SHORT TERM TENDER NOTICE FOR SUPPLY OF MEDICAL BOOKS & MEDICAL JOURNALS
Sealed quotations are invited for Short Term Open Tender “Under Single Bid System”
on behalf of the Medical Superintendent for supply of Medical Books and Medical
Journals(Indian & Foreign) required for ESIC Dental College & Hospital, ESI Hospital
Complex,Sector-15,Rohini, New Delhi-110085 from eligible Publishers/Booksellers having at
least three years experience of supplying Medical Books, /Scientific/Technical/ Journals and
Periodicals(Indian & Foreign) to Medical Colleges libraries/ Government of India libraries.
Sealed Tenders with duly filled up Annexure-I,II &III along with Earnest Money as
mentioned in the tender document in the form of Demand Draft/ Banker’s Cheque issued by
any Nationalized Bank/Commercial Bank should be dropped in a Tender Box kept in the
Chamber of the Medical Officer In charge up to 1.00 P.M. on 25.04.12. The Tender shall be
opened on 25.04.12 at 2.00 PM in Medical Officer In charge ’s Room (Room No.319) on IIIrd
Floor of ESIC Dental College & Hospital, ESI Hospital Complex,Sector-15,Rohini, New Delhi-
110085 in the presence of the Tenderers or their authorized representative(s) who may wish
to be present. In case 25.04.12 is declared a public holiday, tenders shall be received and
opened as per above schedule on next working day.

TENDER UNDER SINGLE BID SYSTEM FOR SUPPLY OF MEDICAL BOOKS AND MEDICAL
JOURNALS (INDIAN & FOREIGN).
1) TENDER VALIDITY
Tender shall remain open for acceptance for a period of 120 days from the date of opening of
Tender. Tenders received for shorter validity will be rejected.
Sealed quotations are invited from eligible Publishers/Booksellers having at least three years
experience of supplying Medical Books / Scientific/Technical/ Medical Journals and
Periodicals(Indian & Foreign) to Medical Colleges libraries/Government of India libraries.
The bidders who are in a position to supply 75% or above the required quantity of books and
Medical Journals (Indian & Foreign) will be treated eligible to participate in the tender.
The tenderer shall furnish, as a part of the tender document, following documents establishing
their eligibility to participate in the tender and qualification to perform the contract.
a) Copy of PAN card issued by the Income Tax Department and Copy of the Income Tax
Return for the financial year 2009-10.
d) All Tenders must be filled as per details mentioned in Annexure- I, II & III.
3) QUALIFICATION OF THE BIDDERS:-
3.1. The Bidder, to qualify for the award of contract, shall submit a written power of
attorney authorizing the signatories of the bid to participate in the bid.
3.2. The bidder shall submit full details of his Agency / Firm or, if the bidder is a
Proprietorship/Partnership or a Private Limited Company, full details of ownership
and name of the directors.
3.3. Bidder shall submit a copy of PAN card No. under the Income Tax Act.
3.4. Bidder must submit self-attested copies of all documents and each & every page of
tender document duly signed by him.
i. In case the tenderer withdraws its tender or impairs or derogates from the tender in
any respect during the period of tender validity as specified by the purchaser,
OR
ii. The Earnest Money of unsuccessful bidders will be returned as promptly as possible after
the expiry of the period of tender validity without interest.
a) Tenderers should quote rate of discount (in percentage) offered on publishers’ printed
rate in Annexure-III. Medical Superintendent is not bound to accept the lowest bid or
any tender and also reserves the right of rejecting all or any of the tender without
assigning any reason.
b) The current bank exchange rate (TT selling rate) on the date of purchase order for
Medical Books shall be used for conversion of foreign currencies supported by a
certificate issued by a scheduled bank and countersigned by the supplier. All payments
will be made in Indian rupees only.
c) Net payable price will be the publishers’ printed price or (in case of price in foreign
currency) equivalent price in INR minus discount offered.
d) Rates for Medical Journals & Periodicals shall be net amount arrived at after discount on
the rates shown in the Publishers’ Price Lists/Catalog in Indian or Foreign Currency for
subscription year 2010-11. The conversion rates in Indian Currency will be as per rates
on the date on which the Draft remittance has been made to the Foreign Publishers.
Proof of remittance has to be produced to the Medical Superintendent, ESI Hospital,
Sector-15, Rohini,New Delhi-85.
e) Bill in triplicate (pre-receipted) for the Medical Books supplied will be submitted by the
tenderer in the name of Medical Superintendent, ESI Hospital, Sector-15, Rohini New
Delhi-85 for payment. The payment will be released only after the entire supply has
been received to the satisfaction of the Medical Superintendent.
f) The bill should bear the certificate from the supplier that only Medical Books/Medical
Journals (Indian/Foreign) of latest edition(s) have been supplied and that the prices have
been charged correctly and in accordance with the latest publishers catalogue/invoice
or importer/distributors invoice.
7. TERMS OF DELIVERY:-
Free of cost delivery at Library Department, ESIC Dental College & Hospitall, Sector-15, Rohini,
Delhi-85
8. DELIVERY PERIOD:-
(a) For delays-if the supplier fails to supply books, & journals as per purchase order within the
time period specified in the contract, the purchaser shall deduct from contract price a sum
equivalent to 0.5 percent of the price of delayed items for each week of delay or part thereof
until actual delivery up to a maximum of 10 (ten) percent. Once the maximum reached, the
purchaser may consider termination of the contract.
(b) Termination for default: - The purchaser may, without prejudice to any other remedy or
breach of contract, by written notice of default sent to the supplier, terminate the contract in
whole or part if the supplier fails to deliver any or all publications ordered to him within the
time period specified in the contract, or if the supplier fails to perform other obligation(s) under
the contract. In the event of the termination of the contract by ESI Hospital in whole or in part,
the hospital may procure, upon such terms and in such manner as it deems appropriate the
undelivered books, Medical Journals & periodicals and the supplier shall be liable to pay for any
excess costs for such purchases. However, the supplier shall continue performance of the
contract to the extent not terminated.
(c) Force majeure - The supplier shall not be liable for (a) and (b) above, if its delay in
performance or other failure to perform its obligations under the contract is the result of an
event of force majeure(means an event beyond the control of the supplier and not involving
the supplier’s fault or negligence and not foreseeable). Such events may include, but are not
restricted to, acts of the purchaser either in its sovereign or contractual capacity, wars or
revolutions, fires, floods, epidemics, quarantine restrictions and freight embargo. The supplier
shall promptly notify the purchaser in writing of such conditions and the causes thereof.
12. INSPECTION
Medical Books and Medical Journals (Indian & Foreign) will be accepted only after the
inspection by the Medical Superintendent or any officer authorized by him.
Bidders are required to comply with the above requirements and submit their tender
complete in all respects and submit following documents along with the tender by the due
date and time in sealed cover super-scribing “Tender For Supply Of Medical Books and
Medical Journals :-
i) Copy of the Tender Form along with Annexure –I, Annexure-II & Annexure-III duly filled
and signed.
ii) Tender Earnest Money deposit
iii) Copy of PAN card issued by Income Tax Department and Copy of the Income Tax
Return for the financial years 2009-10.
13. No tender may be withdrawn in the interval between the deadline for submission of
tenders and the expiry of the period of tender validity. Withdrawal of a tender during
the interval may result in the Bidder’s forfeiture of its Earnest Money Deposit.
14. The successful Bidder shall not in any case sublet the contract in full or any part of it to
third party.
15. Tenders not meeting any/ all of the aforesaid requirement(s) shall be rejected.
16. Conditional tenders are liable to be out-rightly rejected.
17. The Medical Superintendent reserves the right to accept or reject any tender and to the
annul tendering process and reject any or all tenders at any time prior to award of the contract,
without thereby incurring any liability to the affected Bidders or Bidders or any obligations to
inform the affected Bidders or Bidders of the grounds for the purchaser’s action.
In case of a dispute or difference arising between supplier and purchaser relating to any
matter arising out of or connected with the contract, such dispute or difference shall be
referred to the Sole Arbitrator duly appointed by the Director General, ESI Corporation, Head
quarters’ office, CIG New Delhi-110002. The award of the arbitrator shall be final and binding to
the parties concerned.

NOW THEREFORE we hereby affirm that we are guarantors and responsible to you, on behalf

in words & figures), such sum being payable in the types and proportions of currencies in
which the contract price is payable, and we undertake to pay you, upon your first written
demand declaring the supplier to be in default under the contract and without cavil or

therein.
We hereby waive the necessity of your demanding the said debt from the supplier before
presenting us with the demand.
We further agree that no change or addition to or other modification of the terms of the
contract to be performed there under or of any of the contract documents which may be made
between you and the supplier shall in any way release us from any liability under this guarantee
and we hereby waive notice of any such change, addition or modifications This guarantee shall
be valid until the date of issue of the acceptance certificate issued by purchaser’s
representative.
