Nancy, the guardian of Candy when she was 15 years old, sold Candy’s P4 million worth of one-bedroom
condominium units for P3,500,000 to Dante.

a. Is the contract valid? Why?

- Yes, because it has the consent of the guardian of the owner and also there is a condition that if the
owner reaches 15 years old age the condominium will sell to Dante.

b. Would your answer be the same if Nancy sold the condominium unit for P2 million?
- No, I will sell it based on the contract that both parties agree to.

c. Suppose the contract is rescissible and rescission can take place, how does it affect the parties?
- both parties will be affected if the contract is rescissible because the agreement of both parties will be
changed.

d. If you were Candy and you learned of the sale that your guardian entered into, what would you do?
- I will be against his or her decision because although he or she is my guardian I will make my own
decision because I have the power since I am the owner of the condominium.
