JOINT RESOLUTION NO. 01
Series of 2021

JOINT RESOLUTION AMICABLY ESTABLISHING AND DEFINING THE BOUNDARY


OF THE MUNICIPALITY OF SABLAN AND THE MUNICIPALITY OF TUBA BOTH IN
THE PROVINCE OF BENGUET.

WHEREAS, there exist a political boundary dispute between the two (2)
municipalities which started way back in the 1940s;
WHEREAS, the Office of the Provincial Board on May 17, 1949 passed
Resolution No. 314 "Establishing the permanent boundary within the disputed area of
the Municipal Districts of Sablan and Tuba, Benguet as follows:

"Starting from the City Monument at Irisan Bridge, Tuba following


the National Road (Naguillian Road, Highway No. 9) down to the highest
point of Bisiyan Hill which is directly southwest of Kilometer Post 10
(Baguio City), then due west following Sukong Creek, turning at junction of
the Batuan Creek and following said creek to southwest, down to Galliano
River due south, and finally to the Benguet — La Union boundary".

WHEREAS, on December 22, 1982, the Court of First Instance of Baguio and
Benguet, Second Judicial District, Branch III passed a Resolution/decision establishing
the boundary within the disputed area between the municipalities of Tuba and Sablan
adopting in toto the Provincial Board Resolution No. 314;

WHEREAS, the said court decision did not provide the technical descriptions of
the new established boundary;

WHEREAS, both municipalities are cadastrally surveyed. CAD 1008-D, Sablan


Cadastre, surveyed and approved on October 19, 1992 while CAD 656-D, Tuba
Cadastre, surveyed and approved on December 4, 2008;

WHEREAS, the approved political boundaries of both municipalities resulted in


overlapped/gap of 436.1132 hectares instead of 68.5655 hectares due to the varying
T4 interpretations of the above-mentioned court ruling;

WHEREAS, on September 17, 2020, the Sangguniang Panlalawigan of Benguet


initiated a consultation meeting for the possible settlement of all boundary disputes
between the municipalities in the Province of Benguet in which the officials of the
municipalities of Tuba and Sablan signified their intention to discuss and amicably settle
the boundary dispute between the two municipalities;

WHEREAS, on October 23, 2020, a joint meeting was held at the Sablan
Municipal Hall wherein both the municipalities of Tuba and Sablan presented available
documents establishing the history of the political boundary dispute and thereafter
several follow up meetings and ocular inspections were conducted to locate the DPWH
Kilometer Post No. 10 and Sukong Creek as points of reference;

WHEREAS, on March 17, 2021, another meeting was conducted at the


Sangguniang Panlalawigan Session Hall with both the parties together with the
representatives of the Department of Public Works and Highways-Benguet Engineering
District 1 and it was agreed that the point of reference in resolving the dispute shall now
be the Sukong Creek to Galliano;

WHEREAS, on April 15 and 16, 2021, a joint survey using the Real — Time
Kinematic positioning (RTK), a satellite navigation technique for modern surveying, was
conducted at Yagyagan Elementary School, Sukong Creek, Ampusa Provincial road,
Baguio-Bauang National road and portion of Nangalisan, Asin, Tuba, Benguet by the
municipal assessors of both municipalities, personnel from the DENR-CAR, Provincial
Engineering Office and staff from the Sangguniang Panlalawigan of Benguet;

WHEREAS, on May 5, 2021, initial plotting of the result of the survey was
conducted at the SP Session Hall and upon the request of the municipal assessor of
Sablan, a final ocular inspection at the extreme part of Sukong Creek was conducted on
May 11, 2021 with the municipal assessors and some municipal and barangay officials
of both municipalities together with some staff of the Sangguniang Panlalawigan of
Benguet;

WHEREAS, on June 23, 2021, a joint meeting was again conducted at the
Sangguniang Panlalawigan Session Hall wherein the parties have finally determined the
final boundaries between the municipalities of Tuba and Sablan with the
recommendation that a final survey be conducted at or near the Yagyagan Elementary
School for the overview of the titled lots located therein;

WHEREAS, on July 3, 2021, a final survey for the perfection of the final
boundary map was conducted at Yagyagan Elementary School by the municipal
assessors of both municipalities, personnel from the DENR-CAR, Provincial
Engineering Office and staff from the Sangguniang Panlalawigan of Benguet;

W WHEREAS, on July 6, 2021, the municipal assessors of both municipalities,


Engr. Allan H. Contero of the municipality of Sablan and Engr. Noel G. Tomin of the
municipality of Tuba confirmed the new plotting and new corner description for both
municipalities as prepared by the technical working group based on all the meetings
and surveys that were conducted.

NOW THEREFORE, on motion of Hon. Romulo C. Polon and unanimously
seconded, be it

RESOLVED, as it is hereby resolved to pass a JOINT RESOLUTION


AMICABLY ESTABLISHING AND DEFINING THE BOUNDARY OF THE
MUNICIPALITY OF SABLAN AND THE MUNICIPALITY OF TUBA BOTH IN THE
PROVINCE OF BENGUET, to wit:
Both parties finally agreed:
1. That the area of 44,922.64 hectares shall become part of the political and
territorial jurisdiction of the Municipality of Tuba including the versus with Itogon
while the 10,747.77 hectares shall become part of the political and territorial
jurisdiction of the Municipality of Sablan including the versus with La Trinidad.

2. That the corner description and the supporting map as prepared and signed on
August 11, 2021 by the Technical Working Group headed by Engr. Benjamin A.
Ventura, hereto attached are made integral part of this resolution as Annex "A"
(Corner Description) and Annex "B" (Map);

3. That all existing tax declarations of real properties within the disputed area
declared in the municipality of Tuba which is now inside the political boundary of
Sablan be transferred in favor of the municipality of Sablan and all existing tax
declarations of real properties within the disputed area declared in the
municipality of Sablan which is now inside the political boundary of Tuba be
transferred in favor of the municipality of Tuba upon the approval/concurrence of
this Joint Resolution;

4. That any previous agreements and resolutions in conflict to this Joint


Resolution are hereby modified and rendered ineffective;

5. That this Joint Resolution shall be binding between both parties and shall
continue to have legal force and effect even after the expiration of the terms of
the municipal officials that have affixed their signatures herein; and

RESOLVED FINALLY, to forward this resolution to the Sangguniang


Panlalawigan of Benguet for their information and appropriate actions;

APPROVED."
