Nais ko pong magpasalamat sa inyong lahat para sa


ipinagkaloob ninyo sa akin na tiwala upang kayo ay aking
mapamunuan.

Tunay po itong nagging aking inspirasyon upang mabuo ang


Devolution Transition Plan (DTP), na kung saan ito ay aming
pinagaralan kasama ng mga Sangguniang Barangay para
balangkasin ang mga programa at proyekto na makakapagdulot
ng ating pagunlad bilang isang Barangay .

A RESOLUTION APPROVING THE DEVOLUTION TRANSITION PLAN OF BARANGAY ATENCIO


PROVIDING THE BARANGAY GOVERNMENT WITH A ROADMAP TO ENSURE STRATEGIC,
SYSTEMATIC AND COHERENT ACTIONS TOWARDS THE FULL IMPLEMENTATION OF
FUNCTIONS, SERVICES AND FACILITIES TO BE FULLY DEVOLVED BY NATIONAL
GOVERNMENT AGENCIES (NGAs) CONCERNED, STARTING IN FY 2022.

WHEREAS, Section 25, Article II of the Constitution provides that the State shall ensure the autonomy of
local governments;

WHEREAS, Section 6, Article X of the Constitution provides that local government units (LGUs) shall have
a just share, as determine by law, in the national taxes which shall be automatically released to them;

WHEREAS, Section 2 (a) of the Local Government Code (LGC) of 1991 (Republic Act No. 7160) (The Local
Government Code) provides that the State shall provide for a more responsive and accountable local
government structure instituted through a

system of decentralization whereby local government units (LGUs) shall be given more powers, authority,
responsibilities, and resources. The process of decentralization shall proceed from the national government
(NG) to the local government units LGUs;

WHEREAS, Section 3 (d) of the LGC further provides that “the vesting of duty, responsibility, and
accountability in local government units shall be accompanied with provision for reasonably adequate
resources to discharge their powers and effectively carry out their functions; hence, they shall have the
power to create and broaden their own sources of revenue and the right to a just share in national taxes and
an equitable share in the proceeds of the utilization and development of the national wealth within their
respective areas;”

WHEREAS, the Supreme Court (SC) decision in the consolidated cases of Congressman Hermilando I.
Mandanas, et al. vs. Executive Secretary Paquito N. Ochoa, Jr. et al. and Honorable Enrique T. Garcia, Jr. vs.

Executive Secretary Paquito Ochoa, et al. clarifies the basis for the computation of local government shares
and ordered the national government to include all collections of national taxes in the
computation of the base amount for the just share of LGUs;

WHEREAS, Executive Order No. 138 orders the full devolution of functions, services, and facilities by the
national government (NG) to local governments (LGUs) no later than the end of FY 2024. These shall
include those devolved responsibilities indicated in Section 17 of RA 7160 and in other existing laws which
subsequently devolved functions of the NG to LGUs. These fully devolved responsibilities shall be funded
from the share of the LGUs in the proceeds of the national taxes and other local revenues;

WHEREAS, Section 10 of Executive Order No. 138 orders all local governments to prepare their
Devolution Transition Plans (DTPs) in close coordination with the NGAs concerned especially with regard
to devolved functions and services that are critical to them;

WHEREAS, the DILG-DBM Joint Memorandum Circular (JMC) No. 1 dated August 11, 2021
2021 by the requires all provincial, city and municipal governments to prepare their DTPs to ensure a
strategic perspective and systematic and coherent actions towards their full assumption of devolved
functions and services starting in FY 2022;

NOW THEREFORE, on motion of HON. ANTONIO LORENZANA, Chairman on


Committee on Appropriation ;

BE IT RESOLVED, as it is hereby resolved, to approve the Devolution Transition Plan providing the
Provincial/City/Municipal/Barangay Government with a roadmap to ensure strategic, systematic, and
coherent actions towards the full implementation of functions, services, and facilities to be fully devolve by
national government agencies concerned starting in FY 2022;

RESOLVED further, that copies of this Resolution be furnished to the Honourable


Estelita M. Aquino , Municipal Mayor , the members of the Devolution Transition Committee, NGAs
concerned and the local office of DILG.

III. Profile of Barangay Atencio

A. General Description & Characteristics of the Barangay

Barangay Atencio is situated at approximately 15.7610, 120.5841, in Luzon .Elevation at the these
coordinates is estimated at 22.6 meters or 74.1 feet above sea level

puroks / sitios. The barangay has
an .It has vast plain land suitable
for agricultural purposes.

B. Demographic Reference

The Community Based Monitoring


System (CBMS) conducted in 2017-
2018 has recorded a total population
of 612 with 146 households.

However, based on the Barangay


Health Workers record the actual
population in 2020 is 871 and the
household is 240 .

Proximity of Barangay Location to Basic Services & Service Institutions

The barangay has one shared(1) health center located at nereby Barangay in Aringin and San Leon in
which services offered include the following: health consultation on minor illnesses, pre-natal and post-
partum check-ups, children’s immunizations, and other health and sanitation services. It has one (1)
public day care center, center, one (1) public elementary school , The municipality assigned its municipal
and community workers such as the Midwife, the Child Development Worker (CDW’s), Barangay
Nutrition Scholar (BNS), Barangay health Worker (BHW), Barangay Sanitary Inspector (BSI), Municipal
Agri-Technician and others to help deliver services to the barangay constituents.

C. Public Transportation

Barangay Atencio being at the western barangays can be reach anytime. It is more or less 2 kilometer from
Poblacion –the municipal seat. It is more or less twenty (20) minutes ride through a motorcycle or tricycle
from a public terminal which is more or less 2 kilometer away.
D. Credit Institutions

There is no available credit institution established in the Barangay. But there are credit institutions coming
from the mother barangay –Poblacio 1 operated in barangay Atencio and offered different forms of
financial and loan assistance to individuals to include Moncada Women’s Credit Cooperative ,CARD, Inc.,
ASA Philippines Foundation, RPM Inc, TSP Inc., that offers farm financing to the farmers.

E. Access to Electricity

98 % or 240 out of 210 households are being served by Tarlac Electric Cooperative 1 (TARELCO 1). Only
2% or 12 households without connections are using solar light, kerosene lamps or flashlights as their source
of light during night time

F. Peace and Order

Peace and order situation in the barangay is generally peaceful. The nearest police station is located at
Barangay Poblacion 1 which is more or less 2 kilometers away. The barangay have also institutionalized
their Barangay Tanod as its first line of defense from outlaws and thieves.

G. Government Land and Resettlement

There are identified informal settlers in Barangay Atencio. Most of these families are living in public spaces
or government owned lots that are intended for residential purposes however it is not yet awarded to the
residents. Nevertheless, it is not yet a big problem of the barangay considering that there is still enough
land for them and for the incoming settlers in the future.

H. Gender and Development Planning

The barangay has specific plan for Gender and Development. There are organized women group that
participated and helped in the implementation relatively on gender and development concerns.

I. Barangay Equipment and Facilities

The barangay has limited facilities and equipment. Aside from the barangay hall, day care centers,
basketball courts, multi-purpose building, and other basic facilities and equipment needed for the
operation of the barangay

Equipment such as computer, printer, television, furniture and fixtures are already in the office.

J. Barangay Officials/Personnel

The barangay council is composed of nine (9) elective officials that include the Punong Barangay,
seven (7) members of Sangguniang Barangay and the SK Chairperson, one (1) Indigenous People’s
Mandatory Representative (IPMR) and two (2) appointive officials, the Barangay Treasurer and the
Barangay Secretary. Aside from the conventional type of barangay organizational set up, there are also
service delivery workers such as twenty (20) Barangay Tanod, one (1) Barangay Nutrition Scholar
(BNS), Four (1) Child Development Teachers (CDT), Five (4) Barangay Health Worker (BHW), One (1)
Barangay Electrician and Four (4) Utility and ten (10) Lupon Tagapamayapa Member
IV. Devolution Transition Plan
State of the Devolved Functions, Services, and Facilities
The Local Government Code (LGC) of 1991, also known as RA No. 7160, mandates local government units (LGU) to assume functions, services, and facilities (FSF) to be
delivered to their constituencies. These are elaborately enumerated in Section 17 of the said code. Moreover, barangays are expected to assume FSFs centered on (i) health,
(ii) infrastructure, (iii) social services, (iv) environment, and (v) agriculture according to this law.
The Devolution Transition Team (DTP) of Barangay Atencio conducted an inventory of all the FSFs mandated by RA 7160 and other existing laws of the land, as well as
the status of their implementation; whether they are being carried out by the National Government Agencies (NGA), the higher LGUs (province or municipality) or the
barangay. The table below shows which programs, projects, and activities (PPA) the barangay is solely implementing and those that are shared with the higher LGUs and
various NGAs.

B.Phasing of the Full Assumption of the Devolved Functions, Services, and


Facilities
In light of the Supreme Court (SC) Ruling on the Mandanas-Garcia Case, LGUs will now receive a bigger funding (37.89% more) from the national government (NG). This
includes just shares not only from the national internal revenue taxes collected by the Bureau of Internal Revenue (BIR), but also from collections of custom duties collected
by the Bureau of Customs (BOC) and other collecting agencies.
Relative to this, NGAs will now receive a significantly smaller amount to fund for their usual service delivery because of the new computation. Hence, implementation of
the full devolution of FSFs to LGUs is put in place as a measure to mitigate the impact of the Mandanas-Garcia ruling wherein LGUs will now assume these services the
NGAs used to implement. Particulars of the full devolution is embodied in Executive Order (EO) No. 138, released on June 01, 2021.
However, it must be understood that assumption of these FSFs cannot be done all at one, thus, they are phased for a period of three (3) years. Found on the table below are
the PPAs of the different FSFs the barangay will take full assumption of implementing aside from the ones currently being delivered:

C.Capacity Development Requirements


In order to efficiently and effectively carry out all FSFs, both old and fully assumed, the Barangay DTP Team identified essential capacity development interventions to
prepare the whole barangay in doing so. These are spread out in a span of three (3) years, until the full devolution is completed.
