INTERIOR IMPROVEMENTS

This Contract is between NATHANIEL PEREZ (the “Client”) and THE BULL PAINTING
(the “Business”).

Project Address: 2176 WILTON DRIVE, WILTON MANORS FL 33305

The Contract is dated 8/23/2021

1. Scope of Work/Payment:
1.1. Project Description: The Client is hiring the Business to do the following: WALL
CONSTRUCTION, BATHROOM TILING AND REPAIRS, INTERIOR AND
FLOORING PAINTING, CARPENTRY, LAMPS REPLACEMENT (MORE
DETAILED SCOPE OF WORK ON ESTIMATE N° 21150)
1.2. Schedule: The project will begin on: 08/25/2021 and must be complete by
9/12/2021 , with the exception of unforeseen circumstances or failure to meet
payment requirements.
1.3. Payment Schedule:
1.3.1. Flat Price: The Client will pay the Business $ 12,000 for the completion of

1.3.2. Upfront Deposit: The Client will pay the Business $6,000 by 08/24/2021 to
ensure the project is started on time and $ 6,000 for the completion of

1.4. Payment Terms: Payment shall be made to the Business in Cash, Check,
Cashier check, Credit Card, Bank transfer, or Online payment. If any invoice is not
paid when due, this could result in suspension or termination of the project. If the
Client fails to pay for the Services when due, the Business reserves the right to treat
such failure as a breach of this Contract. Any legal fees associated with such will be
the Client’s responsibility.
1.4.1. Invoices: The Business will invoice the Client on the dates listed in the
Payment Schedule section. The Client agrees to pay the invoice with the amount
owed within Two days.
1.4.2. Late Payments: If the Client fails to pay the Business on time per agreed
upon payment schedule, the Business may suspend work until delinquent
payments are brought current. If payments are delinquent for more than 5 days
then the Client will be subjected to a late fee of $300.
1.4.3. Expenses: Client shall pay to the Business any expenses incurred by the
Business in the provision of services under this Agreement, including, but not
limited to materials not included on original estimates no later than 2 days after
receipt is provided.
1.5. Refund and Cancellation Policy/Warranty:
1.5.1. No Refunds: Services completed as described in this contract are not
subject to refunds. The Client will not be reimbursed for services cancelled once

Warranty Policy: No refunds will be provided for work completed as described in this contract.
Services for work completed are warranted to be free from defects or workmanship for 2 years,
Subject to the limitations set forth below, The Business will repair peeling, blistering or
chipping paint resulting from defective workmanship.

For this warranty to be valid, you must:


 Pay the full contract price
 Retain a copy of the original contract
 Retain a copy of your cancelled check or other evidence of payment in full
 Pay for all materials used to perform the repairs
 Make the property accessible to the Contractor, or his employees, to perform the
repairs
This limited warranty does not cover:
 Any work not supplied by the Contractor, including paint or other materials
 Any work which was not performed by the Contractor
 Houses older than 1982
 Varnished surfaces
 Surfaces made of, or containing, galvanized metal
 The cost of paint required to perform the repairs
 Paint failure at horizontal surfaces or any surface that, by virtue of its design permits
moisture to collect. Surfaces include, but are not limited to, decks, railings, stairs,
porches, roofs, and wood gutters
 Exact paint match as environmental conditions will affect the color and finish of all
paints over time
 Any repairs which are necessitated as a result of a defect in the paint regardless of
whether the paint was supplied by the Contractor or the customer
 Bleeding caused by knots, rust or cedar
 Cracks in drywall, plaster, Stucco or wood
 Driveways and Stamped concrete painting
 Peeling, blistering or chipping where they are caused by:
 mill-glazing from smooth cedar
 ordinary wear and tear
 abnormal use or misuse
 peeling of layers of paint existing prior to the work performed by the Contractor
 structural defects
 settling or movement
 moisture content of the substrate
 abrasion, mechanical damage, abrasive cleaning, abuse, or damage resulting
from use of chemicals or cleaning agents or exposure to harmful solids, liquids or
gases
 damage or defects caused in whole or in part by reason of fire, explosion, flood,
acts of God, extreme weather conditions, misuse, alterations, abuse, vandalism,
negligence, or any other similar causes beyond the control of the Contractor
Repairs under this limited warranty will be performed only on the specific areas where
peeling, blistering or chipping has occurred and only to the level of surface preparation
described in the preparation section of this Contract.

THIS LIMITED WARRANTY IS THE ONLY EXPRESS WARRANTY MADE BY THE


CONTRACTOR AND IS IN LIEU OF ALL OTHER WARRANTIES, EXPRESS OR IMPLIED.
THIS WARRANTY COVERS ONLY THOSE SERVICES PROVIDED BY THE
CONTRACTOR TO THE ORIGINAL PURCHASER NAMED ON THE FRONT OF THIS
CONTRACT. IN NO EVENT SHALL THE CONTRACTOR BE LIABLE FOR INCIDENTAL
OR CONSEQUENTIAL DAMAGES OR DAMAGES IN EXCESS OF THE ORIGINAL
CONTRACT PRICE. THIS WARRANTY MAY NOT BE ALTERED OR EXTENDED FOR
ANY PURPOSE UNLESS DONE SO IN WRITING IN A DOCUMENT EXECUTED BY ALL
PARTIES TO THIS CONTRACT.

2. Representations:
2.1. Authority to Sign: Each party promises to the other party that it has the authority
to enter into this Contract and to perform all of its obligations under this Contract.
2.2. Client will Review Work: The Client promises to review the work product, to be
reasonably available to the Business if the Business has questions regarding this
project, and to provide timely feedback and decisions.

3. General:
3.1. Modification(s): To change anything in this Contract, the Client and the
Business must agree to the change in writing and sign a document showing their
contract.
3.2. Signatures: The Client and the Business must sign the document either
electronically or in hardcopy. If this document is signed in hard copy, it must be
returned to the Business for valid record. Electronic signatures count as originals
for all purposes.
4. Term and Termination: This Contract ends on 9/12/2021, unless the Client or
the Business ends the contract before that time. If one of the parties chooses to end
the Contract prior to project completion, the Client is responsible for paying for all
work and costs incurred up until that date.
