems well have a much
higher salary of 12 million VND/month. The company will periodically pay employees through wire
transfers or employees can multiply directly through the finance department or through the manager
of each store on pay days. (Huệ, 2020)

a. Advantages:

The fact that the company has a reasonable and clear salary and bonus system will help employees
feel secure in their work and promote their abilities at work. Besides, dividing the salary into different
levels in each position will increase the competitiveness in each position. It requires each employee
to work hard every day to achieve the desired remuneration. This also helps the company assess the
capacity of each individual and detect talents in the company.

b. Disadvantages

Dividing the salary into different levels in each position also requires the company to accurately assess
the working capacity of each individual to offer a suitable salary instead of determining a fixed salary.
It also requires the company to provide valid evidence about the salary difference of each individual
at the same position in order to avoid controversies and conflicts surrounding the issue of salary and
bonus.

3. Method 3: Training courses for employees

Improving professional skills for each employee is extremely necessary to keep up with the world's
trends. Mobile World has Before - During training courses for all employees working at the company.
Not only helps employees improve their working skills, but also life skills, spirit and life values. The
company not only stops at traditional learning methods, but also applies new content and methods -

b. Disadvantages

The regular organization of professional training courses also consumes a large capital of the
company. Inviting highly qualified people to teach employees is very expensive and not all businesses
can afford. In addition, the training results may not be as effective as expected, so it requires
businesses to have a thoughtful plan to both have a good result of the training session and take
advantage of the training sessions good resource after training.

V- The key elements of Vietnam Labor Code 2019 that impact on the decisions of the upper
methods and the evaluation on the impacts of the upper key elements of Vietnam Labor Code

A. According to Article 5 of Vietnam's labor Code 2019 on "Employees' rights and


obligations": (Anon., 2019)

1. An employee has the rights to:

a) work; freely choose an occupation, workplace or occupation; participate in basic and advanced
occupational training; develop professionalskills; suffer no discrimination, forced labor and sexual
harassment in the workplace;

b) receive a salary commensurate with his/her occupational skills on the basis of an agreement with
the employer; be provided with personal protective equipment and work in an occupationally safe and
healthy environment; take statutory sick leaves, annual paid leaves and receive collective welfare
benefits;

For example: In order to satisfy workers' rights, fulfill employer's responsibilities and comply with
Vietnam Labor Code 2019, Mobile World always focuses on building a comfortable and healthy
working environment as well as employee training in the company. company. Recently, Mobile World
has excellently received 5 Vietnam HR Awards 2018 jointly organized by Talentnet and Labor &
Social Newspaper. Among them are enterprises with effective training and development of human
resources and enterprises with effective working environment. To achieve these achievements, Mobile
World has developed human resource management policies, welfare regimes and good remuneration
for employees. The members of the company always receive high salaries and bonuses. In addition,

B. According to Article 6 of Vietnam's labor Code 2019 on "Rights and obligations of


employers": (Anon., 2019)

1. An employer has the rights to:

a) recruit, arrange and manage and supervise employees; give commendation and take actions against
violations of internal labor regulations;

2. An employer has the obligations to:

c) Provide basic training and advanced training in order to help employees improve their professional
skills or change their occupations;

For example: In order to satisfy workers' rights, fulfill employer's responsibilities and comply with
Vietnam Labor Code 2019, Mobile World regularly organizes recruitment contests to supplement
human resources as well as expand the company's scale. The Mobile World recruitment process goes
through 3 stages including the application form, the essay test and the face-to-face interview. Coming
to Mobile World, candidates will experience training courses to improve working professional skills

C. Pursuant to Article 8 of Vietnam's labor Code 2019 on "Forbidden actions”. (Anon., 2019)

1. Labor discrimination.

2. Maltreatment of employees, forced labor.

3. Sexual harassment in the workplace.

4. Taking advantage of occupational training or apprenticeships to exploit the trainees or apprentices,


or persuade or force them to act against the law.

6. Persuading, inciting, promising advertising or otherwise tricking employees into human trafficking,
exploitation of labor or forced labor; taking advantage of employment brokerage or guest worker
program to commit violations against the law.

For example: In order to satisfy workers' rights, fulfill employer's responsibilities and comply with
Vietnam Labor Code 2019, at Mobile World, all employees are treated equally and opportunities for
career advancement are shared equally. Any act of unfair treatment, discrimination or abuse of power

D. According to Article 59 “ Basic and advanced occupational training” and Article 60


“Responsibilities of employers for provision of basic and advanced occupational training and
occupational skill development” of Vietnam's labor Code 2019: (Anon., 2019)

Article 59. Basic and advanced occupational training

1. Workers are entitled to have vocational training; participate in national assessment and
recognition of occupational skills, developoccupational skills that are suitable for their desires and
abilities.

2. The State encourages eligible employers to provide basic and advanced occupational training for
their employees and other employees by:

a) Establishing occupational training centers or classes at the workplace in order to train, retrain
and develop occupational skills of theemployees; cooperating with vocational education institutions
in providing occupational training at basic, intermediate and college level, andother occupational
training programs as per regulations;

b) Carrying out vocational assessments; participating in the occupational training council;


forecasting labor demand and develop theoccupational standards; organizing the assessment and
recognition of occupational skills; developing professional capacity of employees

Article 60. Responsibilities of employers for provision of basic and advanced occupational training
and occupational skilldevelopment

1. Employers shall develop annual basic and advanced occupation training and occupational skill
development plans for their employees andallocate budget for implementation thereof; provide
training for employees before reassigning them.

2. Employers shall submit annual reports on results of the basic and advanced occupational training
and occupational skill development theyprovide to the provincial labor authority.

For example: In order to satisfy workers' rights, fulfill employer's responsibilities and comply with
Vietnam Labor Code 2019, Mobile World has Before - During training courses for all employees
working at the company. Not only helps employees improve their working skills, but also life skills,

1. A salary is an amount the employer pays the employee under an agreement for a work performed
by the latter. Salary equals (=) base salaryplus (+) allowances and other additional amounts.

2. The base salary must not fall below the statutory minimum wages.

3. Employers shall pay salaries fairly without discrimination against genders of employees who
perform equal works.Article

91. Statutory minimum wages

2. Statutory minimum wages per month or per hour vary according to regions.

For example: In order to satisfy workers' rights, fulfill employer's responsibilities and comply with
Vietnam Labor Code 2019, the minimum salary of employees in the company is determined by Mobile
World based on the government's annual regional minimum wage. Besides, the salary of employees
in the company is also divided into different levels based on the position, working title as well as the
capacity of each employee. For example, cashier's salary ranges from 7-10 million VND/month or

F. According to Article 137 “Maternity protection” of Vietnam's labor Code 2019 : (Anon., 2019)

1. An employer must not require a female employee to work at night, work overtime or go on a long
distance working trip in the followingcircumstances:

a) The employee reaches her seventh month of pregnancy; or her sixth month of pregnancy when
working in upland, remote, border and islandareas;

b) The employee is raising a child under 12 months of age, unless otherwise agreed by her.

2. Whenever an employer is informed of the pregnancy of an female employee who is doing a


laborious, toxic or dangerous work, a highlylaborious, toxic or dangerous work or any work that might
negatively affect her maternity, the employer shall assign her to a less laborious orsafer work, or
reduce the working hours by 01 hour per day without reducing her salary, rights or benefits until her
child reaches 12 months ofage.

3. The employer must not dismiss an employee or unilaterally terminate the employment contract with
an employee due to his/her marriage,pregnancy, maternity leave, or nursing a child under 12 months
of age, except for cases where the employer that is a natural person dies or isdeclared incapacitated,
missing or dead by the court, or the employer that is not a natural person ceases its business operation,
declared by aprovincial business registration authority that it does not have a legal representative

or a person authorized to perform the legalrepresentative’s rights and obligations.Upon expiration
of the employment contract with female employee who is pregnant or nursing a child under 12 months
of age, conclusion of anew employment contract shall be given priority.

4. During her menstruation period, a female employee shall be entitled to a 30 minute break in every
working day; a female employee nursing achild under 12 months of age shall be entitled to 60 minutes
breaks in every working day with full salary as stipulated in the employmentcontract.

For example: In order to satisfy workers' rights, fulfill employer's responsibilities and comply with
Vietnam Labor Code 2019, Mobile World employees are fully entitled to maternity benefits. And
especially the policy of maternity leave up to 10 months but still with salary. This demonstrates the
company's culture of fairness and favoritism for female employees. (Vo, 2020)

VI- The HRM plan to carry out the upper methods


1. Situation analysis

Under the complicated development of the COVID-19 epidemic in the past year, many domestic and
foreign businesses had to cut staff a lot, including Mobile World. In order to limit the spread of disease
in the community, from the end of March, the company had to close about 10% of the total number
of phone and electronic stores at the request of the local government. In addition, the company must
also limit recruitment and open new stores. In parallel with the closure of stores, Mobile World also
promotes online sales to provide jobs for staff as well as support employees to overcome difficulties

2. Methods to manage employee relations

* Description of the method:

Corporate social responsibility is a form of disciplined activity introduced by businesses to help them
contribute to social goals as a humanitarian, community-based business. how to participate in, support
volunteer activities, or perform ethical activities. The Mobile World Shelter Charity Fund is also an
active charity during the pandemic such as supporting electric injection pumps, patient monitors,
SpO2 meters, providing oxygen tanks... to hospitals in Ho Chi Minh City. .HCM and the southern
region. This is an organization led by businessman Nguyen Duc Tai as Chairman of the Board of
Management. The Fund was established in 2019 with the initial goal of supporting students' living
expenses in the form of scholarships or interest-free loans. Build and operate shelters to nurture
orphans and more recently to support Covid-19 prevention. (Lê, 2021)

These community activities will help improve employee relations as well as teamwork. Besides, it
also helps to create a new environment to help employees relax after tiring working hours and
contribute to society.

This method requires specific plans to balance the time between activities and work. In addition,
organizing activities for the community also requires large costs, so it needs to be carefully calculated.
Besides, it can also cause distraction and distraction at work for employees.

VII- The rationale to explain why carrying out such methods will be beneficial for the company

Mobile World is a leading corporation in the field of the largest multi-industry retail in Vietnam. This
shows that the leadership and employees in the company have made great efforts to improve work

is very good. Human resource management in the salary and remuneration system has really promoted
its role as an economic lever to encourage employees to work efficiently and work with peace of mind.
