URGENT MOTION FOR POSTPONEMENT

1. Sibonga Municipal Assessor Edgar Codilla has not been served with a subpoena to
appear on the April 28, 2021 hearing by the Honorable.

2. The undersigned counsel most respectfully moves for the resetting of the April 28,
2021 hearing to May 17, 2021 to allow issuance and service of subpoena to the Sibonga
Assessor.

3. This motion is not filed for delay. The defendants have meritorious defenses and
grounds.

Wherefore, it is most respectfully prayed of this Honorable Court to grant this urgent
motion for resetting of the April 28, 2021 hearing to May 17, 2021.
