In view of the absence of Vice Mayor Sebastian Z. Duterte, Councilor Edgar P.


Ibuyan Jr. acted as Temporary Presiding Officer and called the session to order at 1:25
in the afternoon. The session began with the invocation led by Councilor Jesus Joseph
P. Zozobrado III which was immediately followed by the singing of the Philippine
National Anthem and “Tayo’y Dabawenyo.”
The Temporary Presiding Officer (TPO) directed Ms. Charito N. Santos,
Secretary to the Sanggunian to call the roll whereupon it was established that twenty-
four (24) Members of the Body were present, thus, mustering a quorum.

For the approval of the Minutes of the June 14, 2022 Regular Session, Floor
Leader (FL) J. Melchor B. Quitain Jr. presented the relevant motion which was duly
seconded by Councilors Mary Joselle D. Villafuerte, Edgar R. Ibuyan Sr., Jessica M.
Bonguyan, Pilar C. Braga, Dante L. Apostol Sr. and Wilberto E. Al-ag. As there were no
further remarks, the motion was carried.

FIRST READING

Continuing with the agenda, the Floor Leader presented a motion, duly seconded
by Councilors Villafuerte, Al-ag, Braga and Ibuyan Sr., for the approval of the following
items under First Reading:

1795 Deed of Usufruct to be executed between the City of Davao and the
Bureau of Fire Protection-Regional Office XI, Davao City Fire District
Office, represented by its Regional Director, SSUpt. Richard V.
Arbutante, relative to the use of a portion of the property covered by
TCT No. T-29751, for Baguio Fire Station, Baguio District , Davao City,
for appropriate action of the Body.

1796. Request of Anabele R. Natividad, Project Director, GIGA ACE 9, Inc., for
the passage of a Resolution interposing No Objection and favorable
endorsement to develop, construct and operate a 30MW Davao Battery
Energy Storage System Project to be situated in Barangay Binugao, Toril
District, Davao City, to the Department of Energy (DOE), Department of
Environment and Natural Resources (DENR) and other relevant agencies,
for appropriate action of the Body.

1797. Local Zoning Review Committee Resolution No. 08, Series of 2022,

Section 3-Urban Ecological Enhancement Sub-zone (UEESZ)”, for

1799. Letter of Abigail A. Empuerto, ROW Engineer, Huawei Technologies


Phils., Inc., requesting for additional work permit/clearance to allow their

Pawnshop traversing to the other side of Iñigo Street, Dakudaoand Sons
Building 3, for appropriate action of the Body.

Replying to the query of FL Quitain Jr., the SP Secretary explained that all the
items which will be left unacted by the respective committees should be endorsed to
the Archives. If the Members of the Body want to include the same in the calendar, it
can be retrieved and renumbered in the next Council.

After presenting Item No. 1507 for Third Reading, Councilor Zozobrado III
presented the proper motion, duly seconded by Councilors Braga, L.J. Bonguyan
L'Dalodo-Ortiz and Apostol Sr., hence, the following Ordinance was approved on Third
and Final Reading:

COUNCILOR JESUS JOSEPH P. ZOZOBRADO III

Item No. 1700

To discuss Item Nos. 1700 and 1725, Councilor Zozobrado III took the
podium and first tackled Item No. 1700 relative to the request for legislative authority
for the City Mayor to sign, for and in behalf of the City of Davao, the individual Deeds of
Sale executed by the City Government of Davao, as Seller, involving the lots under the
Slum Improvement and Resettlement (SIR) Project, in favor of the awardees, namely:
Susan A. Calago-Palma, Arturo R. Laurente, Tomas R. Remoticado and Dante M.
Zaballero. He stated that, during the Committee Hearing, the committee found that all
requirements have been complied with. Moreover, the City Legal declared in its legal
opinion that the contracts have no legal infirmity. After stating the favorable
recommendation of the committee, Councilor Zozobrado III presented a motion, duly
seconded by Councilors Baluran, Abella, Principe-Castrodes, Apostol Sr. and Braga, for
the approval and adoption of the Committee Report. Following the approval of the
Committee Report, the proponent presented a motion, duly seconded by Councilors
Abella, Braga and Baluran, for the approval of the Resolution entitled:

Item No. 1725 pertaining to the request for legislative authority for the City
Mayor to sign, for and in behalf of the City of Davao, the individual Deed of Sale
executed by the City Government of Davao, involving the lots under the Slum

Dennis M. Gubalane, Craig John Castañeda Neniel and Pablita C. Dumdum was next
presented before the august Body. Councilor Zozobrado III stated that the parties
presented the necessary documents during the Committee Hearing and that the City
Legal Opinion states that there is no legal impediment for the matter. When the
proponent presented a motion for the approval and adoption of the Committee
Report, Councilors Baluran, Braga and Apostol Sr. duly seconded the same, thus, it
was carried. The following motion, duly seconded by Councilors Al-ag, Baluran,
Apostol Sr. and Braga, for the approval of the Resolution below was likewise
approved:

For the corresponding Ordinance, Councilor Zozobrado III presented a motion,


duly seconded by Councilors Braga, Baluran, J.M. Bonguyan and Apostol Sr., to approve
it on Second Reading.

COUNCILOR J. MELCHOR B. QUITAIN JR.

As requested by the proponent, Councilor Bonifacio E. Militar, who was on Sick


Leave, Councilor Quitain Jr. presented Item No. 1733 pertaining to Resolution No. 06,
Series of 2022 of the Local Zoning Review Committee, entitled “A Resolution Favorably
Endorsing to the City Council the Application for Reclassification of SME Posterity
Holdings Corporation, from Low-Density Residential Zone (R-1) to Major Commercial
(C-2) Zone, located at Libby Road, Barangay Bago Gallera, Talomo District, Davao City”.
Councilor Quitain Jr. manifested that the property to be reclassified is located within a
Low Density Residential Sub-Zone (R-1) and Water Resource Zone (WRZ). In essence,
the Local Zoning Review Committee favorably endorsed the matter to the Sanggunian.
SME Posterity Holdings Corporation owns the 10,000 square meter area which it intends
to develop into a taxi garage with gas refilling station, storage and office building.
Considering that the area is located in a Water resource Zone, the applicant’s safety
measure plan/mitigating measures to protect the aquifer/water resource of the City has
been approved and was issued a clearance by the Water Resource Management
Council/Task Force. The committee recommended that the subject application for
reclassification be given appropriate action. Councilor Quitain Jr. presented a motion,
duly seconded by Councilors Villafuerte and Braga, for the approval and adoption of the
Committee Report.

Prior to the approval of the Committee Report, Councilor Abella wanted to ask
the representatives of the applicant and the City Planning and Development Office

(CPDO) some questions. However, due to technical difficulties, the Temporary
Presiding Officer declared a brief recess.

RECESS
(1:55 P.M.)

When the session resumed, Councilor Abella presented a motion, duly seconded
by Councilor Villafuerte, to convert the Body into the Committee of the Whole, to let the
resource persons participate.

COMMITTEE OF THE WHOLE

Duly recognized, Engr. Samuel Singco, representative of the City Planning and
Development Office (CPDO), screen shared an aerial view of the subject area. He
stated that their office inspected the area. There area about twenty (20) houses near
the area. Furthermore, Engr. Singco emphasized that the LZRC Resolution states that
the applicant is required to have a 3 meter buffer zone which will be planted with
molave trees. The gas refilling service will be solely for the applicant’s taxi units only.
Furthermore, no major repairs will be done there.

Councilor Abella was concerned that the proposed garage will include a repair
shop which will cause to complain due to the noise. Since Mr. Edgar Laure,
representative of SME Posterity Holdings Corporation, had technical issues, Councilor
Abella invited him to go to the Session Hall in order to answer the questions.

Clarifying that he had no serious objections due to the fact that the application
already passed the scrutiny of the Local Water Resource Management, Councilor
Mahipus however pointed out that, whenever the Sanggunian reclassifies a certain
property, the use of such property will not be limited only to the use applied for such as
a garage, in this instance. He suggested that, instead of recommending the
reclassification of a particular land, an additional allowable use be granted for the
present zone, provided it is not a prohibited use. If an applicant proposes a use that is
not prohibited in the zoning of the area but it is not among the use listed for such
zoning classification, CPDO should recommend for an approval of additional allowable
use specifically for the application. If the practice of reclassifying will be continued, the
property will not be limited to the specific use as it is originally applied for.
Consequently, it will open the gates to other usage to which others may not be
amenable.

Thereafter, Councilor Ungab asked the CPDO representative for the total area of
the Low Density Residential area. He pointed out that each zoning classification must
have a total area and that CPDO must know how much is left of the zone and how
much was reclassified. Since the Body had been experiencing technical issues,
Councilor Ungab suggested to defer the item.

Duly seconded by Councilors Marohomsalic and Al-ag, the motion presented by


Councilor Quitain Jr. to revert to the plenary was approved. Thereafter, the proponent
presented a motion, duly seconded by Councilors Braga, Villafuerte, Marohomsalic,
Mande, Al-ag, Advincula, Ungab and Abella, to defer Item No. 1733. As there were no
further questions, the motion was carried.

COUNCILOR ANTOINETTE G. PRINCIPE-CASTRODES

Item No. 1777

Upon due recognition, Councilor Antoinette G. Principe-Castrodes discussed


Item No. 1777 relative to the proposed Ordinance Institutionalizing the Davao City
Enhanced Comprehensive Local Integration Program (E-CLIP) for Former Rebels (FR’s)
and Former Violent Extremists (FVE’s) in Davao City and other pertinent programs and
services as provided by half-way house Kalinaw Village. The proponent emphasized
that the proposed Ordinance aims to further accelerate the sound development of the
City in accordance with its peace building programs and projects. Moreover, a Non-
Disclosure Agreement will be executed by the members of the E-CLIP, Kalinaw Village
personnel and employees as well as those invited in conferences and meetings was
strongly suggested in order to protect the confidentiality of information coming from
FRs and FVEs. The City Legal Opinion states that the proposed Ordinance has no
legal infirmity. When the proponent presented a motion for the approval and adoption
of the Committee Report, Councilors Marohomsalic, J.M. Bonguyan, Villafuerte and
Braga duly seconded the same, thus, it was carried. Afterward, the proponent
presented a motion, duly seconded by Councilors Mande, Acosta, Apostol Sr., Braga,
J.M. Bonguyan and Villafuerte; co-sponsored by Councilors Acosta, J.M. Bonguyan,
Braga, Villafuerte and Mande, for the approval of the Resolution as:

AND SERVICES AS PROVIDED BY THE
HALF-WAY HOUSE KALINAW VILLAGE

Subsequently, Councilor Principe-Castrodes discussed the proposed Ordinance;


some of its salient provisions are as follows:

“Section 3. – Purposes- Specifically this Ordinance aims to:

a. Provide comprehensive guidelines and clear process in the implementation of E-CLIP in


Davao City. Also, to stipulate the Kalinaw Village Operations Manual as the halfway
house, being managed and maintained by the City Government, which serves as a venue
for various interventions needed to be undertaken by FRs and FVEs in preparation for
their mainstreaming and in general serves as a governance reform strategy in Davao
City;
b. Stipulate procedure to methodically collect, store, track, manage, interpret, and utilize
data of FRs, FVEs, and receiving unit given the localized, customized, efficient,
collaborative and holistic approach through the E-CLIP Information System (E-CLIP IS,
for brevity), thereby decreasing the processing time in the release of assistance and the
reintegration of the FRs and FVEs to their communities as stipulated in Department of
the Interior and Local Government (DILG, for brevity) and Department of National
Defense (DND, for brevity) Joint Memorandum Circular 01 Series of 2021 (JMC 01 Series
of 2021, for brevity) entitled “Implementing Guidelines on the Provision of DILG-
administered Package of Assistance for FRs and FVEs under the E-CLIP;

c. Define the specific roles and responsibilities of all partners and stakeholders for the
effective and efficient implementation of the program in Davao City such as but not
limited to the Davao City E-CLIP Committee, City Social Welfare and Development Office,
Kalinaw Village, Joint Armed Forces of the Philippines and Philippine National Police
Intelligence Committee (JAPIC), Barangay Officials, Davao City Peace and Order Council,
Civil Society organizations and FRs and FVEs.

CHAPTER II.
SCOPE/ COVERAGE

Section 4. – Area of Coverage – This Ordinance and all policies herein shall cover all
areas in the City of Davao. For Davao City E-CLIP and other pertinent programs and
services, the area of coverage includes all regular CPP-NPA-NDF, Militia ng Bayan, Abu
Sayyaf Group, Maute Group, DawlaIslamiya, Bangsamoro, Islamic Freedom Fighter and
Turaife Group, referred to as FRs and FVEs, whose former units operated in Davao City,
who are themselves residents of Davao City or those who surrendered in Davao City.

CHAPTER III.
E-CLIP COMMITTEE AND KALINAW VILLAGE ADMINISTRATION

Section 5. – Implementors – To implement the provisions of this Ordinance there


shall be:

a. Davao City E-CLIP Committee;


b. E-CLIP Secretariat and Technical Working Group; and
c. Halfway House Kalinaw Village Management and Administration

Section 6. – Composition of the E-CLIP Committee –Davao City E-CLIP Committee


shall be composed by the following or the respective heads of the following offices, to
wit:

Chairperson – Davao City Mayor


Co-Chairperson - Commanding Officer, Philippine Army having jurisdiction of Davao City

Members:
- City Administrator
- City Social Welfare and Development Office (CSWDO, for brevity)
- Davao City Peace 911
- Department of the Interior and Local Government (DILG)
- Davao City Police Office (DCPO, for brevity)
- Committee on Peace and Order of the City Council
- Committee on Civil, Political and Human Rights
- Liga ng mga Barangay
- Representative from each of the following organizations:
o Representative from Civil Society Organization (CSO, for brevity)
o Davao City Chamber of Commerce & Industry, Inc. (DCCCII)
o Representative from the FRs and FVEs
o The Media Sector

6a. The City Mayor, as Chair of the City E-CLIP Committee, shall identify and
appoint the qualified representatives from the Media Sector and CSO who must be a
member of the Davao City Peace and Order Council.

6b. E-CLIP Committee shall set appropriate parameters for the FRs and FVEs
Representative nominee then unanimously vote and approve in terms of the
representation of the FRs and FVEs in the E-CLIP Committee.

Section 13. – Partners-Stakeholders- The following partner-stakeholders shall enjoy
the benefits and other assistance provided under Davao City Enhanced Comprehensive
Local Integration Program and other pertinent Assistance:

13a. Former Rebels (FRs):

13a.1. Refer to the partner-stakeholders (beneficiaries) of the program who were


members of the Communist Party of the Philippines (CPP), New People’s Army (NPA),
National Democratic Front (NDF) and Militia ng Bayan (MBs) who voluntarily abandoned
the armed struggle to become productive members of the society;

13a.2. Those who have surfaced on April 3, 2018 onwards and have expressed the desire
to abandon armed violence and become productive members of the society, including
their immediate family members; and

13a.3. Those who surfaced starting July 1, 2016 as well as those who have been
processed but did not receive the full assistance under the Comprehensive Local
Integration Program.

13b. Former Violent Extremists (FVEs)

13b.1. Refer to the partner-stakeholders (beneficiaries) of the program who were


members of the Abu Sayyaf Group, Maute Group, DawlahIslamiya, Bangsamoro Islamic
Freedom Fighters, Turaife Group and other violent extremist groups maybe identified by
the Joint AFP-PNP Intelligence Committee (JAPIC).

13b.2. Those who have surfaced on April 3, 2018 and onwards who have expressed the
desire to abandon armed violence and be part of the mainstream society including their
immediate family members, if applicable.

13b.3. Those FVEs who surfaced starting July 1, 2016, provided that circumstances of
their surrender to receiving unit maybe proven, and that assistance of the same nature
was not received.

13c.FRs and FVEs who were already beneficiaries of any previous


reintegration programsshall not be qualified to receive the Davao City E-CLIP and
other pertinent assistance provided in Kalinaw Village.

13d. Joint AFP-PNP Intelligence Committee (JAPIC) Certification

13d.1. Both FRs and FVEs must be certified by the Joint AFP-PNP Intelligence Committee
(JAPIC) to be qualified for the E-CLIP and other pertinent assistance provided by Kalinaw
Village.

13d.2. The JAPIC Certification shall hold even if the FR or FVE dies or has a pending case
while his/her enrollment to the program is being processed. In such instances, his/her
identified beneficiary/ies shall receive the E-CLIP benefits and other pertinent assistance.
In the event that the FR or FVE failed to identify/designate any beneficiaries, the Davao
City E-CLIP Committee has the authority to conduct validation/investigation as to the
possible selection of a new beneficiary based on pertinent laws on succession.

13d.3. In the issuance of JAPIC certificate, the Periodic Status Report of Threat Group
(PSR-TG) list for 2018 shall be the basis in the determination of the eligibility of the FR
and FVEs who will be enrolled in the E-CLIP and other pertinent assistance. If the FR or
the FVE is not listed in the 2018 PSR-TG list, only those who can be conclusively proven
FRs and FVEs on or before December 31, 2018 shall be considered for enrollment in the
program upon further assessment and decision of Davao City E-CLIP Committee.

Section 14. – Kalinaw Village Admission Criteria - Regardless of sex, status, age,
race, those who satisfy the following conditions are eligible to be accepted into the
Kalinaw Village, to wit:

14a. Former Members of the Communist Party of the Philippines (CPP), New People’s
Army (NPA), National Democratic Front (NDF) and Militia ng Bayan (MBs) who surfaced
from April 03, 2018 onwards.

14b. Those who have surfaced from July 01, 2016 and has been processed in a halfway
house but did not receive the full assistance of the CLIP for the period July 1, 2016 to
April 3, 2018.

14c. Modes of Admission may be

• Referral - refers to FRs or FVEs who have been referred by AFP/PNP, LGUs, NGOs,
church groups and personalities with the knowledge and approval of Davao City E-CLIP
Committee Chair.

• Walk in - refers to FRs or FVEs who come directly to the home to seek assistance and
protection with a referral from any government institution.

Section 15. – Benefits and Other Assistance - Along with the benefits and
assistance provided by the National Government and Agencies and subject to availability
of funds, the LGU shall also provide the following:

a. Firearm Remuneration;

b. Educational services from the Educational Benefit System Unit (EBSU) and Scholarship on
Tertiary Education Program (STEP) for their children from the City Mayors Office;

c. Financial Assistance for Livelihood Assistance in Crisis Situation;

d. Food and other basic needs and transportation assistance from City Social Welfare and
Development Office (CSWDO);

e. Medical services from the City Health Office and Lingap Para saMahirap program;

f. Hog raising and native chicken from City Veterinary Office;

g. Home Gardening and Farming from City Agricultures Office;

h. Assistance in the Registration of Certificate of Live of Birth of FRs and FVEs from City
Local Civil Registrar’s Office;

i. Trainings and Seminars for Proper Waste Disposal Management from City Environment
and Natural Resources Office (CENRO);

j. Kalinaw Village provides free board and lodging to FRs and FVEs for a period of Four (4)
to Six (6) months and also caters or provides the various intervention programs during
their accommodation and food assistance to families they left behind;

k. Provide free employment facilitation services and other information on job opportunities
for FRs and FVEs from Public Employment Service Office;

The foregoing offices shall give priority to the FRs and FVEs for the aforesaid benefits
and services.

Section 22. – Kalinaw Village Treatment to FRs and FVEs – The City Government
through the Kalinaw Village assumes no responsibility for the safety of reintegration
participants where the FR or FVE refuses or chooses to stay out of the center.

In such cases, the Center Manager shall require the FR or FVE to identify at least One (1)
person of good standing and with known residence in the community willing to take the
responsibility of keeping his or her safety, and in the presentation of the person for the
purpose of undertaking and completing the necessary reintegration processes.

Section 32 – The funding requirements for the implementation of Davao City E-CLIP
and Kalinaw Village shall come from the funds allocated by the local government. Subject
to compliance of government accounting and auditing rules and regulations.

The budgetary needs pertaining to the effective implementation of the Kalinaw Village
Pertinent services, programs and intervention, including the payment of honoraria,
incidental and other expenses to the City E-CLIP Committee, its Secretariat, Technical
Staff, and other appropriate personnel, as may hereinafter be identified, shall be taken
from the available funds of the City Government of Davao, as well as from the funds
allocated by the national government for the herein purposes.

Subject to compliance of the City government and the National government accounting
and auditing rules and regulations.

Afterwards, the proponent presented a motion, duly seconded by Councilors

COUNCILOR RODOLFO M. MANDE

Item No. 1712

As Chairperson of the Committee on Indigenous, Cultural Communities


and Muslim Affairs, Councilor Mande discussed Item No. 1712 regarding the
proposed Resolution seeking institutionalized support from Colleges, Universities
and other educational institutions of higher learning within Davao City, providing
scholarship grant to the Indigenous Cultural Communities/Indigenous Peoples
(ICCs/IPs) with quality education and various skills training, capacitating and
empowering them to become self-reliant and meaningfully contribute to the
promotion of the personal and community well-being, and nation building.
Informing the Body that Indigenous People (IPs) in the country remain to be
among the poorest and most disadvantaged, the proponent stated that IPs suffer
disproportionately in areas like health, education and human rights and regularly
face discrimination and exclusion. The lack of access to tertiary education results
in high illiteracy rate among the different Indigenous People (IPs)/ Indigenous
Cultural Communities (ICC) in the City. Economic activities within the Ancestral
Domain of ICCs are limited but basic social services are inadequate in these far
flung area.

In 2015, Councilor Mande initiated the Iskolar ng Tribu Program which helped
many IPs in getting their degrees. These graduates, in turn, rendered community
service in their ancestral domain. Upon his selection as the Indigenous People

Mandatory Representative (IPMR), there has been a sudden rise of IP scholar
applicants, thus, the need to institutionalize the program.

Councilors Braga, Principe-Castrodes, Villafuerte, Marohomsalic, Advincula,


Baluran and J.M. Bonguyan duly seconded the motion presented by the proponent for
the approval and adoption of the Committee Report. Councilor Marohomsalic asked
for clarification on whether the proposed Ordinance includes members of the Muslim
tribes since Muslim students also seek scholarships. In reply, Councilor Mande clarified
that the proposed Ordinance is limited only to five (5) tribes since there are
scholarships already offered to those of Muslim tribes such as that offered by Al Qalam
of Ateneo de Davao University.

It was also the suggestion of the National Commission on Indigenous Peoples


(NCIP) to give the Certificates of Confirmation (COC) to the five (5) tribes, to wit:
Matigsalug, Tagabawa, Bagobo Klata, Ata and Obo-Manuvu. Historically, the Kagan
tribe is amongst the tribes of Davao City though they were not included in the proposed
Ordinance. Councilor Marohomsalic suggested to collaborate with the proponent’s
office for the inclusion of the Kagan tribe.

At the question of Councilor Mahipus regarding the allocation of the Annual


Development Fund (ADF) of the City for the Office of the IPMR, the proponent
answered that they only started on January 10, 2022 and have not received their ADF.

Since it was already 3:00 in the afternoon, a recess was declared to make way
for the 3 ó’clock Prayer to be led by Councilor Jesus Joseph P. Zozobrado III.

When the session resumed, the proponent manifested that, since 2015, many
IPs graduated from tertiary education through his initiative and he had no funds to
speak of then. Recounting his experiences, Councilor Mande stated that he personally
requested the various Universities and Colleges to reserve scholarship slots for IP
students until the IP scholars reached 200. Consequently, there is no budget allocation
for the program yet. However, he expressed hope that budget may be allocated for
said program especially because the budget of their office is insufficient to provide for
the hospitalization of IPs as well.

At the question of Councilor Mahipus regarding an Office that caters to the


concerns of IPs in the City, the proponent manifested that the City only has the City
Cultural Office (CCO) or the Deputy Mayor who are advised to hold their offices in their
respective locality such as Paquibato. The City has not allocated funds to CCO to
provide for scholarships for IPs.

Manifesting that he considers himself a member of the Ata tribe, Councilor


Mahipus suggested to institutionalize the allocation of funds for IP scholars. Moreover,
he suggested to the Committee on Finance, Ways and Means and Appropriation of the
20th City Council to appropriate sufficient additional funds for IP scholars. Thereafter,
he registered his co-sponsorship to the legislative measure.

Councilor Villafuerte suggested to add the phrase “and the City Government
of Davao” to Section 5 (A) (1). The proponent noted that there are eleven (11) tribes
in the City, out of these, six (6) are Muslim tribes and the others are lumads. However,
there are also lumads from other areas such as Talaingod. Thus, the tribes must be
restricted to those who are bona fide residents of Davao City. He then signified his
agreement to the suggestion of Councilor Villafuerte since the inclusion of the
suggested phrase will also mean the inclusion of the eleven (11) tribes of the City.

Speaking as the Chairperson of the Committee on Education, Councilor Braga


lauded the proposed Ordinance and emphasized that many of the higher educational
institutions are mandated by law to provide free college education. The legislative
measure will support the tribes in the City, thus, it is definitely a step in the right
direction. Thereafter, she registered her co-sponsorship to the matter.

Duly seconded by Councilors Villafuerte, Advincula, Braga, J.M. Bonguyan and


Apostol Sr.; co-sponsored by Councilors Campos III, Villafuerte, Advincula, Braga, J.M.

Item No. 1781

Item No. 1781 which pertains to the Deed of Donation to be executed by


Urbaneast Developments Inc., in favor of the City of Davao involving the alley, parks
and playground, and community facilities of Altezza Grande, located in Barangay
Catalunan Grande, Talomo District, this City was the first one discussed by Councilor
Advincula. She reported that the applicant submitted all the necessary requirements
including the Certificate of Completion issued by the Department of Human Settlements
and Urban Development (DHSUD). The City Legal Office likewise issued a legal opinion
stating that there is no legal infirmity in the contract. The donation will be executed in
compliance with Section 33 of Batas Pambansa Blg. 220 which states that:

“Section 33. Donations of Roads, Open Spaces and Water Supply . The


owner or project developer shall donate the roads and open spaces found
in the project to the local government of the area after their completion
had been certified to by the Commission and it shall be mandatory for the
said local government to accept such donations. Xxx xxx xxx”

Noting the recommendation of the committee to approve the request to grant


authority to the City Mayor to sign the contract, Councilor Advincula presented a

Ambulance by Jelo Val Caresusa Laurente, Councilor Quitain Jr. manifested that the
City Legal Opinion states that there is no legal infirmity in the contract. Thereafter, he

Next, Councilor Quitain Jr. discussed the proposed measure regarding the Deed
of Usufruct (DOU) by and between the City of Davao and Davao City Water District
(DCWD), involving a Pressure Sustaining Valve (PSV) assembly installed in a 5-storey
investment and tourism building. He manifested that the Sanggunian already approved
a similar legislative measure for one of the newly constructed buildings of the City
Government. Furthermore, the City Legal Opinion on the matter states that there is no
legal infirmity on the agreement. Thus, the proponent presented a motion, duly
seconded by Councilors Villafuerte, Advincula, Apostol Sr., Braga and J.M. Bonguyan,
for the approval of the Resolution below:

Lastly, Councilor Quitain Jr. presented the proposed Memorandum of Agreement


to be executed by and between the University of Southeastern Philippines, relative to
the operationalization of the University of Southeastern Philippines (USEP) – Malabog
Extension Campus. The City Legal Office stated in its legal opinion that the contract
has no legal infirmity. Accordingly, Councilor Quitain Jr. presented a motion, duly
seconded by Councilors Villafuerte, Apostol Sr., Advincula, Braga and Mande, for the
approval of the following Resolution:

COUNCILOR PILAR C. BRAGA

As the term of the 19th City Council was about to end, Councilor Braga took a
moment to express her gratitude to Vice Mayor Sebastian Z. Duterte whose leadership
caused the passage of several landmark Ordinances. She likewise thanked Floor Leader
and Vice Mayor-elect J. Melchor B. Quitain Jr. Moreover, she thanked her colleagues
as well as the SP Secretariat for their hard work. Councilor Braga also thanked City
Mayor Sara Z. Duterte and expressed her joy that the Mayor has been elected to the 2 nd
highest office in the country, the Vice Presidency. Councilor Braga also thanked
President Rodrigo Roa Duterete for his sterling l;eadership. On a personal note, she
thanked God for blessing her with perfect attendance throughout the 19 th City Council.

The lady Councilor from the first District reminded everyone of the maxim: “ The
greatest good for the greatest number”.

COUNCILOR ANTOINETTE G. PRINCIPE-CASTRODES

Duly recognized, Councilor Principe-Castrodes recalled that the Body approved a


Resolution supporting the nomination of Dabaweño artist Ms. Agnes Dacudao Locsin to
the Order of the National Artist in the Area of Dance. On June 10, 2022, President
Rodrigo Roa Duterte elevated Ms. Locsin to the Order of the National Artist by virtue of
Presidential Proclamation No. 1390. In connection with her speech, Councilor Principe-
Castrodes presented a motion, duly seconded by Councilors Apostol Sr., Braga,
Villafuerte and Baluran, for the approval of the following Resolution:

MS. AGNES LOCSIN FOR BEING DECLARED
THE NATIONAL ARTIST FOR DANCE FOR
THE YEAR 2022

COUNCILOR DIOSDADO ANGELO JUNIOR R. MAHIPUS

Rising on a matter of personal and collective privilege, Councilor Mahipus


informed the Body that the Department of Environment and Natural Resources –
Region XI (DENR XI), in support of the improved land administration and distribution of
free patents to qualified beneficiaries covering agricultural and residential lands, was
able to distribute 22,266 patents to qualified beneficiaries in the Davao Region where
1,471 are for applicants from Davao City. The Davao Region has the most number of
patents distributed to qualified beneficiaries. The Handgo Filipino Program is one of the
legacies of President Rodrigo Roa Duterte to the people.

In addition to the land title distribution, the Metro Davao Development Authority
(MDDA) was officially launched. MDDA was created by Republic Act No. 11708 and

signed by the President on April 13, 2022. It shall provide an institutionalized
metropolitan level management and to permanently govern affairs of metropolitan
Davao.

The Certificate of Conveyance of Land by the DENR in favor of 58 government


agencies was issued that day, June 21, 2022. 58 government offices, Regional and
Municipal Trial Courts and the City Government of Davao shall be co-located in the
Regional Government Center (RGC).

Subsequently, Councilor Mahipus presented a motion, duly seconded by


Councilors Villafuerte, Baluran, Apostol Sr., Marohomsalic, Braga and Abellera; co-
sponsored by Councilors Baluran, J.M. Bonguyan, Abellera, Braga, Advincula, Villafuerte
and Apostol Sr, for the approval of the Resolution entitled:

The Floor Leader encouraged the Members of the Body to be physically present
during the farewell session on June 28, 2022.

Apostol Sr. and Advincula. The session was adjourned at 4:45 in the afternoon.
