INTRODUCTION AND GUIDELINE


RHDHV I&B Vietnam Specification System is split by disciplines as below:

▪ Book A: General Requirements (the overall general specification to be used in combination with
discipline specification)

▪ Book B: Civil & Structure

▪ Book C: Architecture

▪ Book D: Electrical

▪ Book E: Firefighting

▪ Book F: Plumbing

▪ Book G: HVAC

▪ Book H: Piping
Every Book has two separated documents:
(1) Standard Specification is the typical specification for all RHDHV projects
(2) Particular Specification is the specific specification issued for a particular project by altering the
standard specification:
 giving specific information as required by the standard specification;
 modification of text in the standard specification;
 adding or omitting text/clauses in the standard specification.

Non-altered clauses shall be noted with “Referred to Standard Specification”. Therefore, Particular
Specifications shall be used alongside the Standard Specifications.
Any specific requirements stated in the project Particular Specifications override requirements
given in Standard Specifications.
Specifications define minimum criteria chosen by the Engineer and the Employer. Any alternative or
deviation from the Specifications shall be submitted to the Engineer for consideration and acceptance.
It is important to emphasize that The Engineer’s acceptance shall not relieve the Contractor from any
duty obligation or responsibility the Contractor has under or in connection with the Contract.
Contractors shall always receive ‘Book A – General Requirements’ and other relevant Books
corresponding to the Contractor’s scope of work.
Languages: Specifications are written in English and could be translated to local languages if required.
English shall be prevailed in case of any conflict.
Abbreviations:

▪ QMS: Quality management system

▪ CDE: Common data environment (such as Box, Asite, BIM360, SharePoint, etc.)

PROJECT CONDITIONS AND SCOPE


Project identification
Project identification information is the official administrative information for a project, including
information such as names, locations, codes, etc. that are to be used in project communications and
documents. This information is specified in Book A Particular Specification.

Project summary
Project summary describes the overall scope of the project and is specified in Book A Particular
Specification.

Scope of works
A detailed description of the scope of works is given in Book A Particular Specification. The description
is not exhaustive and shall be read in conjunction with all other documents in the Contract.
The works included in the Contract comprise the furnishing and installing of all materials and equipment
necessary to form the complete construction of the works shown in the contract documents, which
include but not limited to drawings and Specifications.
The construction materials, equipment, finishes, fixtures etc. shall be the same or closely similar to those
shown on the contract drawings and/or described in Specifications.
All works shall be constructed in accordance with this Specification and its particularized one as well
with the contractual drawings.
The Contractor shall be responsible that all materials and items, mentioned and/or described in this
Specification and its particularized one and/or shown on the drawings and/or deemed necessary for the
proper and workman like execution of this project will be purchased, delivered, supplied, processed,
fixed, finished and tested by himself or under his authority unless specifically stated otherwise in the
Contract documents.
Where the Contractor is required in this Specification and its particularized one or other Contract
documents to purchase, deliver, provide, make available, allow or pay for installations, services, etc., it
shall be deemed that such costs have been provided for and included in the Contract Sum unless stated
otherwise.

Operation and connection permits and fees


The Contractor shall obtain all necessary operation and connection permits from Government agencies
and make all necessary applications and required arrangements for execution of works within the
boundary of the site/plot.

Standards, laws and guidelines


Standards mentioned or referred to on the drawings and this Specification shall be the most up-to-date
versions of the following:

▪ TCVN and QCVN (Vietnamese regulations)

▪ Other internationally accepted standard where specifically mentioned on the drawings or in this
Specification;
Required standards shall be specified in Particular Specifications.

Construction site handover


At the start of construction activities and further when the Contractor is mobilized, construction site shall
be handed over (partially or in full) from Employer to the Contractor, and/or from Contractor to another
Contractor.
Since the handover, the party receiving the construction site is responsible for all activities being
performed, security of site, safety of stored materials and equipment of their scope of work.
In case of a brownfield project, where Employer’s operating facilities have their own security services
provider, this shall be subjected to a separate discussion and agreement between Employer and
Contractor.
The Contractor shall conduct the following surveys, inspections and monitoring activities:

▪ Surveys, also pre-award such as site visits (to get acquainted with the site characteristics);

▪ Non-employer dilapidation survey;

▪ Structural / dilapidations survey adjoining buildings;

▪ Environmental surveys;

▪ Movement monitoring;

▪ Maintenance and inspection costs.

TEMPORARY FACILITIES AND CONTROLS


Temporary services
The Contractor shall provide at his own costs all required temporary services and facilities indicated in
this chapter to ensure proper execution of his works and if required so in the Particular Specification for
the use of other Contractors and Suppliers.

Temporary electricity supply


The Contractor shall provide all temporary electricity supply and artificial lighting required for the
execution of the works and for the temporary provisions and offices. The Contractor shall provide and
maintain all temporary panels, cables and wiring, and shall remove at project completion.
Temporary electrical cables shall be hung up at minimum 4.5 meters height at temporary road crossings
in order to not obstruct movement of vehicles and minimum 2.5 meters height at workplace / pedestrian
locations. Electrical cables can be hung on metal poles with isolated cable supports or to permanent
structures and/or other materials approved by the Engineer. Lighting fixtures to be installed on rigid steel
poles / frames. Timber and bamboo poles are not considered rigid.
All works for temporary electricity supply shall be carried out in a safe and workmanlike manner.

Temporary water supply


The Contractor shall be responsible for the supply of water for his own use on site from the connection
points of the water supply grid of the Municipality close by the construction site. The Contractor to install
sufficient connection points on site for use of his construction works.

Temporary drainage
The Contractor shall provide the following with respect to temporary storm water and wastewater
drainage system:

▪ Temporary mains or connection to temporary mains;

▪ Septic tanks;

▪ Holding tanks;

▪ Sewage pumping;

▪ Drainage infrastructure;

▪ Drainage installation and adaptations;

▪ Disposal costs (i.e. connection / discharge / tanker charges).


During the entire period of the execution of the works, the Contractor under this Contract shall maintain
the drainage.
Required periodic maintenance and necessary repairs of these site provisions during the construction
works shall be for the expense of the Contractor under this Contract and to the complete satisfaction of
the Engineer.

Temporary IT and telecommunication systems


The Contractor shall provide and maintain the suitable IT and telecommunication systems, such as WIFI,
LAN, subscriptions, hardware, software, walkie talkies, etc.

Consumables and services


The Contractor shall provide and maintain stationary, services and consumables in connection with site
establishment.

Temporary construction facilities


Temporary roads
The Contractor shall provide and maintain all necessary temporary roads and pavement-crossings, as
may be required, for access to all portions of the works. The temporary roads and/or pavement to be
maintained throughout the whole construction period. When no longer required and/or upon completion
of the works, the temporary roads and/or pavement to be removed and cleared from site.
Temporary roads must be minimum 06 meters wide and made with crushed stone or macadam,
compacted to K = 0.93.
Required periodic maintenance and necessary repairs of these site provisions during the construction
works shall be for the expense of the Contractor under this Contract and to the complete satisfaction of
the Engineer.

Site tools / equipment


The Contractor shall provide everything necessary for the proper and efficient execution of the works in
orderly sequence including all requisite tools, tackle, plant, scaffolding, hoists, machinery, labour,
haulage, materials and storage sheds, etc. required by the Contractor and clearing away all items at
completion or as they become superfluous and making good all or any damage caused. All tools and
equipment are subject to inspections and scaffolding system need to be submitted for approval.

Site accommodation
The Contractor shall provide and erect all temporary offices, stores, fabrication yards, etc. that may be
necessary for the construction works. The Contractor shall provide the following as part of his site setup.

2.2.3.1 Site facilities


Prior to any construction of temporary workshops, offices, stores, fabrication yards, etc. the Contractor
shall submit his space requirements, proposed locations, layout plan and drawings to the Engineer for
his scrutiny and approval.
The toilets may be in a separate container or building, which serve for the Engineer’s, the Employer’s
employees and the Contractor’s staffs only. It shall be cleaned daily with properly sanitary provisions.
All costs above to be borne by the Contractor.
The Contractor shall take down all sheds, etc. on completion of the works or when instructed to remove
from the site and make good all disturbed work.

2.2.3.4 The Contractor’s office


The Contractor’s office, of an Engineer approved structure, or containerized by 20 and/or 40ft containers
of sufficient size and fitted out as an office, sufficiently furnished and ventilated.
Office shall be minimal equipped with:

▪ Computers as laptops or desktops with sufficient quality for working for his staffs;

▪ A multifunction colour photocopy / scanning / printer with A3 paper size;

▪ A digital camera full time on site for recording site progress;

▪ A drone / flycam is recommended;


The Contractor will not be allowed to erect living quarters for his workers and staffs within the Employer’s
premises.

General sanitary provisions on site


The Contractor shall provide and erect all necessary proper sanitary and other facilities for the use of
the workers engaged on the site and to keep these in a clean and hygienic condition. The facilities shall
be fully equipped with sufficient WC’s, paper dispensers, urinals and wash basins, etc. This requirement
will be strictly enforced by the Engineer so as to prevent the workers using other places for sanitary
purposes. Should it be necessary as specified in the Particular Specification, this sanitary provision shall
be sufficient to allow use by labours of the other Contractors or Suppliers on site and serving as general
sanitary facility on site.
The Contractor shall provide the above-mentioned temporary buildings with the required electrical
installations, water supply and sewage system and shall provide connections to the appropriate service
mains. The sanitary provision will remain in place to the completion of the project and will be removed
from the site at the cost of the Contractor.
The Contractor shall prepare a drawing of the sanitary provisions for the Engineer’s approval.

Contractor working area


The Contractor's working areas must be maintained and kept clean by the Contractor. Working areas
must be provided with a hardened floor surface, to facilitate proper working conditions during the wet
season.

Project information board and advertisements


The Contractor shall provide and erect a project signboard as required under the regulation issued by
the Vietnamese Government and any other sign required by a local authority having jurisdiction.
The Contractor shall not be allowed to put up any signboards or other advertisements in any form within
the boundaries of the site or on adjacent grounds, unless approval has been obtained from the Engineer
for the erection of signboards or notice boards.

Security
The Contractor will be required to supply all day and night security and protection of the Works that he
may deem necessary, during the whole performance of the Contract, and he will be held responsible
for all losses or damage to his own materials on site or work in progress or to materials on site or work
in progress of his own sub-contractors.

Security lighting
The Contractor shall provide all temporary artificial lighting required for the security of the works. The
Contractor shall provide and maintain all temporary panels, cables and wiring, and shall arrange for the
clearing away at completion of all temporary provisions.

Lightning system
Contractor shall install a temporary ear-thing system for lightning protection to cover the complete
construction area. Ground resistance for lightning system must be below 10 ohms. Drawings for the ear-
thing system shall be submitted for approval before installation.

Prevention of trespass
The Contractor is to confine his operations to the actual construction site and is to prevent any trespass
on adjoining areas by the workers engaged on the construction site.

Unauthorized persons / Identification badges


The Contractor shall not permit any unauthorized person to have access to the site and shall give his
assigned persons and watchmen strict instructions to that effect. All personnel of the Contractor shall be
provided with identification badges, which shall always be worn when engaged on the works.

Material and equipment leaving site


Removal of any material and equipment shall be approved as site procedure by an authorized person
before leaving site.

Social security scheme


The Contractor shall allow for all costs and expenses in connection with any social security scheme in
force during the period of execution of the Contract and for all expenses incurred in complying with
statutory obligations regarding welfare, transportation, holidays, etc.

Protection
Protection of works
The Contractor will be solely responsible for the safety of the whole of the works including the materials
and plant on site until the Contract is accepted by the Employer as complete. He is to allow for supplying
all necessary materials and effectively protecting the whole of the works from damage, from whatever
cause arising, and is to allow for keeping the works free from storm water, subterranean water and
flooding by protecting with suitable covering, pumping, baling or as otherwise required or directed.
In areas with combustible materials and where otherwise directed by the Engineer, sufficient numbers
of fire extinguishers, to the approval of the Engineer, shall be provided.

Protection of adjacent structures


During the entire period of the execution of works on the project site under the Contract, the Contractor
shall be fully responsible for any damage to structures, services, roads, fences, waterways, drains, etc.
that are located on the Employer's or adjacent premises and any such damage resulting from the
Contractor's operations shall be made good by the Contractor at his own expense and to the complete
satisfaction of the Engineer and the Employer.
The Contractor shall take every effort to reduce the level of noise and dust from his operations, which
creates discomfort to occupants on site and adjoining properties or adjacent structures.

The Engineer may require specific adjacent structures to be surveyed and photographed in detail before
the commencement of the works and for all existing cracks in the structure to be recorded and
dimensioned on a drawing.
No construction, foundation, working area, etc. is to exceed the boundary of the site.

Protection of people and public property


The Contractor is to allow for keeping all roads, footpaths and rights of way clear of all plant, materials,
etc., and maintaining the unimpeded passage of vehicular and pedestrian traffic during the whole course
of the Contract.
The Contractor will also be held responsible for any interference or dislocation which occurs to any
supplies or services at the Employer's premises or to any public supplies and services such as water,
electricity, telephone, sewers, etc., due to the Contractor's operations and will be required to pay all
costs and expenses in connection with the reinstatement and repair of same.

Support the Engineer and Employer


When requested by the Engineer, the Contractor shall provide at his own expense as many men as may
be required to assist the Engineer in checking levels, setting out, making of concrete samples, taking of
soil samples, the testing of materials incorporated in the works or any work in connection with the
contract. All equipment for levelling, setting out and testing works on site, including that mentioned in
Chapter 07, shall be made available and kept in good condition for use by the Engineer.

Attendance upon other Contractors


The Contractor is to allow for affording every reasonable facility to enable the proper execution of their
works by other Contractors engaged by the Employer to proceed without interruption of the ordinary
progress of the works. The following to be included:

▪ The Contractor shall be responsible for general watching but each contractor shall be responsible
for the watching of his own tools and materials stored on the building site or the materials already
incorporated in the works;

▪ The Contractor is to obtain from all other Contractors’ full particulars of their requirements with regard
to chases, recesses, concrete supports and other such details, and is to supply them with all
necessary dimensions and other information to enable their works to be correctly carried out and
subsequent alterations avoided.
Alterations necessitated by the Contractor's failure to supply requisite information will be at his own cost.

Liaison with other parties


The Contractor shall cooperate closely with the Engineer on the matter of liaison between himself and
other contractors to prevent any undue interference with the progress of the works and delay in the total
project.
The Contractor shall prepare for his own activities a programme of works and shall provide to the
Engineer all information necessary for the coordination of the programme of works of the Contractor and
his subcontractors with that of other contractors and Installers.
The Contractor shall determine the critical dates for arrival of all essential installation and construction
materials for his own and his subcontractors' works and shall make a scheme of all the dates of
commencement and completion of the various stages of the works, in close coordination with the
Engineer.

Project related

The Contractor shall, in addition to his programme of works, prepare short term schedules for his own
and his subcontractors’ works which shall contain clear indications of works that have to be done by
other contractors or installers in order to prevent delay in the works, and the Contractor shall submit
copies of his short term planning sheets to all involved parties, including the Employer and the Engineer.
If required, the Contractor shall vary his programme of works and/or his detailed planning schedules to
allow for special circumstances or changes in the requirements of the Employer.
The Contractor shall closely watch the performance of each party engaged on the project and shall
immediately inform the Engineer in writing about occurrences that will or could influence the scheduled
progress. The Contractor shall also report in writing to the Engineer immediately whenever he suspects
or becomes aware of insufficient cooperation or performance of any of the other contractors and/or
installers or of circumstances that will affect the required quality and rate of progress of the works.

Cleaning, tidy and waste management


The Contractor must do a general site cleaning every day, and a complete site clean-up every Saturday
afternoon. Waste shall be disposed of daily at an approved waste collection point off site.
The Contractor shall remove from site all rubbish from time to time as it accumulates and leave the works
clean and tidy on completion.
Special care shall be taken regarding storage and use of oil and chemicals, which must be contained
and used properly and under no circumstances allowed to pollute the soil.
The Contractor shall take all measures that are necessary to prevent sewage, fuel, lubricants, chemicals
or contaminated water being discharged into temporary or permanent drains or seeping into the soil.
The Contractor will be obliged to notify the Engineer before commencing execution of works at site, and
about the measures he intends to take to enable him to comply with this requirement.
The Contractor must supply on a weekly basis to the Engineer, a list of chemicals stored on site, with
proper description of relevant properties of the chemicals.
This clause will be strictly enforced by the Engineer to maintain safety and neatness on the site.
Refer to Health, Security, Safety and Environment (HSSE) Regulations provided by the Engineer for
waste management requirements, which take precedence.

ADMINISTRATIVE MANAGEMENT
Communication
If the Employer does not have any specific request on any particular communication system which
should be applied in the project, the Engineer shall instruct its system through a Procedure / Plan,
which should be complied by all parties.

Minutes of Meetings
The Engineer shall call site or project meetings in accordance with paragraph 3.5.
These meetings shall be under the direction of the Engineer and decisions made during these meetings
shall be binding and included in the minutes of meeting.
Should the Contractor disagree with the contents of any minutes of meeting, he may make his comments
as soon as possible or in the next project meeting latest, and such comments will then be recorded in
the minutes of that meeting.

Digital communication
Communication can be made digitally via emails, messaging applications, etc. However, only
communication via emails is official. Specific digital communication protocol shall be agreed upon.

Official letters
All official letters (e.g. pertaining to contractual matters) shall be prepared and signed by an authorized
person of a party submitting the letter. Same way, official letters shall be addressed to an authorized
person of a party receiving the letter. All personnel that should be informed about a letter’s subject, shall
receive the letter as well.

Verbal communication
All verbal communications are considered as unofficial unless written Instructions are received by the
instructed party(ies) or in relevant minutes of meeting.

Documents and record control


Document control
If the Employer does not have any specific request on any particular document control system which
should be applied in the project, the Engineer shall instruct its system through an Information
Management Procedure / Plan, which should be complied by all parties to ensure the recognition of all
site documents and same understanding between parties.
The following minimum rules shall be indicated in the Procedure / Plan:

▪ Applicable Common Data Environment (CDE) platform to store and exchange documents between
parties. CDE can be Box, Asite, BIM360, etc. or the combination of multiple platforms, where project
participants are able to access within their granted permission;

▪ File Naming Convention is how document / file should be named in the way of ensuring recognition
and revision control;

▪ Document list(s) shall be kept track.

Site records
The Contractor should keep site records in an orderly manner by proper document control.

Hard copies shall be kept orderly in cabinets according to project’s filing system. Hard copies shall be
scanned and saved by the Contractor in agreed CDE.
Soft copies shall be kept orderly in server or CDE according to project’s filing system.
Filing system shall take into account project completion documents and as-built drawings.

Reporting
The Contractor shall submit following reports to the Engineer as minimum requirement.
Report Requirements

• The Contractor shall keep a diary on the site, in which shall be recorded with site daily
operation such as workers on site, materials and equipment related, drawings, special
Daily report / Work diary occurrences, etc.
• A copy of the diary shall be submitted daily to the Engineer for his perusal. The original
diary shall become the property of the Employer.

The Contractor shall submit Weekly Reports, which reflect weekly progress of works
Weekly report execution on the basis of performed volumes in comparison with what was planned and with
analyses of deviations, so as forecasts provided for the next construction periods.

The Contractor shall submit Monthly Reports to the Engineer and the Employer. Monthly
Reports reflect monthly progress of works execution with regards to Health, Security, Safety
Monthly report and Environment, summary report of work performed, any delay, progress compared to plan,
updated schedule, key milestones, labour resources, any variations, financial status, risk
assessment and works planned for next month, etc.

The Contractor shall submit Accident / Incident report to the Engineer and the Employer
whenever any accident / incident happening on site. In the report, the Contractor shall

analyse the situation, root causes, actions taken place to correct the situation and actions to
prevent it from happening in future.

Meetings
The Engineer shall determine the types of meetings required for the management of project. These can
be, but are not limited to the meetings below.

The Engineer’s instructions


Instruction procedure shall be according to the Contract conditions.

Variations and adjustments


Variation and adjustment procedures shall be according to the Contract conditions.
The Contractor shall inform the Engineer of the impacts of any variation.
If Contractor fails to give notice to consults or the Employer by writing in advance and approved by the
Employer, the Contractor shall not be entitled to claim any additional cost or variation.

Schedule and progress control


Project schedule
The Engineer is responsible for preparation of initial project schedule, which shall be high-level and
include various interfaces between the project participants. The project schedule shall be used as a base
for further elaboration of detailed construction schedules by the Contractor.

Construction schedule
The Contractor must prepare a detailed construction schedule (the contract schedule) in agreed software
on the basis of the project schedule provided by the Engineer at the start of construction. The schedules
should be made taking project risks into account such as weather, logistics, manpower availability,
material availability, safety, etc. The contract schedule shall be submitted for the approval of the
Engineer and the Employer. The baseline schedule shall not be amended unless reviewed and approved
by the Engineer. A modification of the schedule will not constitute an extension of time claim unless the
extension of time has been specifically requested by the Contractor and approved by the Engineer and
the Employer. The Contractor is fully responsible for following up the contractual milestones and
schedule.
The contract schedule shall be in such a form, and shall use such method of planning, that delays, and
the effects of delays can be discovered at an early stage and steps can be taken to correct and prevent
such delays. The total construction period of this schedule shall be the period stated in the Contract or
such shorter period that the Contractor thinks possible. When necessary, the Contractor shall prepare
amended schedules for the approval of the Engineer.
Based upon the approved contract schedule, the Contractor shall prepare working schedules and s-
curves for each individual construction item or process. The working schedules shall detail each and
every construction item or process, on a day-to-day scale.
Progress shall be shown on the working schedules by progress lines indicating the percentage of work
done, and they shall be submitted weekly.

Other schedules
Based on accepted detailed construction schedules the Contractor shall develop and timely submit (as
agreed with the Engineer) the following schedules:

▪ Manpower and machinery-assignment schedules;

▪ Material approval and delivery schedule;

▪ 02-week ahead schedule;

▪ Shop drawings submission and review schedule;

Construction progress tracking


3.8.4.1 Overall progress of construction (S-curve)
Contractor is fully responsible for tracking schedule(s) and meeting deadlines.
On monthly basis (or as instructed by The Engineer and Employer) Contractor shall provide S-curves
for the project (in relation to its scope of works) on the basis of progress of works and cash flow. The
progress S-curve shall contain planned progress, actual progress, forecasted progress.

3.8.4.2 Observance of the schedule


Project participants shall do their outmost in order to keep contract milestones and complete project on
time. Comparison of actual progress of works with planned progress shall be carried out by Contractor
on daily basis. The Engineer and the Employer shall be notified in case any potential impacts on the
schedule occurs.

3.8.4.3 Measures on catching up


In case due to any issues, itis observed by Contractor and/or the Engineer that delays might, will or have
occur(ed), Contractor shall immediately elaborate measures on catching up the original schedule.
Contractor is fully responsible for elaboration and implementation of necessary corrective measures.
After the Contractor’s catch-up plan is submitted, the Engineer shall study and check proposed plan and
accept it or provide comments within required days.
Detailed schedule shall be updated accordingly if impacted and distributed to other parties.

Risk Management
The Contractor shall prepare monthly a risk management analysis to identify upcoming risks and to
prepare mitigation measures.

Organization chart, responsibilities and contacts


Contractor shall furnish the Engineer with an organization chart and contact information within 14 days
of commencement. Should the names or positions deviate from the contractual organization chart, the
Contractor shall need to get written approval. Contractor is responsible to keep the organization chart
and contacts up to date at all times.

Staff management
The Contractor shall make available all staff members that are required to ensure the proper and smooth
running and timely completion of the project. Such staff shall have the proper qualifications and
experience for the work on which they will be engaged. Should there not be a contractual organization
chart, the Contractor shall propose, for approval by the Engineer, his senior staff members.
The Project Manager, Site Manager and Safety Supervisor/Manager of the Contractor must be able to
speak, understand, read and write English and the main communicated language in the project.
The Engineer reserves the right to instruct the Contractor to replace any of the Contractor’s staff in the
case of their misbehaviour, or if the Engineer is of the opinion that the staff are incompetent in their fields
of work.

Working drawings on site


The term "Working drawings on site" means either the contract drawings, or later designs issued for
construction, and the shop drawings made by the Contractor.
Soft copies of working drawings on site are to be kept on proper folders in applicable CDE and hard
copies (if needed) are always kept on site. The hard copies shall be in a good readable condition and of
the latest issued revision.

Calculations and drawings


Where required in this Specification and where considered necessary for proper execution of the Works,
the Contractor shall prepare a detailed design which can include models, calculations and (shop)
drawings. These shall be made in accordance with specified laws, regulations and standards and shall
be produced in accordance with the project Information Management Plan/Procedure, if defined.
Calculations and (shop) drawings shall be made by qualified engineers. The qualifications and licenses
of the engineers shall be available upon request. Such calculations and drawings shall be issued to the
Engineer for checking and approval. The Contractor shall supply to the Engineer and to other contractors
concerned three prints of the final approved (shop) drawings.
In case of any discrepancies throughout the tender documents, the Contractor shall immediately inform
the Engineer in writing and request for a decision.

Dimensions
Figured dimensions as indicated on the drawings are to be followed and in no case shall dimensions be
scaled from the drawings. Whenever possible, dimensions are to be taken from the building(s). Before
any work is commenced by specialist firms, dimensions must be checked on the site and/or the
building(s) and agreed with the Contractor, who shall be responsible for the accuracy of such dimensions
irrespective of the comparable dimensions of the drawing(s).

QUALITY ASSURANCE REQUIREMENTS


Contractor quality system
Contractor shall use their own Quality Systems (QA/QC, QHSE, etc.) for the performing of the works
and providing services on a daily basis. All documentation and work, subject to be reviewed and/or
accepted by the Engineer and/or the Employer, shall be prepared as per the Engineer’s quality system
and following relevant procedures (i.e. using standard forms, preparing and submitting as per fixed
timeframes, having required information and signatures of authorized personnel, etc.).
The Contractor shall be responsible for training their staff and workers with regards to the project QA/QC
systems as well as agreed/approved requirements. The Contractor shall also be responsible to create
awareness regarding quality assurance and quality control.
Should the Engineer deem the Contractor’s documentation insufficient, the Engineer may require the
Contractor to adopt the Engineer’s site forms.

Submittals for approval


Requests for approval (RFA)
The Contractor shall submit formal requests to the Engineer by means of approved standard forms for
the approval of:

▪ Materials, equipment;

▪ Samples and mock-up;

▪ Method statements and Job Safety Analyses;

▪ (Shop) Drawings and calculations;

▪ Subcontractor;

▪ Manpower planning and any changes in organization chart, roles and responsibilities compared to
the initial agreement;

▪ Any changes in construction schedule

▪ Any other changes compared to the initial agreement;

▪ Other topics as required by the Engineer.


The Contractor is responsible that relevant staff and workers are informed of the approved submissions
to enable them to comply.
It is important to emphasize that the Engineer’s approval and/or acceptance in any items shall not relieve
the Contractor from any duty obligation or responsibility the Contractor has under or in connection with
the Contract.

Material & equipment approval


All materials and equipment need to be approved by the Engineer. The Contractor may not deviate from
specified brand(s), unless specifically requested and approved by the Engineer.
Requests for approval of building materials shall, if reasonably possible, be accompanied by a
representative sample of the material proposed for approval, the names of the makers, together with
any details that may be requested by the Engineer.

The Contractor shall not order materials or start with any special process or method of execution of
works till the acceptance of the Engineer has been obtained. If required by the Engineer, the Contractor
shall provide him with copies of the purchase orders for such materials.
Samples
Samples required by the Engineer are to be provided without delay at the Contractor's expense and
shall be in accordance with the relevant standard method of sampling. The samples shall be taken in
such a way or by such a method that they can be considered to be representative of the full quantity of
materials or work from which they are taken. The samples, when approved, will be kept by the Engineer,
who has the right to reject all materials or workmanship that are not corresponding in quality and
character with the approved samples. Suitable, labelled boxes or containers for the storage of samples
shall be provided by the Contractor at his own expense.

Mock-up approval
Some works may require a mock-up by the Contractor, which shall be requested by the Engineer. The
Contractor shall provide mock-ups free of charge for consideration no later than required days before
intended usage of such material or execution of such work on site.
All approved samples and mock-ups shall be stored by the Contractor in a sample room/container or
shall remain on site until requested to be removed.

Method statement approval


The Contractor shall be responsible to draft method statements to explain how they will execute generic
or specific works on the project. The method statement shall cover the following subjects:

▪ Scope of works

▪ Materials to be used

▪ Manpower and machinery requirement to be used

▪ Schedule for each individual task

▪ Survey method

▪ Installation details

▪ Construction procedure

▪ Quality control procedure

▪ Material and waste management

▪ Risk assessment/Job Safety Analysis (JSA) covering health, safety and environment

▪ Others as required by the Engineer


In case any changes to the method during the construction time, the method statement shall be updated
and resubmitted for approval.
Once the method statement is approved, the Contractor shall not be allowed to deviate from it without
consent from the Engineer.

Subcontractor management
The Contractor shall be responsible for the work of all Subcontractors, for managing and coordinating
all the Subcontractors’ works, and for the acts or defaults of any Subcontractor, any Subcontractor’s

QUALITY CONTROL REQUIREMENTS


The Contractor shall be fully responsible for the quality control of the works by providing surveys,
inspections, monitor, setting out, protect the works, and environment control of the construction as well
as by providing necessary equipment to conduct any tests and measurements.
Contractor’s site teams shall be arranged in such a way that the whole construction site is split into
separate zones with responsible persons of each discipline appointed for each of them avoiding blank
spaces.

Factory / Workshop inspection


The Contractor shall be responsible for the inspection of factories and workshops to ensure good
conditions for manufacturing materials, equipment and structures according to Specifications. This
includes the inspection of the facility’s quality management system.
The Contractor shall invite the Engineer to witness the inspections.

Certificates
The contractor shall provide all certificates as required in the Contract Conditions and in accordance to
TCVN / QCVN regulations and/or other project requirements.
Materials and equipment shall, unless otherwise directed by the Engineer, be tested before leaving the
manufacturer's premises and the Contractor shall obtain and supply to the Engineer for his approval
certificates from the manufacturer, showing that the materials and equipment have been tested
according to the relevant specification or standards.

Testing
Factory Acceptance Test (FAT)
For main equipment and components, as per suppliers / manufacturers QA & QC system and/or as
defined by the Engineer, FAT to be performed and documented. The Contractor to invite the Engineer
to witness the FATs and to include all cost related to these FATs.

Tests
The Contract shall perform all tests as required by TCVN / QCVN regulations and as specified in design
drawings and specifications.

Equipment for testing and measuring


The Contractor shall make available at his own expense for use on the project site or in workshops of
the Contractor or his Subcontractors or Suppliers, as the case may be, such equipment necessary for
the measuring or testing of the quality of construction works and finishes produced on the project site or
in said workshops. Such equipment shall be in good condition and shall be calibrated to ensure that the
results of tests or measurements are within the required degree of accuracy.

Testing institutes
The Contractor shall notify the Engineer which institute(s) is selected by him for the testing of
construction materials and the Engineer reserves the right to inspect the facilities and equipment of the
institute(s) and informs the Contractor which of the said institute(s) is acceptable for the said testing of
construction materials.

Inspection and supervision


The Contractor shall perform inspections and supervisions as per its QAQC system and the Vietnamese
laws and regulations. Final inspections to be performed, documented and signed off by the licensed
Contractor’s and Engineer’s Supervisors.
Inspection upon receiving
Quality control of received materials, products and equipment is performed on site by Contractor’s
personnel. Results are to be recorded in a Material Delivery Form (MD) and in a Register of Received
Materials. Register of all MDs and digital copies of logbooks are to be submitted to The Engineer by
Contractor at required time.
The following must be checked by Contractor upon receiving any materials / structures / equipment:

▪ Correspondence to specifications;

▪ Quantity;

▪ Quality;

▪ Damages;

▪ Presence of necessary certificates and guarantees.

Testing and commissioning


The Contractor shall prepare testing & commissioning plans for each of the systems on site. The T&C
plan shall be based on specifications, design, equipment data and other information that shall be
considered as a base for commissioning period and include information on:

▪ T&C activities;

▪ Training of the Employer’s personnel (Refer to chapter 8)


The T&C plan shall be reviewed and accepted by the Engineer. After that, the Contractor shall carry out
commissioning activities according to the plan, which are to be witnessed by the Engineer, the Employer
and relevant stakeholders of the Employer. Results of all testing activities shall be recorded and shared
with all involved parties.
If T&C activities fail to comply with requirements due to malfunction of a system or any other reasons,
the Contractor shall prepare a report describing an issue led to malfunction. Report shall be submitted
to The Engineer and Employer. All causes of malfunction shall be rectified by Contractor(s) and accepted
by The Engineer and Employer before any further tests are carried out.
After successful completion of T&C activities, all relevant forms and documents shall be registered and
filed as document control rule indicated in part 3.2 (Document and record control). Each project
participant involved in T&C activities shall receive 01 copy of signed off documentation.

Non-compliance report (NCR)


A Non-Compliance Report (NCR) is issued when the Engineer identifies non-compliant work(s) or its
part, performed by Contractor(s) with regards to the Contract which includes specifications, regulations,
standards, design, etc. NCR can be issues in relation to quality of works, type of materials in use, HSE
level and any other characteristics of works/services, which differ from the Contract requirements.
A subject of an NCR might be required to be removed, rectified and/or replaced. The Contractor shall
bear all related costs. In case a remedial action is possible, The Contractor shall propose necessary

corrective actions and submit them to the Engineer for review and acceptance. After acceptance of
proposed corrective actions, the Contractor shall carry out necessary works/actions. After that, the works
shall be inspected and approved by the Engineer.
At taking over, all NCRs must be closed, unless otherwise decided by the Engineer.

Defects and reparation


Should a defect be identified by the Engineer during the project, the Contractor shall repair it as quickly
as possible. Prior to the execution of the repairs, the Engineer may request the Contractor to submit a
method statement for the repairs for approval.
Contractor(is obliged to execute works in such a manner, so no defect and/or outstanding items are left
by the time of expected Taking-over date.

regulations as well as the table below. The Engineer reserves the right to request other documentation.

The documents shall be submitted to the Engineer for approval and be approved prior to the issue of
the Taking-over Certificate.

As-built drawings and Model


The as-built drawings shall be submitted as white paper prints, at A1 format, complete with all necessary
signatures and stamps, with their scanned files on 01 set USB or applicable CDE platform as provided
by the Engineer. The Contractor shall also submit the native files of the drawings and the drawings
printed out as pdf format.
The Engineer may further define the as-built drawing requirements with type of files (soft or hard copies),
quantity, and related requirements regarding submission time, etc. The Contractor shall prepare as-built
drawings accordingly.
The requirements for the update of the 3D model are defined in the Particular Conditions.

Cleaning
The Contractor shall perform a final builder’s clean upon handover of the project.

Training
The Contractor shall train the Employer’s personnel. The basis of the training shall be the final
documentation. The training shall take place with regards to:

▪ How to operate and maintain buildings, equipment and systems;

▪ How to use project completion documents.


Training activities must be finished and accepted by the Employer before the start of Taking-Over
activities. The Contractor shall administer attendance list of all trainings and submit it to the Employer.

Taking over
The Contractor is fully responsible for organization, notification and timely performed activities on
Taking-Over.
All testing and commissioning activities, outstanding works, rectification of defects and similarity (Refer
to Chapter 07) shall be completed and accepted by the Engineer in the scheduled date of Taking-Over.
The final joint inspection by the Employer, the Engineer and the Contractor shall take place on the date
of Taking-Over. If the inspection reveals additional outstanding items, decision is to be made by the
Employer – if the object can be taken over in an incomplete state or not. If the Employer agrees, then
correspondent information on newly revealed outstanding items and deadlines for their rectification shall
be mentioned in the Taking-over Certificate (TOC). In case the Employer refuses to take over any object
which is newly revealed as an outstanding item, Contractor shall rectify such and inform other parties
about a new inspection date.
The following activities shall be successfully finished by the Contractor and accepted by the Engineer
and Employer before the TOC issuance:

▪ Completion of works as per contract;

▪ Rectification of all defects as per chapter 07;

▪ Completion of necessary tests and commissioning activities as per chapter 07;

▪ Submission and acceptance of all required project completion documentation as per part 8.2;

Project related

▪ Completion of training of the Employer’s personnel as per part 8.4.


Issuance of TOC defines the start of defect notification period. Possession of site will be returned to the
Employer, so as provision of security on site, responsibility on damages to works and third-party liability.

Defect notification period


The Contractor shall keep responsibilities for carried out works according to the Contract Conditions
after the TOC is signed throughout the whole Defects Notification Period (DNP).
In case of any defects appear during the DNP, the Contractor shall perform actions to resolve defects
within required time. All rectified defects shall be checked and accepted by the Employer.
