The humble petition is being
filed on behalf of the above
named petitioner:

MOST RESPECTFULLY SWETH

1.That the land being Revisional Survey plot No. 1124


under Khata No. 04 situated at Mouza Khizri Revenue
Thana No. 330, Police Station Namkom within the Town and
District of Ranchi in the state of Jharkhand was
recorded in the name of Etwa Pahan son of Late Budhuwa
Pahan.
2.That the Revisional Survey Record of right which was
published in or about the year 1935 and the name of
recorded tenants was Etwa Pahan son of Late Budhua
Pahan.
3.That the nature of the land as recorded in R. S. record
right is Kaymi.
4.That the above named recorded tenant by paying rent to
the Ex Land Lord maintaining peaceful possession over the
above mentioned land during whole of his life time which
is more fully detailed and described in the schedule
appended at the foot of this petition.
5. That after few years of peaceful possession above named
recorded tenant namely Etwa Pahan died leaving behind his
only son namely Budhuwa Pahan as his legal heir and
successor who inherit the same through the process of
inheritance and enjoyed over the same during whole of his
life time.
6. That after passing of few years above named Budhuwa Pahan
son of Late Etwa Pahan was died leaving behind his only
son namely Charka Munda as his legal heir and successor
who inherit the same through the process of inheritance
and enjoyed over the same during whole of his life time.
7. That after few years of peaceful possession said Charka
Munda son of Late Budhuwa Pahan died leaving behind his
only son namely Jodhan Munda as his legal heir and
successor.
8. That after the death of Charka Munda his son namely
Jodhan Munda inherited the entire property through the
process of inheritance which was left by his deceased
father.

9. That said Jodhan Munda son of Late Charka Munda mutated


his name before the serista of Circle Officer Namkom
Anchal Ranchi and maintaining peaceful possession over the
same during whole of his life time.

10. That after few years of peaceful possession said


Jodhan Munda died leaving behind his four sons namely
Etwa Munda, Somra Munda, Sukra Munda and Sohrai Munda as
his legal heir and successor.
11.That above named four sons of Late Jodhan Munda
jointly inherited the entire property through the process
of inheritance which was left by their deceased father
and maintaining joint peaceful possession over the same.
12. That to avoid further litigation and complication
above named four sons of Late Jodhan Munda decided to
make an amicable family settlement and as a result of
above said family partition the schedule land falls under
the exclusive share of the petitioner which is more fully
detailed and described in the schedule appended at the
foot of this petition.
13. That the petitioner after he came in actual physical
possession of his exclusive share is maintaining peaceful
over the same
14. That the relationship of the legal heirs of the
recorded tenant is more fully greater clear from the
following table as hereunder:

15. That at present the petitioner is suffering from


acute financial crisis for construction of his own
residential house so he decided to sell his few area of
land which he obtained through the process of
inheritance.
16.That to fulfil his necessity he contacted with one
AJIT SINGH MUNDA son of Marshel Singh Munda, by caste
Munda by profession service resident of village
Kutiyatu, Post Office Tetri, Police Station Namkom
within the Town and District of Ranchi in the state of
Jharkhand.
17.That the prospective purchaser namely Ajit Singh
Munda son of Marshel Singh Munda who is also in need of
small area of land for constructing his residential
house agreed to purchase the same from the petitioner.
18. That both the petitioner and the prospective
purchaser are residing within the same police station
within which the proposed land is situated and b0th of
them belongs from schedule tribe community.
19. That the petitioner assured the prospective
Purchaser that the land is free from all encumbrances
and there is no case pending regarding the schedule
land before any court of law.
20. That the petitioner humbly submits and states that
this proposed sale has not gave any affect over the
share of the other shareholder and after sale the
schedule land there is sufficient land remaining with
the petitioner for his livelihood.
21. That the petitioner received the amount which is
fair and reasonable as per the market price available
in the locality.
22. That prior to filling this application the
petitioner has not filed any application regarding the
same and similar relief.
23. That the other and further ground shall be urged at
the time of hearing.
It is therefore prayed before
your Honour may graciously be
please to accord permission to
the petitioner to sell the
schedule land in favour of the
prospective purchaser under
section 46 of the Chotonagpur
Tenancy Act 1908.

AFFIDAVIT
1 Sohrai Munda son of Late Jodhan Munda by caste Munda by
profession farmer resident of village Kutiyatu, Police
Station Namkom, within the Town and District of Ranchi do
solemnly affirm and declare hereunder.
1. That I am one of the legal heir of the recorded
tenant of Khata No. 04, plot No. 1124 situated at
village Kutiyatu Thana No. 330 District Ranchi
2. That I would like to sell 05 decimals of land of
Khata No. 04 plot No. 1124 with one Sri Ajit Singh
Munda son of Marshel singh Munda resident of
village Kutiyatu Police Station Namkom District
Ranchi.
3. That both of us belongs to schedule Tribe
Community and belongs from Munda Caste and also
resides within the same village and within same
police station where the land is situated.
4. That I have filed this present case for
obtaining permission under section 46 of C. N.T.
Act 1908 and the same is being numbered for which
this affidavit is required hence this affidavit.
5. That the statement made in this petition have
been read over to me and explained to me in Hindi
which I fully understood and found the same to be
correct.

AFFIDAVIT

I Ajit Singh Munda son of Marsel Munda by caste Munda,


by profession service, resident of village Kutiyatu,
Post Office Tetri, and Police Station Namkom District
Ranchi do hereby solemnly affirm and declare as
hereunder:

1.That I have purchased the land being Revisional


Survey plot No. 1124 under Khata No. 04 measuring
an area 05 decimals situated at village Kutiyatu,
Thana No. 330, Police Station Namkom, District
Ranchi from Sohrai Munda who is one of the legal
heir of the recorded tenant.
2. That both of us belong to schedule Tribe
Community and belong to Munda Caste and also resides
within the same village and within same police
station where the land is situated.
3.That I have filed this present case for obtaining
permission under section 46 of C. N.T. Act 1908 and
the same is being numbered for which this affidavit
is required hence this affidavit.
4. That the statement made in this petition have
been read over to me and explain to me in Hindi which
I have fully understood and found the same is
correct.
