KNOW ALL MEN BY THESE PRESENTS:
This CONTRACT TO SELL, made and executed this ____ day of _________, 20__ by and between:
ROLINIO P. POZAS, of legal age, married to MARISSA P. POZAS, Filipino, and with residence and postal
address at #127 Gov, Ferrer Subdivision, Pinagtipunan, Gen, Trias, Cavite, hereinafter referred to as the
"SELLER";
-AND-
NOVI JAMAICA B. ANGELES, Filipino and with residence and postal address at Block 10 Lot 2 Green City
Subdivision, Malagasang II-A, Imus, Cavite, hereinafter referred to as the "BUYER".
WITNESSETH;
WHEREAS, the SELLER is the absolute and registered owner of a parcel of land consisting of One Hundred
Fifty (150) square meters, more or less, located at Lot 6 Block 8, Phase 1-A, Pallas Athena Executive Village,
Bgry. Anabu II, Imus Cavite and covered by Transfer Certificate of Title No. 057-2011003046 issued by the
Registry of Deeds of Province of Cavite;
WHEREAS, the BUYER has offered to buy and the SELLER has agreed to sell the above mentioned property
under the terms and conditions herein below set forth;
That for and in consideration of the total sum of One Million Five Hundred Thousand Pesos (Php: 1,500,000.00)
Philippine Currency, and of the covenants herein after set forth the SELLER agrees to sell and the BUYER agrees
to buy the aforesaid property and which parcel of land is known as:
1. The total consideration shall be One Million Five Hundred Thousand Pesos (Php: 1,500,000.00), Philippine
Currency, payable as follows:
a) The amount of Three Hundred Thousand Pesos (Php: 300,000.00), representing earnest money shall be payable
by the BUYER to the SELLER upon signing of this Contract to Sell;
b) The remaining balance in the amount of One Million Two Hundred Thousand Pesos (Php: 1,200,000.00), to be
paid upon the approval and/or release of the loan from the Bank of the Philippine Islands.
2. The SELLER upon receipt of the Bank Guarantee from Bank of the Philippine Islands shall;
a) Capital Gains Tax and Real Estate Tax, shall be for the account of the BUYER/VENDEE;
b) Documentary Stamps Tax, Registration Fee, registration expenses, and all other miscellaneous fees and expenses
shall be to the account of the BUYER/VENDEE;
c) In case the BUYER/VENDEE should cancel this Contract, part of the down payment in an amount
equivalent to ten (10) percent per month of the amount received will be forfeited by the SELLER/VENDOR;
In the same manner, should the SELLER cancel this Contract, the BUYER has the right to demand the return
of the amount received by the SELLER;
