STUDENT AGREEMENT
All sections of this document constitute the written agreement between the student and Academies Australasia Polytechnic (‘the College’). These
remain binding for the duration of the student’s enrolment with the College. Please read them carefully.
Once the student has accepted this offer by returning the completed Student Agreement and making the required payment, the College will send an
electronic Confirmation of Enrolment (eCoE) to the student to obtain their visa. The student’s enrolment with the College cannot commence until all
information is received and confirmed as accurate.
SECTION 4: GENERAL TERMS AND CONDITIONS
4.1 GENERAL
a) Upon the student’s enrolment at the College, and subject to payment of the "TOTAL FEES TO BE PAID IN ADVANCE" (referred to in page
2), a binding contract (Written Agreement) is created between the student and the College.
b) The laws of the Commonwealth of Australia and the States govern the contract between the Student and the College.
4.2 ENROLMENT AND ATTENDANCE
a) The student’s enrolment shall not be deemed as accepted until the "TOTAL FEES TO BE PAID IN ADVANCE" (referred to in page 2) have
been received by the College.
b) The College reserves the right to discontinue or alter any course date, tuition or service fee, policy, location, timetable or staffing without prior
notice.
c) The College may vary conditions of enrolment, as may be necessary, to comply with any law or regulation of the Commonwealth of Australia
or the States.
d) In the event of any unforeseen circumstances or event beyond the control of the College which could adversely impact the health and safety
of students, the College may temporarily change the method of course delivery – for example, from face-to-face learning to online learning or
distance delivery mode.
e) The student agrees to be bound by the rules and regulations of the College in force during any and all enrolments and otherwise to follow
acceptable codes of behaviour, attendance and academic performance and show due concern for other students.
f) Changes to student enrolment and/or any breaches by the student of enrolment conditions will be reported to the Department of Home Affairs
as required under the Education Services for Overseas Students (ESOS) Act 2000, the ESOS Regulations 2019 and the National Code of
Practice for Registration Authorities and Providers of Education and Training to Overseas Students 2018 (the National Code 2018). The
College reserves the right to request updates from the Department of Home Affairs on any action taken.
g) Transfer between courses, campuses, and colleges (including transfers to any other Academies Australasia Group College) must be
approved by the Designated Head, Student Services (DH-SS).
h) If an enrolled student obtains permission to transfer to another course within the College, all unused fees paid will be credited to the new
course. A new Administration Fee will be charged at the rate current at the date of transfer.
i) The National Code 2018 requires the student to remain enrolled in the principal course of study for at least six months before they can
transfer to another education provider, unless the provider of the principal course agrees. Where the student seeks to transfer prior to
completing six months in the principal course of study, a request for release must be submitted to the College in writing. If the College
approves the transfer to another provider, the transfer will be treated as a withdrawal from the College and the refund process for withdrawal
in Section 5 will apply. The relevant government authorities will be advised accordingly and your student visa status may be affected. (For the
Transfer between Registered Providers process, refer to the Student Handbook available on www.aapoly.edu.au).
Note: As defined in the National Code 2018, the principal course of study refers to the main course of study to be undertaken by an overseas
student where a student visa has been issued for multiple courses of study. The principal course of study would normally be the final course
of study where the overseas student arrives in Australia with a student visa that covers multiple courses.
j) The College can only defer or temporarily suspend the enrolment of the student on the grounds of compassionate or compelling
circumstances (for example, illness where a medical certificate states that the student is unable to attend classes) or misconduct by the
student.
4.3 VISA REQUIREMENTS – ACADEMIC PROGRESS
a) Students are required to undertake a full-time study workload of 20 contact hours per week and achieve a minimum rate of progress that will
enable them to complete the course in the time frame stated in their confirmation of enrolment.
b) Students are required to successfully complete a minimum of 50% of their subjects in a study period. (Refer to the Monitoring Course Student
Progress Policy and Procedure (for Vocational programs) and Student at Risk and Academic Support Procedure (for Higher Education
programs) available at http://www.aapoly.edu.au/student-policies
c) Students who do not respond to warning letters may be reported to the Department of Home Affairs which may result in the cancellation of
their student visa.
4.4 OVERSEAS STUDENT HEALTH COVER
a) It is an Australian Government requirement that all students studying on a student visa are covered by Overseas Student Health Cover
(OSHC). The payment listed in the student’s offer details covers the length of the student’s course at the College. If the student prematurely
withdraws from their course and returns home, the prepaid portion may be refunded by the Health Cover Provider, upon request.
b) Students accompanied by family must pay the OSHC family fee.
c) The College will process the student’s payment with BUPA. The student will be advised on how to collect their card during the orientation.
4.5 EMPLOYMENT AND LIVING COSTS
a) International students are permitted to work up to 40 hours per fortnight during terms and full time during term holidays, provided that work
does not interfere with their studies. It is recommended that students budget for annual living costs of at least AU$21,041 (as of 23 October
2019) above their tuition fees.
b) Students who have school-aged dependents (i.e. unmarried children between 5 and 18 years old) accompanying them to Australia for more
than three months are required to ensure that adequate arrangements have been made for their schooling. Their dependents will be charged
the full college fee if they are enrolled in either a government or non-government college.

4.6 INDUCTION/ORIENTATION
a) Students are required to attend an induction/orientation program, usually during the first week of the course. Details to be advised.
b) Students are required to bring their passport and a copy of the Confirmation of Enrolment.
4.7 COMPLAINTS AND APPEALS
a) This written agreement, and the right to make complaints and seek appeals of decisions and action under various processes, does not affect
the rights of the student to take action under the Australian Consumer Law if the Australian Consumer Law applies.
b) COMPLAINTS PROCESS
• For academic complaints students should approach the Trainer and/or Course Coordinator (for vocational students) or the Lecturer
and/or Academic Dean (for higher education students). For any other issues, students should contact Student Services.
• Academic related complaints
- In the first instance, students should raise the matter with their Trainer or Lecturer.
- If the student is not satisfied with the Trainer’s response or the matter is more serious, the student completes and returns the Student
Complaint Form available on www.aapoly.edu.au to Student Services. The student should attach copies of any supporting
documents (if applicable). If the matter is very serious or confidential, the student may wish to make an appointment with the Course
Coordinator to give notice of the complaint. The complaint is referred to the Course Coordinator or the Academic Dean.
- Within 10 working days of the receipt of a formal complaint the Course Coordinator or the Academic Dean will consider the
information provided and may contact the student and/or trainer/staff members if further information is required. The Course
Coordinator or the Academic Dean shall, if they see fit, make a decision on the matter and advise the student in writing of the
actions/plans, details of the reasons for the outcome and right to access an independent external complaints and appeal process
within 10 working days of concluding the investigation of the complaint.
- If the student is still unhappy, they can request Student Services within 5 working days of the outcome to refer the complaint to the
Chief Executive Officer (CEO).
- The student will be informed in writing of the outcome of the complaint including details of the reasons for the outcome and right to
access an independent external complaints process within 10 working days of concluding the investigation of the complaint.
- Should a student feel that the problem cannot be resolved within the College, the CEO should be informed.
- During the complaints process the student is entitled to have a support person (at the student’s cost).
- Students may also access the external appeals process within 5 working days of the outcome. Please refer to the 'External Appeal'
section below.
- The College’s complaint resolution process does not inhibit the student’s right to seek other remedies under Federal or State law.
- The student’s enrolment will be maintained while the complaints and appeals process is ongoing.
• Other complaints
- For other complaints, students must raise the matter to Student Services. If the complaint cannot be resolved informally, students
may lodge a formal complaint by submitting the Student Complaint Form available on www.aapoly.edu.au to Student Services. The
College will maintain the student’s enrolment while the complaint process is ongoing. Students must also enrol in their course during
the process.
- Within 10 working days of the receipt of a formal complaint the Department Head, Student Services (DH-SS.) will consider the
information provided and may contact the student and/or staff members if further information is required. The DH-SS shall, if they see
fit, make a decision on the matter and advise the student in writing of the actions/plans, details of the reasons for the outcome and
right to access an independent external complaints and appeal process within 10 working days of concluding the investigation of the
complaint.
- If the student is still unhappy, they can request Student Services, within 5 working days of the outcome, to refer the complaint to the
CEO.
- The student will be informed in writing of the outcome of the complaint, including details of the reasons for the outcome and right to
access an independent external complaints process within 10 working days of concluding the investigation of the complaint.
- Should a student feel that the problem cannot be resolved within the College, the CEO should be informed.
- During the complaints process the student is entitled to have a support person (at the student’s cost).
- Students may also access the external appeals process within 5 working days of the outcome. Please refer to the 'External Appeal'
section below.
- The College’s complaint resolution process does not inhibit the student’s right to seek other remedies under Federal or State law.
- The student’s enrolment will be maintained while the complaints and appeals process is ongoing.
c) APPEALS PROCESS
• If a student wishes to lodge an appeal against an official decision made by the College, they need to submit an Appeal Form to Student
Services and in case they are appealing against Intention to Report for unsatisfactory course progress the student needs to submit the
Appeal Form to the Course Coordinator or the Academic Dean, within 20 working days of receiving the notification.
• Staff responsible, as per the type of appeal, will commence the investigation within 10 working days of the appeal being lodged. Staff will
consider the information provided (if applicable) and information about the student in the Student Management System (Paradigm), and
may contact the student if further information is required. Once the outcome has been finalised the student is informed in writing.
• If the outcome is in favour of the student, the College immediately implements any decision or corrective/preventative actions required
and commences continuous improvement process. A record of the appeal is kept in Paradigm as evidence of the communication to the
student.

• If the outcome is not in favour of the student, the student can choose to either withdraw the appeal or access an external appeal process
with the Overseas Student Ombudsman (OSO). The College informs the student in writing of their right to access an external appeal
process within 10 working days of concluding the internal appeal. The student must contact the OSO within 5 working days of the written
outcome and inform the relevant staff. If the student does not proceed and withdraws the appeal, the College proceeds with the decision
and keeps record in Paradigm.
• OSO investigates and informs the student and the College of the outcome. The appeal procedure will be determined by an independent
mediator. During the appeal process the student’s enrolment will be maintained. If required, all documentation from the student and the
College related to the appeal will be forwarded to the OSO.
• If the outcome of the external appeal is in favour of the student, the College immediately implements any decision or
corrective/preventative actions required and commences continuous improvement process. A record of the appeal is kept in Paradigm as
evidence of the communication to the student.
• If the outcome is not in favour of the student, the College proceeds with the decision, and keeps a record in Paradigm.
d) EXTERNAL APPEAL
• The student will have access and receive the outcome of only one external appeal process before the College may report the student to
the relevant authorities. Hence, the College does not have to await the outcome of multiple external appeals processes which the student
may wish to access. However, the College will inform students that they could refer to the OSO. The OSO offers a free and independent
service for overseas students who have a complaint or want to lodge an external appeal about a decision made by their College. You can
initiate the external appeals process to OSO by telephone, in writing, by fax, or using OSO’s online complaint form. Refer to OSO’s

e) WITHDRAWAL OF COMPLAINT/APPEAL
• The student may withdraw a complaint or appeal at any time during the resolution process. The student must make the withdrawal in
writing and submit it to Student Services. This will then be forwarded to the DH-SS. Alternatively, the student may send an email to the
DH-SS using their email address registered with the College.
• DH-SS will send a written acknowledgement of the withdrawal to the student. The matter will be concluded and deemed to be resolved.
4.8 CONDITIONS OF OFFER
a) Vocational Programs:

• Student meeting all entry requirements
• Students wishing to apply for credit transfers must do so before course commencement of their program. Credit transfers will be subject
to approval by the College.
b) Higher Education Programs:
• Students wishing to apply for credit transfers must do so before course commencement of their program. Where an application for credit
transfer is made that is consistent with an established precedent or an articulation approved by the College, the application will be
processed within 5 working days of receipt of the application and accompanying documentation. Credit transfer application, where there
are no current precedents, will be processed within 10 working days from receipt of the application and accompanying documentation
and will be subject to approval by the College. The course length in the Confirmation of Enrolment (CoE) may be adjusted accordingly.
• All entry requirements must be met.
4.9 CONDITIONS OF ACCEPTANCE
a) TUITION FEES
• I agree to pay all fees charged directly to me arising from this acceptance.
• I understand that the fees may change and agree to pay the published fees at the commencement of my studies. I understand that the
program’s tuition fees will not change once I have commenced and remain enrolled in the same program.
• I understand that the Terms and Conditions of my enrolment specify that tuition fees are payable in advance and that enrolment will not
be deemed as accepted until the "TOTAL FEES TO BE PAID IN ADVANCE" (referred to in page 2) have been received by the College
prior to course commencement.
• I understand that I am not required to pay more than 50 percent of tuition fees before I start my course, but may pay more if I choose to.
(National Code Standards 3.3.4).
• I understand that should I fail to pay tuition fees due in accordance with the Terms and Conditions of enrolment, I may be excluded from
class and I may be reported by the College to Department of Home Affairs.
• I understand that I may be charged with financial penalty for late enrolment or late payment.

b) ENROLMENT CONDITIONS
• I confirm that all the information provided in this application is complete and correct.
• I understand that a Study Period for a vocational course is equivalent to a term. Each term consists of 9-10 weeks depending on the
course unless otherwise changed by the College.
• I understand that a Study Period for a Higher Education course is equivalent to a semester. Each semester consists of 14 weeks (12
academic weeks and an additional 2 weeks for examinations and assessments and/or supplementary assessment if required).
• I understand that continuation in the course/s is dependent upon satisfactory academic progress and attendance. Failure to meet these
conditions will result in my case being reported by the College to Department of Home Affairs.
• I understand that it is compulsory to be covered by OSHC while I am on a student visa.
• I understand that I am not eligible to transfer to another registered provider, without permission from the College, until I have completed 6
months of my principal course of study.
• I confirm that I have read and understood the entry requirements, prerequisites and mode of study for the course I am applying for
(referred to in the Appendix).
c) CONTACT DETAILS
• I understand that it is one of my student visa conditions that I must advise the College of my Australian residential address within seven
(7) days of my arrival in Australia and must advise any changes of address within seven (7) days. Failure to do this may mean that I do
not receive important information which may affect my course, my enrolment or my visa.
• I understand that the provision of incorrect or false information may result in the cancellation of my enrolment by the College.
• I understand that I must also notify the College of any change to any of the following, within 7 days of such change.
- Name
- Mobile/landline telephone number(s) and contact details
- Email address
- Visa status
- Emergency contact details
• I understand that I must also notify the College of my Unique Student Identifier (USI) details as required under the Standards for
Registered Training Organisations (RTOs) 2015 in order to obtain my final certificate.

d) STUDENT RESPONSIBILITIES
• I confirm that I have sufficient funds to finance both my tuition fees and living expenses for the duration of my program. I understand that
the tuition fee does not cover the costs of books, materials, field trips or living expenses unless otherwise specified.
• I understand that I am responsible for all education and other living cost expenses of any person who accompanies me to Australia. I also
understand that all school aged dependents accompanying me to Australia must attend school and are required to pay full fees if they
are enrolled in a government or non-government school.
• I agree to attend all classes, Program related information sessions, supervised study sessions and assessment sessions and undertake
all assessments during my course.
• I agree to seek assistance from the trainers/lecturers, and support staff as soon as I experience difficulties with any aspect of my course.
I confirm that I will attend learning support and/or counselling sessions and intervention meetings if requested to do so.

4.10 PRIVACY
a) Personal information of students will be held by the College and may be accessed and used by people employed or engaged by the College
in the delivery of services to the student.
b) Information is collected in order to meet our obligations under the ESOS Act and the National Code 2018, to ensure student compliance with
the conditions of their visas and their obligations under Australian Immigration Laws generally.
c) The authority to collect this information is contained in the ESOS Act 2000, the ESOS Regulations 2019, and National Code 2018.
d) Information collected about the student on this may be shared between the registered provider and the Australian Government and
designated authorities and, if relevant, the Tuition Protection Services. This information includes personal and contact details, course
enrolment details and changes, and the circumstance of any suspected breach by the student of a student visa condition. In other instances,
information collected on this form can be disclosed without the student’s consent where authorised or required by law.
e) The provision of information is voluntary, but if this information is not provided, the College may be unable to process the student enrolment.
Students have a right of access to, and correction of, personal information in accordance with Privacy Legislation and the College’s Privacy
Policy.

SECTION 5: FEES, PAYMENT AND REFUND
5.1 DEFINITIONS
Student: A person who has signed the Student Agreement given by the College whether or not they have commenced their studies.
Tuition Fees: The fees for enrolment in a course determined by the College and advised in both the Offer Letter and the Student Agreement,
as being the tuition fees for the Course. The Tuition Fee is subject to change.
Non-Tuition Fees: Amounts the student has to pay other than Tuition Fees, directly or indirectly to the College in order to undertake the
course and includes but not limited to:
- Administration/Registration Fees
- Access Card Fees
- Material Fees
Fee Schedule: List of tuition and non-tuition fees for enrolment in a course offered by the College and advised in both the Offer Letter and
Student Agreement. The Fee Schedule is updated from time to time.
Payment Date: Date when tuition fee is due.
Student Agreement: Binding contract between the student and the College.
Agreed Starting Date: Starting date specified on the student eCoE.
Designated Account: Bank account where the initial fees are kept before the student commences the course.
5.2 PAYMENT OF FEES
a) All course fees and charges are payable in Australian dollars in accordance with the current published Fee Schedule. Fees may change from
time to time, so students should confirm with the College prior to commencement of their course. Once enrolled in a course, the course fees
will remain the same for the normal duration of that course.
b) Students must pay the "TOTAL FEES TO BE PAID IN ADVANCE" (referred to in page 2) only after returning the signed and dated copy of
the student agreement to the College and before the eCoE is issued.
c) The subsequent payments are indicated in the payment schedule below. Actual fees payable will be adjusted by the amount shown as
"TOTAL FEES TO BE PAID IN ADVANCE" on Page 2.

b) NON-PAYMENT OF FEES
The College reserves the right to take any or all of the following actions should a student not pay their fees as per the payment schedule:
- Disable access to computers
- Bar access to the classroom
- Bar access to examinations
- Withhold transcripts, certificates and other documents
- Suspend or dismiss the student from the College (and report to the Department of Home Affairs)
- Collect a late payment fee on the amount outstanding
- Pursue legal action to recover debt
c) LATE PAYMENT OF FEES
Students must pay their fees in accordance with the payment schedule above. Failure to pay fees by the due date may incur a financial
penalty. The College reserves the right to charge each month, an administration fee of $10 plus a penalty fee computed at the rate of 1% per
month on the amount outstanding from the day after the due date.
5.4 REFUND POLICY
a) Please refer to: http://www.aapoly.edu.au/student-policies for the latest refund policy and procedure. This refund policy does not remove the
student’s right to take further action under Australia’s consumer protection laws. In addition, the College’s grievance resolution process does
not inhibit the student’s right to pursue other legal remedies.
• Any request for refund must be forwarded in writing to the College via email to studentadmin@aapoly.edu.au, using the Credit/Refund
Form (found in https://aapoly.edu.au/wp-content/uploads/2020/07/AAPoly-Refund-Form.pdf) and signed by the student.
Note: If the student is withdrawing from the College, the student must complete and submit the Withdrawal of Enrolment Form along with
the Credit/Refund Form and any relevant supporting documents.
• The College will pay the refunds within twenty (20) working days after receiving from the student the Credit/Refund Form complete with
all the relevant supporting documents. A statement explaining how the refund was calculated will accompany the payment to the student.
• Refunds will not be processed if supporting documentation is incomplete.
• Where a refund is due, the refund amount will be calculated as per the refund procedure (referred to in clauses 5.5 and 5.6).
• Refunds will be paid to the student, unless written authorisation is given by the student nominating another party.
• Where a student is dissatisfied with a decision to provide or not to provide a refund, they may appeal that decision in accordance with the
Complaints and Appeals Process.
b) STUDENT DEFAULT
A student is not eligible for a refund in the event of a student default. Situations of student default include the following:
• The student fails to pay an amount they were liable to pay the College, directly or indirectly, in order to undertake the course;
• The student breaches a condition of their student visa;
• The student fails to start the course on the agreed starting day or attend classes and fails to inform the College in writing;
• Misconduct by the student; or
• The student withdraws from the course after the agreed start date.
c) DEFAULTS BY THE COLLEGE
• Situations of the College in default include the following:
- The course does not start on the agreed starting day;
- The course ceases to be provided at any time after it starts but before it is completed;
- The course is not provided in full to the student because a sanction has been imposed on the registered provider by the authorities;
or
- The student has not withdrawn before the default day
• In the unlikely event that the College is unable to deliver the course in full, the College will notify the Tuition Protection Service (TPS)
Director and the students within three (3) working days of the Provider default and will have a period of fourteen (14) working days to
satisfy its tuition protection obligations in relation to an affected student.
• The student will be offered a place in a suitable alternative course at the College or another provider, at no extra cost to the student, or
will be provided with a refund of all unexpended prepaid tuition fees. The refund will be paid to the student within ten (10) working days
from which the course ceased being provided. The refund will be paid directly to the student or another person who has been authorised
by the student in writing.
• The student has the right to choose whether to receive a refund of the unspent Tuition fees, or accept a place in another course at the
College or at another provider.
• If the College is unable to provide a refund or placement in an alternative course, or if it appears to the TPS Director that the College is
unlikely to satisfy its tuition protection obligations, the student will have access to an on-line placement facility under the TPS. If a student
requires any assistance with the placement process, a TPS Administrator or service provider will be available to help the student to place
them in a suitable alternative course, or if this is not possible, they will be eligible for a refund as calculated by the TPS Director.

5.5 VISA REFUSAL
a) Where a visa application is refused before commencement of the course, the amount of the refund payable by the College is the sum of both
tuition and non-tuition fees received by the College in respect of the student (the course fees), less a small amount to account for
administrative costs that the College may have incurred in enrolling the student and undertaking other activities in preparation for providing
the course to the student. The small amount of course fees that the College will retain on account of administrative costs is
• 5% of the amount of course fees received; or
• $500; whichever is less
Note: The student payment for the OSHC is separately processed and refunded in full by the College's partner health insurance provider
BUPA.
b) Where a visa application is refused after commencement of the course, the refund amount of the tuition fee paid in advance is calculated as
follows:
• Refund amount = weekly tuition fee x weeks in default period
c) In both circumstances, the student must show proof of refusal and evidence of payment to the College. However, the College is not required
to provide a refund if the visa was refused for one or more of the following acts or omissions by the student that directly or indirectly caused
the student to default:
• student's failure to start the course on the agreed starting day;
• the student's withdrawal from the course;
• the student's failure to pay an amount that they were liable to pay the College in order to undertake the course.
5.6 WITHDRAWAL FROM COURSE OF STUDY
The student must notify the College of their request to withdraw from their course by completing the Withdrawal of Enrolment Form and
Credit/Refund Form, if the student is also requesting a refund and submit the form(s) via email to studentadmin@aapoly.edu.au. A withdrawal
administration fee of $250 must be paid for every withdrawal request submitted. The refund amount for course withdrawal will be calculated
based on the date on the Withdrawal of Enrolment Form provided that all relevant documentation was received by the College and will be
calculated as indicated in the following tables:
• Before Commencement of Course:
70% refund of tuition fees paid in advance
(For AAPoly’s Higher Education courses: 70% refund of tuition fees paid
More than 4 weeks before course commencement
in advance less BTHM/BBUS Application Fee (non-refundable))

50% refund of tuition fees paid in advance


(For AAPoly’s Higher Education courses: 50% refund of tuition fees paid

In the event of a withdrawal from the course, no refund will be given for the following payments:
• Administration/Registration Fees or any non-refundable fees such as BTHM/BBUS Application Fee, unless specified otherwise.
• Fees used to purchase goods and services from other service providers (i.e. Book Fee, Knife Kit, etc.) unless not provided to the student.

SECTION 6: PAYMENT DETAILS
Payment must be made in Australian Dollars in the form of bank draft, direct transfer, or credit card. Bank charges, if any, will be added to the student’s
account. The reference number must be shown on all transactions.
A copy of any bank payment advices must be emailed to Academies Australasia Polytechnic Pty Limited via applications@aapoly.edu.au.
