RESOLUTION NO. 35
SERIES OF 2007

“A RESOLUTION GRANTING AUTHORITY TO GLOBE TELECOM INC. TO

CONSTRUCT, INSTALL, OPERATE AND MAINTAIN A CELLULAR BASE
STATION IN BARANGAY MINDORO, VIGAN CITY.”

WHEREAS, Globe Telecom is authorized to install, operate and maintain cell sites and
base stations anywhere in the country by virtue of its congressional franchise as
certified by the National Telecommunication Commission on July 6, 2006 issued by
Deputy Commissioner Jaime Fortes Jr.

WHEREAS, the Bureau of Health Devices and Technology of the Department of

Health had issued a radio frequency radiation evaluation of the proposed Globe
Telecom Inc. Mobile telephone base system in Mindoro, Vigan City dated July 16, 2007
and concluded that it is unlikely that members of the public will be exposed to levels
exceeding the limits.

WHEREAS, the Sangguniang Barangay of Mindoro had passed Resolution No.5,

series of 2007 granting clearance to Globe Telecom Inc. to construct, install, operate
and maintain a cellular base station within the vicinity of Barangay Mindoro after a
public hearing;

WHEREAS, the identified site has an area of four hundred square meters and is being
leased by Globe Telecom Inc. from the Juan Carlo Medina, the declared owner of the
agricultural land under Tax Declaration No. 022-00666;

WHEREAS, the proposed site is adjacent to the Playa de Oro Resort in Mindoro which
is owned and operated by the City Government of Vigan;

WHEREAS, the construction, installation and operation of the Globe Telecom Cellular
base station will redound to the benefit of the public in terms of employment, increase
taxes and improvement of cellular signals.

NOW THEREFORE, BE IT RESOLVED AS IT IS HEREBY RESOLVED BY

THE SANGGUNIANG PANLUNGSOD IN SESSION DULY ASSEMBLED to
grant authority to Globe Telecom Inc. to construct, install, operate and maintain a
cellular base station in Barangay Mindoro Vigan City.

RESOLVED FURTHER that the authority granted is subject to the provisions of the
Constitution, applicable laws in compliance with the terms and conditions of its
congressional franchise and that Globe Telecom Inc. shall comply with permits and
licenses in order to install, operate and maintain its base station in Mindoro, Vigan City
after complying with the National Building Code other related laws, city ordinances,
rules and regulations and terms and conditions imposed herein that are necessary prior
to the construction, installation operation and maintenance.

RESOLVED FURTHER, that Globe Telecom Inc., or its contractor shall employ staff
and labor from sources within the City of Vigan in connection with the construction,
installation, operation and maintenance of the base station.

RESOLVED FURTHER, that from the Globe Telecom, Philippines shall ensure
restoration of roads, streets and other public and private properties to be affected by the
proposed construction of the GLOBE cellsite sub-station. It shall endeavour to restore at
its own expense, to its former conditions, all excavations it may have caused within (30)
days from the date of completion of its underground conduit and manholes work as
determined jointly by the City Engineer and GLOBE TELECOM, PHILS. shall post a
bond in the amount of P 100,000.00 Philippine Pesos or the equivalent of 10% of the
underground conduit and manhole installation costs whichever is higher to ensure the
faithful compliance of its obligations with the provisions, the bond posted by GLOBE
TELECOM, PHILS. shall be used to cover expenses for restoration whenever
necessary.

RESOLVED FINALLY, that violation of any provision of the terms and conditions of
the resolution is sufficient ground to withdraw the authority herein granted to Globe
Telecom Inc. or its constructor.
