CONCRETE PLACING AND FINISHING WORKS


GENERAL TERMS AND CONDITIONS

I. SCOPE OF WORK
1. MCE ROCKTECH PHILS. CORPORATION (ROCKTECH) shall undertake completely the
concrete placing work and surface as per plan and specification.

2. ROCKTECH scope of work shall be limited to, elevation setting, spreading of the
discharged concrete, vibrating using a motorized concrete vibrator, screeding the
concrete to the desired elevation, application of float pan and performing the
required floor finish.

3. ROCKTECH shall provide the necessary equipment and hand tools to execute the
above scope of work.

4. CLIENT shall make available the supply of water for cleaning of equipment and hand
tools, likewise for worker’s sanitation purposes. Cement grout or any equivalent
material is to be provided by the CLIENT and in any manner not included in the
contract price.

5. CLIENT shall make available power supply for all electric driven motorized equipment
and hand tools, likewise for lighting fixtures required at site.

6. ROCKTECH shall accumulate all debris generated during the execution of its work
and haul-out the same to an area designated by the CLIENT, while other debris and
waste materials caused by pump breakdown or pipe de-clogging activities shall be
to the account of the CLIENT.

7. ROCKTECH, in the event of rained pours, shall not be liable for any damages due to
the absence of roofing on areas poured. Relatively, there will be no guarantee on
the quality of finished areas as well.

8. ROCKTECH, shall not be held liable to any cracks emanating from any of the poured
areas as these are mainly due to poor compaction, inferior quality of concrete,
movement of the structure, temperature change, improper curing and other sources
not attributed to workmanship.

9. Honeycomb traceable to the following reasons shall not be the responsibility of


ROCKTECH:
a. Poor quality of concrete, re; harsh or boney concrete, over-mix or spoiled
concrete and slump of concrete lower than 6”
b. Defective formworks
c. Insufficient shoring and anchoring.
d. Unclean pouring decks and the presence of barriers such as styro foam and the
likes.
e. Poorly installed re-bars with insufficient width to accommodate passage of
vibrator shaft.
II. SCHEDULING REQUIREMENTS
1. Reservation requirements
a. ROCKTECH aims to provide our client the prompt service expected from us, we
therefore adopt “First-Call / First-Served” basis. CLIENTS are required to place a
reservation at least three (3) days before their desired schedule and must re-
confirm this schedule a day before. CLIENT’s failure shall give ROCKTECH the
right to allot the schedule to the next client in line or change the cancellation
fee stipulated in the contract in the event it has mobilized its network at site but
there is no work to be performed.

2. Information requirements:
a. CLIENT is required to provide the following project information when reserving
for a schedule:
1) Project name and project location
2) Structure to be poured
3) Estimated volume of concrete to be poured
4) Floor level where the concrete is to be poured
5) Required surface finishing
6) Name of the project in-charge to be assigned during pouring operation
who will entertain the conduct of site inspection and who will acknowledge
acceptance of the work accomplishment.
7) Project vicinity map (sketch leading to the project site from a known
landmark) delivered to our office thru facsimile, and;
8) Other pertinent information deemed necessary to the proper execution of
the scope of work stipulated in the contract.

III. OPERATIONAL REQUIREMENTS


1. A lifting equipment is to be provided by the client in order to properly position
ROCKTECH’s tools and equipment to the required pouring deck. The CLIENT shall
also provide ROCKTECH a place for field office, warehouse, shed and barracks
posted with its billboard if needed.

2. Required Site Coordination Procedure


a. ROCKTECH shall be allowed by the CLIENT to coordinate for the location of the
concrete pump and its pipes at site. Shall also be allowed to coordinate for the
required concrete slump, in case CLIENT opted to use concrete pumps as a
method of transporting and discharging the concrete mix.

3. Reference volume of concrete poured shall be the Delivery Receipt (DR) of the
ready mix concrete provider.

IV. SAFETY REQUIREMENTS

Safety shall be the utmost concern of the contracting parties. Should there be
deficiency on the various safety provisions of the project, ROCKTECH reserves the right to
cancel the concrete placing work and appropriate cancellation fee shall be charged
to the CLIENT until remedied and the resumption is called to order.
V. LEGAL MEASURES

In the event that a court litigation arises due to a non-payment of billings and charges
by the CLIENT, ROCKTECH is entitled for a One Hundred Thousand & 00/100 (Php
100,000.00) liquidated damages fee on top of all monetary claims. Attorney’s fee shall
be twenty five percent (25%) of the total claim which in no case shall not be less than
Ten Thousand & 00/100 (Php 10,000.00). All cases shall be filed in Imus, Cavite,
Philippines.

CERTIFICATE AND CONFIRMATION

This is to certify and confirm that we have read, understood and agreed with the above
stated Concrete Placing and Finishing Terms and Conditions.

All other conditions and scenarios not covered by these Terms and conditions, or issues that
may arise during the pour, will be dealt with amicably by both parties.
