G. Salvador, CESO IV Regional Director Dear Regional Director Salvador, We write in relation to the formation of a Multi-Partite Monitoring Team (‘MMT’) for SM City Rosales. To recall, we have already complied with your office's decision to impose charges on SM City Rosales for its failure to constitute an MMT upon issuance of its Environmental Compliance Certificate ("ECC") in 2008. We now seek your consideration in no longer forming ¢ an MMT for SM City Rosales in light of the existing circumstances described hereunder. SM City Rosales has already finished construction by November 2008 and have immediately commenced operations thereafter. No adverse environmental findings have ever been found against SM City Rosales up to this date. As previously stated in our letter dated 28 December 2012, SM City Rosales has been consistently submitting its Quarterly Self-Monitoring Reports, procured all necessary environmental permits and have complied with the conditions provided under its ECC. As stated under the Revised Procedural Manual for Department Administrative Order No. 2003-30 ("DAO 2003-30"), MMTs of projects whose significant environmental impacts do not persist after the construction phase can be terminated. Considering that SM City Rosales has been operational for 5 years since 2008, there is no longer any reason to form the MMT at this late stage. The monitoring of SM City Rosales’ environmental compliance is already being done through the regular reports that it submits to your office. Consequently, even if an MMT is formed at this time, its monitoring will be a mere superfluity as the same is adequately addressed by the reportorial requirements presoribed under DAO 2003-30. In any case, the formation of an MMT is not even mandatory for Non-Environmentally Critical Projects, to which SM City Rosales squarely falls. The project includes / covers the construction and operation of SM Supercenter Rosales with facilites consisting of Hypermarket, Department Store, Malls / Learable Shops, Food Court / Restaurants, Entertainment Area, Parking Areas, Hardware Store, Sewage Treatment Plant, and other amenities / services. 1. —_ conprrions | | | ENVIRONMENTAL MANAGEMENT The proponent shall strictly implement the following mitigating, enhancement, and rehabilitating measures: 1. Prior to project implementation, all permits and/or clearances from concerned office that have administrative jurisdiction over the project shall secured, ie. LGU, HLURB, DAR, etc | 2 Adequate and approprite drainage system and soil erosion control eae including | other structural measures which will conform with natural topography shall be constructed / provided to avoid erosion and flooding of the adjoining properties; 3. Regular Sanitary Housekeeping practices, proper collection of solid and hazardous waste resulting from the implementation/operation of the project shall be strictly ‘observed. The waste management plan shall include adequate facilities for disposal of wastes which shall be done from the start of the construction; exc -2- 4. In case of vegetation loss due to construction activities such as clearing and excavation ‘works, the project proponent shall plant appropriate tree species and/or other forms of ‘vegetation to compensate for the damaged vegetation; 5. | Cutting of trees shall be covered by a valid permit from the DENR pursuant to the | provisions of PD 708 and PD 958; GENERAL CONDITIONS Further adm trative conditions for the grant of this certificate shall be strictly complied: 6. The proponent’s operations shall conform with the provisions of RA 6969 (Toxic Substances and Hazardous and Nuclear Waste Control Act of 1990), RA 9003 (Act Providing for an Ecological Solid Waste Management Program), RA 9275 (Philippine Clean Water Act of 2004), and RA 8749 (Philippine Clean Air Act of 1999), 7. ‘The proponent shall make available information based on the project schedules as indicated in the submitted Impact Assessment and Mitigation Summary / EMP for the implementation of the project and proposed mitigating measures in the construction and ‘operational phase. An accomplishment report on the implemented mitigating measures and the corresponding cost of such activities shall be submited to EMB Regional Office on a (quarterly basis for monitoring; | 8. ‘The proponent shall undertake an effective and sustained Information, Education and ‘Communication (IEC) Campaign to explain publicly its mitigative measures as well as the conditions of this ECC.
