With reference to our meeting at your good office and subsequent to visit of construction site
dated 9th of May’22 with regard to the Role of an independent Owner’s Engineering Services for
Supervision of Construction of Residential Bungalow at Yemalur, Bangalore, we are pleased to
submit our techno-commercial proposal that shall encompass the work scope towards the
completion of mentioned works.

2 BACKGROUND
Mr. Sushil Kumar Bhuwalka, Managing Director of Bhuwalka Premier Group of
Companies, Bangalore (Herein after referred to as “Client”), is constructing a Residential
Bungalow in Yemalur locality of Bangalore.
The overall project goals are to create an upscale residential property of high
architectural and engineering standards and quality. The Residential Building is of
16000 Sqft area consisting of Ground Floor + First Floor + Roof with Garden Area.
As part of supervision of entire engineering, procurement and construction works,
Client is looking for an Owner’s Representative(s) to perform the following tasks:
a. Act as an overall in-charge of the project, and
b. Review the engineering design, architectural works, plumbing, electrical, HVAC,

3 PURPOSE
We, Ashkam Energy Pvt. Ltd. (hereinafter referred to as “ASHKAM”) understand that
Client intends to engage consultant to provide Detailed Engineering for the construction
of his dream Residential Building.
In this respect, the Client requires the services of Owner’s Engineer(s) to be rendered

for facilities and works covered under the scope of work. For this purpose, the Client
has invited Ashkam Energy Private Limited (ASHKAM) to submit the proposal to render
the engineering & consultancy services for this project.
This document presents the Techno-Commercial proposal prepared by ASHKAM in
response to the Invitation/Proposal request from the Client for rendering services for
the subject project.
4 SCOPE OF SERVICE
In accordance with requirements set forth in this contract, the project shall be
undertaken to include the following:
a. Act as an overall in-charge of the project, and
b. Coordinate with the Client during the review of the design and documents.
c. Coordinate and assist the Clients ‘s representatives and architects in all meetings.
d. Review the engineering design, architectural works, plumbing, electrical, HVAC,
Painting, All BoQs.
e. Monitor the construction activities in close coordination with the Client’s
appointed PMC and Engineering Consultants.

5 LIST OF DELIVERABLES
The deliverables for Construction, Engineering and Procurement of Residence
Bungalow will include the following but not limited to:
i. Architectural Design
For Planning of construction of any structures including building, bridges and other

major structures, architects will prepare the architectural Layouts and drawings by
using computer modelling software and data from surveys, tests and maps to create
project blueprints. Following activities provided below which will be taken for the
aforesaid project.
Civil & Structural Engineers will prepare Structural drawing based on the Architectural
layouts and shall be checked for the safety and serviceability of the structure as per the

Indian codes and Standards. Following documents prepared below will be taken for the
aforesaid project.
Electrical engineers will prepare the electrical design basis, develops electrical load

balance and single line diagram with the help of suitable software, test, and supervise
the manufacture of electrical equipment, such as radar and navigation systems,
communications systems, or power generation equipment.
The Mechanical data such as design data, protective coating & insulation, scope of
supply, material of construction, nozzles data, equipment sketch, shall be included
complying the requirements of client technical specifications and applicable
international codes and standards.

In order to ensure that the Client receives an excellent level of services, ASHKAM will
provide a team which includes:
✓ Project Manager
✓ Site Engineer
✓ Project Coordinate Engineer at Client’s Office
✓ Engineering discipline leads support (Civil/Structural/Architectural, Piping
(Plumbing) & Electrical and HVAC)
responsibility for:
• Review and approval of Engineering methods and procedures,
• Cost & budget management,
• Equipment / means operations.
✓ Leading safe behavior and supporting open communication regarding safety issues.
✓ Supervision of all personnel seconded to him.
✓ Direct liaison with Managers/Supervisors who are in charge of Project services, and
who are directly responsible for all personnel/equipment allocated to the Project.
✓ To be conversant with all items and conditions of the Project both technically and
commercially and to have a full understanding of the scope of work.
✓ Responsible for the implementation, control and monitoring of overall Quality
Assurance in all projects related activities.
✓ Responsible for the preparation and maintenance of budgets for the Project assisted
by the Project Controller.
✓ Responsible for identifying and initiating any variations towards the Company.

✓ To witness and co-ordinate the construction works at onsite and off site.
✓ Make, develop and encourage any technical suggestions that will enhance the
overall Project Engineering or Operational efficiency.
✓ Implement and organize any approved modifications to the Project, ensuring all
changes are fully documented and included in the appropriate documents.
✓ Liaise with and co-ordinate the activities of vendors and Subcontractors as and
when required as a part of the Project, without commercial authority.
✓ Assist with inspection of incoming items;
✓ Interface with the other engineers to guarantee all design work is carried out
with the common target of optimizing final cost and schedule.

resource stays within assigned schedule and cost targets. Ensure that all
personnel under their control are suitably qualified to undertake the work
assigned to them.
✓ Responsible for all engineering activities associated with the task, which shall be
reviewed and approved accordingly. This also includes, but is not limited to,
documentation such as Specifications, Procedures, Calculations, Reports, etc. The
Lead Engineer is also responsible for the final dossier.
✓ Responsible for all interfaces relevant to the task under their responsibility. This
includes, but is not limited to, Client, Subcontractors, Internal Entities etc
✓ Ensure that the Cost Controller/Planner is provided with adequate information
to enable correct and accurate preparation of Project status report for the task
under their responsibility.
✓ Responsible for initiating actions to prevent non-conforming condition or
product. Initiating, recommending or providing solutions to non-conformances.

Verifying the implementation of corrective action and ensuring that these have
been effective and controlling further work until the deficiency or unsatisfactory
condition has been corrected and the root cause resolved.
✓ Conduct all activities within the management system, Policy, Procedures and
Work Instructions.
✓ Perform engineering tasks as per Project Engineer, when applicable, in order to
complete scopes of work as identified by the Project Manager or Engineering
Manager
✓ Ensure that the relevant Project Engineers are kept up to date and informed
about the direction and methods that the Project engineering is following.

✓ Identify and supervise all technical resources needed to complete the task.
Assign and coordinate scopes of work, review work done and ensure each
resource stays within assigned schedule and cost targets. Ensure that all
personnel under their control are suitably qualified to undertake the work
assigned to them.
✓ Responsible for all engineering activities associated with the task, which shall be
reviewed and approved accordingly. This also includes, but is not limited to,
documentation such as Specifications, Procedures, Calculations, Reports, etc. The
Lead Engineer is also responsible for the final dossier.
✓ Responsible for all interfaces relevant to the task under their responsibility. This

8 TIMELINE
The service of ASHKAM as Owner’s Engineer is envisaged upto the completion and
commissioning of the Project by end of Q2’ 2023 from the day of receipt of Work Order.
9 CONSULTANCY FEE
The basic and firm fixed fees towards the consultancy services pursuant to this proposal
for the said Project as presented below shall be payable by the Client to ASHKAM.

NOTES:
i. The fees are exclusive of all statutory taxes. The direct taxes, indirect taxes, withholding
taxes, GST, Service Tax, etc. shall be borne by the Client, and any deductions made from the
Consultant’s fees shall have to be reimbursed by the Client. GST would be payable at the
rates prevailing at the time of payment.
ii. The fees are inclusive of out-of-pocket expenses towards accommodation, food, travelling.
iii. All the security arrangement during site visit shall be managed by Client
iv. Payment shall be made within 15 days upon issuance of Invoice.

vii. The Consultancy shall be under no liability whatever to the Client for any indirect loss
and/or expense (including loss of profit) suffered by the Client arising out of a breach by the
Consultancy of these terms and conditions.
viii. In the event of any breach of this contract by the Consultancy the remedies of the Client shall
be limited to damages. Under no circumstances shall the liability of the Consultancy exceed
the Fee of the Services.
ix. The Client shall not be entitled to set off against or deduct from the Fee any sums owed or
claimed to be owed to the Client by the Consultancy.
x. The Consultancy reserves the right to review these terms and conditions at any time. If,
following any such review, there is to be any change to these terms and conditions, then that
change shall take effect from the date on which the Consultancy notifies the Client of such
change. Except where the Consultancy supplies further Services to the Client and the Client
accepts such Services, the Client shall be under no obligation to accept such changes.
xi. In the event of a default in performance or event of termination, all calculations report in

the possession of ASHKAM shall be subject to lien for the payment of all fees and expenses
due and owing by virtue of this agreement.
10.2 Confidentiality
i. All correspondence forwarded by the Consultancy to the Client and relating to any and all
Candidates shall be considered to be strictly private and confidential between the parties
involved and cannot be forwarded to any other party unless formal written permission is
given, in advance, by the Consultancy.
ii. Should these conditions be breached by the Client the Consultancy reserves the right to
charge the Client a penalty Fee equivalent to the value of the original placement Fee for the
Candidate.
10.3 Disclaimer
i. The Consultancy interviews Candidates and obtains details from them of their
qualifications, skills and experience, which the Consultancy records and retains. The
information contained in the Consultancy’s assessment and report is therefore based on
details supplied to the Consultancy and is correct to the best of the Consultancy’s
