Act as a Contractor and
hereinafter referred to as a
SECOND PARTY.

Perjanjian ini dibuat pada hari Jumat
tanggal 31 bulan Maret tahun 2022,
antara :
a. Owner Pekerjaan Meubeler
Farmhouse villa starbucks,
Medan, dalam perjanjian ini
diwakili oleh Masyitah Daud,
Selaku Perwakilan Starbucks
Coffe Trading Company Sarl.
Bertindak sebagai Pemberi Kerja
dan selanjutnya disebut PIHAK
PERTAMA.
b. Ade Syahputra Astono, beralamat
di Cluster Amsterdam No. L06
Perumahan Merci Medan Johor,
Medan, pemegang KTP No.
1209160611960003.
Bertindak sebagai Kontraktor dan
selanjutnya disebut PIHAK KEDUA.
PIHAK PERTAMA menugaskan PIHAK
KEDUA untuk melaksanakan Pekerjaan
Meubeler Farmhouse villa starbucks,
Medan yang Berlokasi di Jl. Jamin
Ginting, Dolat Rakyat, Kabupaten Karo,
Sumatera Utara.

 Article 1
BASIC OF THE CONTRACT
AGREEMENT
(1) The First Party assigns the task to the
Second Party to carry out the project
of “Pekerjaan Meubeler Farmhouse
Villa Starbucks Medan” located at Jl.
Jamin Ginting, Dolat Rakyat, Karo
Regency, North Sumatra.
(2) The project is carried out as well as
possible and in accordance with the
technical specifications and building
drawings that have been provided by
the First Party to the Second Party in
accordance with Attachment 1 and
use the materials in accordance with
the specifications in Attachment 2
(BoQ) of this employment
agreement. (BoQ/Bill of Quantity).
Article 2
THE PROJECT ASSIGNMENTS
(1) Second Party work as described in
article 1 will begin on Wednesday,
April 06, 2022.
(2) The work of the Second Party shall
be completed within 60 working days
as agreed between the two parties.

Pasal 1
DASAR PERJANJIAN KERJA
(1) Pihak Pertama memberikan tugas
kepada Pihak Kedua untuk
melaksanakan Pekerjaan Meubeler
Farmhouse villa starbucks yang
beralamat di Jl. Jamin Ginting, Dolat
Rakyat, Kabupaten Karo, Sumatera
Utara.
(2) Pekerjaan dilakukan dengan sebaik-
baiknya dan sesuai dengan
spesifikasi teknis dan gambar
bangunan yang sudah diberikan.oleh
Pihak Pertama kepada Pihak Kedua
sesuai dengan Lampiran 1 dan
menggunakan bahan-bahan sesuai
dengan spesifikasi yang ada dalam
Lampiran 2 (RAB/Rencana Anggaran
Biaya) perjanjian kerja ini.
Pasal 2
TUGAS PEKEJAAN
Pekerjaan Pihak Kedua sebagaimana
diuraikan pada Pasal 1 akan dimulai
pada hari Rabu, 06 April 2022
Pekerjaan Pihak Kedua harus di
selesaikan dalam waktu 60 hari kerja
seperti yang sudah disepakati antara
kedua belah pihak.

 Article 3
OBLIGATIONS AND
RESPONSIBILITIES OF THE SECOND
PARTY
(1) The Second Party shall begin work
on the date that has been agreed and
set.
(2) The Second Party shall also work
based on complete data and shall not
decide for itself when there is a
matter outside the design or image
provided by the First Party.
Article 4
THE CONTRACT PRICE
(1) As outlined in Chapter 1, the
renovation cost is Rp 294,381,000,-
(Two hundred and ninety-four
million three hundred and eighty-
one thousand rupiah). The fee does
not include the cost of taking care of
licensing (Building Permit).
Article 5
TERMS OF PAYMENT
(1) Payment of fees as referred to in
Chapter 4 is carried out in stages as
follows:
a. The first payment (Down
Payment) amounted to 30% of the
cost referred to in article 4 or
amounting to Rp. 88,314,300
(eighty-eight million three
hundred and fourteen thousand
three hundred rupiahs) and was
paid after both parties signed this
agreement letter.
b. The next payment is made every
instalment 1,2,3 and BAST with
the following weight value :
- Termin I weight 20% = Rp.
58,876,200
- Termin II weight 30 % = Rp.
88,314,300

Pasal 3
KEWAJIBAN DAN TANGGUNG
JAWAB PIHAK KEDUA
(1) Pihak Kedua harus memulai
pengerjaan pada tanggal yang sudah
di sepakati dan ditetapkan.
(2) Pihak Kedua juga harus
mengerjakan berdasarkan data–data
yang lengkap dan tidak boleh untuk
memutuskan sendiri ketika ada suatu
perkara yang mungkin di luar desain
atau gambar yang di berikan oleh
Pihak Pertama.
Pasal 4
BIAYA PEKERJAAN
(1) Biaya renovasi sebagaimana
diuraikan pada Pasal 1 adalah
sebesar Rp 294.381.000,- (Dua ratus
sembilan puluh empat juta tiga ratus
delapan puluh satu ribu rupiah).
Biaya tersebut tidak termasuk biaya
mengurus perizinan (Izin Mendirikan
Bangunan).
Pasal 5
CARA PEMBAYARAN
(1) Pembayaran biaya sebagaimana
dimaksud pada Pasal 4 dilakukan
secara bertahap sebagai berikut:

d. Pembayaran berikutnya

Article 6
MAINTENANCE
(1) For the maintenance period, each
worker is given 3 months, starting
from the event's news of completed
work is signed.
(2) At the end of maintenance, both
parties will agree to sign the news of
the handover of the work.
Article 7
RESPONSIBILITY
(1) The entire work is the second party's
sole responsibility to complete it, and
it is not permissible to transfer the
project to the other party.
Article 8
CONTRACT CHANGE ORDER
(1) For the work that is added and or
reduced apart from the package of
employment as stated in Article 1 of
this contract agreement, the reward
of the services shall be taken into
account based on the deliberation of
BOTH PARTIES or will be held
renegotiation between the FIRST
PARTY and the SECOND PARTY

Pasal 6
PEMELIHARAAN
(1) Untuk masa pemeliharaan setiap
pekerja di beri waktu 3 bulan, di mulai
semenjak berita acara selesai
pekerjaan ditandatangani.
(2) Pada masa berakhir pemeliharaan
kedua belah pihak akan sepakat
menandatangani berita acara serah
terima pekerjaan.
Pasal 7
PERTANGGUNG JAWABAN
(1) Seluruh pekerjaan adalah tanggung
jawab penuh Pihak Kedua untuk
menyelesaikannya dan tidak
diperbolehkan untuk mengalihkan
pekerjaan kepada pihak lain.
Pasal 8
PEKERJAAN TAMBAH KURANG
(1) Untuk pekerjaan tambah dan kurang
selain dari paket pekerjaan seperti
tercantum dalam Pasal 1 Perjanjian
Kerja ini, maka Imbalan jasanya
diperhitungkan berdasarkan
musyawarah KEDUA BELAH PIHAK
atau akan diadakan negosiasi
kembali antara PIHAK PERTAMA
dan PIHAK KEDUA yang akan

Article 9
PENALTY AND FINES
(1) If the SECOND PARTY is late to

Article 10
CONTRACT CANCELLATION
(1) If the Second Party is unable to carry
out the work in accordance with the
conditions of this contract agreement,
then the First Party may unilaterally
terminate the project relationship with
the Second Party and may appoint
another contractor to continue the
project.
Article 11
FORCE MAJEURE
(1) The provisions for carrying out work
in accordance with the schedule as
provided for in Article 2 of this
contract agreement do not apply in
the event of Force Majeure.
According to this contract
Agreement, what is meant by Force
Majeure is: Natural disasters, Wars,
General Strikes, Sabotage,
Outbreaks, Fires, Blockades,
Revolutions, and Riots or
circumstances that are unavoidable
and beyond human capabilities,
government policies/regulations in
the monetary field, etc.
(2) As soon as it is made aware of force
majeure, the SECOND PARTY shall
notify the First Party

Pasal 9
SANKSI DAN DENDA
(1) Bila PIHAK KEDUA terlambat
menyelesaikan pekerjaan seperti
tersebut pada Pasal 2 diatas, maka
kepada PIHAK KEDUA akan
dikenakan denda sebesa 1% dari
jumlah biaya sebagaimana
tercantum pada Pasal 4 untuk setiap
hari keterlambatan.
Pasal 10
PEMUTUSAN HUBUNGAN KERJA
(1) Apabila Pihak Kedua tidak dapat
meaksanakan pekerjaan sesuai
dengan syarat-syarat dalam
perjanjian kerja ini, maka Pihak
Pertama dapat memutuskan
hubungan kerja secara sepihak
dengan Pihak Kedua dan dapat
menunjuk Kontraktor lain untuk
melanjutkan pekerjaan tersebut.
Pasal 11
FORCE MAJEURE
(1) Ketentuan untuk melaksanakan
pekerjaan sesuai dengan jadwal
seperti diatur dalam Pasal 2
Perjanjian kerja ini tidak berlaku bila
terjadi Keadaan Memaksa / Force
Majeure. Yang dimaksud dengan
Keadaan Memaksa / Force Majeure
menurut Perjanjian Kerja ini adalah:
Bencana alam, Perang, Pemogokan
umum, Sabotase, Wabah, Kebakaran,
Blokade, Revolusi dan Huru-hara atau
keadaan yang secara wajar tidak
dapat dihindari serta berada diluar
kemampuan manusia, kebijaksanaan
/ peraturan pemerintah di bidang
moneter, dll.
(2) Segera setelah mengetahui adanya
Force Majeure, PIHAK KEDUA akan
menyampaikan kepada PIHAK
