SUPPLEMENTRY AGREEMENT TO THE IRQP AGREEMENT NO.LS CR AGT.NO.43/2015-16, Dt:30.12.2015

BETWEEN

The Roads and Buildings Department, Government of Andhra Pradesh, represented by the
Superintending Engineer, (R&B) NH Circle, Ananathapuramu, Andhra Pradesh (hereafter refered to as the
“Authority” which expression shall, unless repugnant to the context or meaning thereof, includes its
administrators, successors and assigns) of one part.

AND

M/s PLR Projects Pvt Limited, Hyderabad, means the selected bidder having Corporate office at 3B, 3 rd
Floor, Inwinex Towers, Plot No:130, Road No.2, Banjara Hills, Hyderabad-500034, and registered office at
10-34, Maruthi Nagar, M.R. Palli, Tirupati-517002, Chittoor District, Andhara Pradesh, which expression
shall, unless repugnant to the “contractor” meaning thereof, include its successors and permitted assigns)
of the other part.

NH-42) in the state of Andhra Pradesh – M/s PLR Projects Pvt Limited, Hyderabad.

1. Whereas
I. The Government of India had entrusted to the Authority, the work, “IRQP from Km 0/0 to Km
3/245 and Km 20/0 to Km 27/0 of Madanapalle – Krishnagiri Road NH-219 (New NH-42) in the
state of Andhra Pradesh”.
II. The Ministry, New Delhi, vide File No.RW/NH-12037/29/2018-AP/Misc/Zone-III,
Dated:22.08.2022, has accorded the approval of revalidation of phasing of instant projects for
clearing the liabilities in the current financial year 2022-23 on wards for the subject work.
III. Subject to the approval of the revalidation of the subject work by the Ministry, both Parties,
and are willing to deduce in writing on the covenant, as set out herein under.
2. Now, this Supplementary Agreement witnesses the following.
I. Entire Agency Charges payable to the state PWD may be forfeited.

II. No price escalation beyond scheduled Completion date may be borne by the Ministry.

III. This will be full & final payment and no additional financial implications viz., interest etc.,
will be entertained by the Ministry. The Contractor has agreed to give an undertaking to
this effect.
IV. The Contractor has agreed to give an undertaking that he will withdraw all
Cases/petitions/arbitration raised with regard to the project.
V. The Contractor has agreed for withdrawal of the pending court case W.P.No. in the
Hon’ble High court of Andhra Pradesh, Amravati.
VI. The approval of the revalidation of phasing must not be construed as approval for any
Variation/COS/Revised Cost Estimate/EOT etc.,
VII. Revalidation of the sanction is subject to the condition of 10% recovery from the cost of
Bituminous macadam + bituminous concrete. Accordingly, the Contractor has agreed to
receive full & final payment for the subject work for an amount of Rs.-------
3. Now therefore, in consideration of the facts stated above, the parties hereto hereby agree to the
terms and conditions as stated above.
