HELD ON JULY 21, 2014, 2:00 P.M., MONDAY,

CITY RESOLUTION NO. 077-2014

A RESOLUTION APPROVING THE CONDUCT OF THE "BARATILLO" AND


AUTHORIZING THE CITY MAYOR TO NEGOTIATE WITH QUALIFIED OPERATORS

WHEREAS, the traditional celebration of the Patronal Feast of Tuguegarao is highlighted by the
"Baratillo" flea market activity along the streets surrounding the Tuguegarao Central Market from August
1 to September 15 annually;

WHEREAS, the City Mayor, Hon. Jefferson P. Soriano, through a letter dated July 18, 2014,
requested for an authority from the Sangguniang Panlungsod to conduct "Baratillo" around the premises
of the Tuguegarao City Central Public Market from August 01 to September 15, 2014;

NOW THEREFORE RESOLVED, to approve the conduct of the "Baratillo" from August 1,
2014 to September 15, 2014 and to grant authority to the City Mayor, Hon. Jefferson P. Soriano, to
negotiate with interested and qualified operators on the following conditions:

For the Operator:

1. To secure a Mayor's Permit;


2. To install and dismantle the stalls;
3. To pay the electric and water bills;
4. To maintain the cleanliness and sanitation within the premises;
5. Not to use flammable materials such as LPG and firewood;
6. Not to extend the time and days of operation; and,
7. To pay a penalty of automatic prohibition of entering any future contract with the City
Government of Tuguegarao until such time that the said obligation is settled, if he/she fails to
pay the stipulated contract amount.

For the Tuguegarao City Government:

1. To itemize all fees paid by the operator;


2. To re-route the flow of traffic to ensure orderliness; and,
3. To make sure that a fire truck shall always be available at the vicinity.

RESOLVED FURTHER, that the amount of the contract price is One Million Seven Hundred
Thousand Pesos (P1,700,000.00), however, if there is no taker, the City Mayor may negotiate for the best
terms but not lower than One Million Five Hundred Thousand Pesos (P1,500,000.00) and, if still there is
no taker, the amount of One Million Five Hundred Thousand Pesos (P1,500,000.00) shall be divided
among the interested locators;

RESOLVED FURTHER, that the collection and disbursement of fees shall strictly conform
with the provisions of RA 9184, and accounting, budgeting and auditing rules and regulations;

RESOLVED FINALLY, that if for any reason that any section or provision of this resolution is
declared unsconstitutional by the Constitution and other laws and statutes, other sections or provisions
hereof which are not affected thereby shall continue to be in full force and effect.

On motion of Hon. Estelita U. Dayag, duly seconded by Hon. Jude T. Bayona, and without
objection from the Body, CITY RESOLUTION NO. 077-2014 was UNANIMOUSLY APPROVED.
