Greeting.
The Department of Agrarian Reform (DAR) Clearances for the three (3) deeds
mentioned below were issued later on APRIL 22, 2022 (see attachments “A”, “B” “C”
to this letter) while the E-CARs pertaining to the deeds were issued by the BIR on
March 25, 2019 and expired on March 25, 2022. The delay was due to a number of
reasons:
1. DAR previous required forms of affidavits were numerous and the many parties
under the first deed are scattered all over Cebu and we had a hard time having
them sign the affidavits;
2. The heirs of Rizalina Durohom-Dicdican took time to process the late registration
of her death as her death was not registered.
3. The pandemic including the lockdowns and unavailability of signatories;
4. DAR changed its checklist of requirements for clearance wherein newly
formatted affidavits were required. New affidavits would have to be prepared
again and have the parties who are scattered all over Cebu sign them again;
(a) FIRST DEED (Extrajudicial Settlement among Heirs with Waiver/Donation and Sale)
includes the following:

square meters; (220) square meters;
5. Spouses Antonio Labria Concepcion and Minerva Francisco-Concepcion,
(1,100) square meters;
(b) SECOND DEED (Deed of Absolute Sale by Alberto Dicdican to spouses Mauricio
and Rena Dicdican, 1,684 square meters)
(c) THIRD DEED (Deed of Absolute Sale by Frederick Dicdican to Rommel R. Rosito,
306 square meters)
