CITY RESOLUTION NO. 104-2015

A RESOLUTION APPROVING THE CONpUCT OF THE "BARATILLO" AND

AUTHORIZING THE CITY MAYOR TO TRANSACT WITH QUALIFIED OPERATORS

WHEREAS, a tradition and part of the celebration of the Patronal Feast of Tuguegarao is the
"Baratillo" flea market activity which is usually held at the portions of some streets of Tuguegarao City to
attract Tuguegarao City constituents and those from other places to witness the activities designed for the
celebration;

NOW THEREFORE RESOLVED, that the "Baratillo" shall be conducted from July 27, 2015
to September 15, 2015 and to grant authority to the City Mayor, Hon. Jefferson P. Soriano, to transact
with interested and qualified operators on the following conditions:

For the operator:

1. To secure a Mayor's Permit;

2. To install and dismantle the stalls;
3. To pay the electric and water bills;
4. To maintain the cleanliness and sanitation within the premises;
5. To secure and ensure the safety of their goods and personnel;
6. To provide Portable Toilets to be used by exhibitors;
7. To have at least three years experience in operating a flea market
8. Not to use flammable materials such as LPG and firewood;
9. Not to extend the time and days of operation;
10. To pay a penalty of one percent (I%) per day of the unpaid balance until the same shall have been
fully settled and failure on the part of the operator to settle his/her obligation shall be a ground for
disqualification from participating in any contract with the Tuguegarao City Government in the
future;

 11. To post a security/surety bond in such amount as may be fixed to guarantee the performance of
the operator's obligations and to answer for whatever damages incurred in the operation of the
business; and,
12. To provide six (6) pieces ten-pounder fire extinguishers and coordinate with the fire marshal for
the locations.

For the Tuguegarao City Government:

1. To create a Special Committee to facilitate the conduct of the bidding process subject to pertinent
laws, rules and regulations;
2. To itemize all fees paid by the operator;
3. To re-route the flow of traffic to ensure orderliness;
4. To make sure that a firetruck shall always be available at the vicinity;
5. To provide relocation sites for street vendors;
6. To provide parking spaces for tricycles; and,
7. To insure public safety, peace and order in the vicinity.

RESOLVED FURTHER, that the amount of the contract price shall not be lower than One
Million Seven Hundred Thousand Pesos (P1,700,000.00), with a thirty percent (30%) down payment
upon execution of the contract and the balance shall be paid on or before September 10, 2015, however, if
there is no taker, the City Mayor may negotiate for the best terms but not lower than One Million Seven
Hundred Thousand Pesos (P1,700,000.00) and, if there is no taker, the amount of One Million Seven
Hundred Thousand Pesos (P1,700,000.00) shall be divided among the interested locators.

RESOLVED FINALLY, that the collection shall form part of the revenues of the Tuguegarao
City Government.

On motion of Hon. Rosauro G. Resuello, with the inhibition of Hon. Aurora A. Ave and without
any objection from the Body, CITY RESOLUTION NO. 104-2015 was APPROVED on its Second and
Final Reading under suspended rules.
