JUDICIAL AFFIDAVIT
I, ________________, Filipino, 65 years old, married and a
resident of __________________, Bohol, Philippines, after having
been duly sworn to in accordance with law, hereby depose and say:

1. That I am testifying as a private complaining witness in the

above-entitled case;

2. That this Judicial affidavit is taken upon examination of ATTY.

DODELON F. SABIJON at his law office at SABIJON &
ASSOCIATES LAW OFFICE, Mezzanine Floor, Sarabia-Co-Torralba
Bldg., CPG Avenue, Tagbilaran City, Bohol, Philippines, where my
statements were taken;

3. That I am answering the questions asked of me, fully conscious

that I am doing this under oath and that I may face criminal liability for
false testimony or perjury if I state a falsehood in my testimony. The
whole process has been done in Visayan which language is
understood by me, and translated into English and explained to me;

4. That the following are the questions asked of me and answers

that I gave to the questions:

[Q3 : At the age of 65, can you tell me your state of physical
condition?
A3 : Aside from being a senior citizen, I am suffering from
stroke and I cannot easily move as I have the difficulty of
moving].

nga maoy hinugdan niining maong kaso.

[Q4 : Since when do you have this stroke?

A4 : Several years ago even before the incident that gave rise
to this instant case].

P5 : Niadtong Abril 10, tuig 2016, ilabina niadtong mga oras alas 3:30
sa hapon, makihunumdum ka ba kon dis-a ka niadtong panahona?
T5 : Niadtong petsaha ug orasa, didto ako sa among balay sa
_________, _________, Bohol nagpatigayon sa ahong mga panday
nga nagama ug ad sa mga baboy diha likod sa among kusina sa
balay.

[Q5 : On April 10, 2016, particularly at around 3:30PM, can

you recall where were you?
A5 : During that date and time, I was in our house in
__________, __________, Bohol tending my carpenters
who, at that time, were making a pig pen at the back of
my house at the kitchen area].

[Q6 : Can you recall and state what unusual incident that
happened while you were at your house with your
carpenters?
A6 : Yes. I heard someone outside of my house who was
getting wild and making noise and was so violent as he
was shouting something bad against me and my wife. As
I stood up and looked from our house, I saw that the
person who was shouting threatening words against
me and my wife was approaching near my house and I
identified he was ______________].

P7 : Unsa man ang imong naobserbahan, kon aduna man, ni

T7 : Kini siya nagsigit-singgit nga iyang patyon ako ug ang akong

[Q7 : What did you observe, if any, on _______________

whom you said was near outside your house?
A7 : He was shouting that he would kill me and my wife
because he was angry at my wife and me. He challenged
me for a bolo fight].

P8 : Unsa ang imong tubag, kon aduna man?

T8 : Ako siyang giingnan nga ako dili mo-tubay kaniya ug ako
siyang giingnan nga mopalui nalang sa ilang balay.

[Q8 : What was your reply, if any?

A8 : I told him that I would not engage with him and I told him
to go to his home].

P9 : Unsa man ang iyang gibuhat sa imong tambag kaniya?

T9 : Siya mipadayon sa paghulga sa pagpatay kanako ug sa akong
asawa.

[Q9 : What was his reaction, if any, on your advice to him?

A9 : He still threatened me to kill me and my wife].

P10 : Unsa ang imong na-obserbahan human ikaw nakadungog sa

mga pulong pagpanghulga batok kanimo ug sa imong asawa?
T10 : Ako nakabantay usab nga ang akong mga trabahante
nagpakisusi usab ug sila ug pagkahuman nibalik sa ilang trabaho.

[Q10 : What did you observe upon hearing those threatening

words against you and your wife?
A10 : I observed that my carpenters also verified and thereafter
went back to their work].

among balay didto dapit sa akong nahimutangan sa kusina nga walay

[Q11 : What happened after that?

A11 : I saw that ________________ immediately went inside
our house where I was at in the kitchen area
without asking permission and continued to threaten to
kill me].

[Q12 : Where were you at that time when

__________________ entered your house in the
kitchen area?
A12 : I was there at my kitchen area because my carpenters
whom I supervised in their work].

P13 : Unsay sunod laing nahitabo human niadto?

T13 : Ako mo-estorya unta kaniya apan sya mikalit hinuon ug
dasmag kanako pinaagi sa pagamit sa iyang sundang ug iya akong
gitigbas pero wala siya kaigo diri kanako tungod kay didto man sa
jam sa pultahan niigo ang iyan sundang sa diha ning tigbas sya dire
kanako ug nahuso kini sa pu-an sa sundang tungod sa kakusog sa
pagtigbas.

[Q13 : What next happened then?

A13 : I tried to say something to him but he immediately
attacked me with the use of a bladed weapon (bolo)
and hacked me but missed because his bolo hit on the
door jam portion when he hacked me and the blade
was loosened off from its handle because of the
impact].

[Q14 : What did you do in that situation?

A14 : I tried to defend myself but was not able to because he
picked up a bamboo stick and struck me that cause me
to fall to the ground. He kicked me several times while
I was lying on the ground until my carpenters helped
me and brought ____________________ out of the
house].

kasakit niini ug uban pang parte sa akong lawas tungod sa iyang

[Q15 : What was your injury from the incident?

A15 : My head was bloodied and I felt pain on different part of
my body because of his striking of the bamboo stick
and of kicking me. It was my head that I felt the most
pain at that time].

A16 : Diha lang ako sa balay ug giingkan ako nga magpakitabang
sila sa police ug sa ambulansya.

[Q16 : Where were you after you were helped by your workers
after the acts done to you by _______________?
A16 : I was in our house and was told that they will ask for
help for police assistance and ambulance].

P17 : Samtang didto ikaw sa inyong balay, unsa pay imong

nahobalo-an?
T17 : Dihay mga tawo nga nagtapok sa gawas sa among balay ug
unya pagkataod taod ako nahibaloan nga ang akong asawa gibunal-
bunalan usab ni _____________________ ug lipak ug sa dgidla nila
ang akong asawa sa among balay, nakita nako ang akong asawa
nga nagkadugo usab ug adunay mga samad sa iyan dagway.

[Q17 : While at your house, what else happened?

 A 17 : There were many people outside my house, and few
moments thereafter, I was informed that my wife was
beaten with the use of a flat bamboo slat or stick by
___________________, and when my wife was
brought to our house, I saw for myself my wife in
bloodied condition and with injured face].

A18 : The policemen arrived and we were fetched by
ambulance who brought us to the hospital at the town
center, and then we were later transferred to

T19 : Oo, ang doctor nga nag-examine sa akong samad sa ulo
naghatag kanako ug medical certificate nga mao usab ang akong

[Q19 : Do you have medical certificate in relation to the injuries

that you sustained?
A19 : Yes, the doctor who examined my head injuries issued
to me medical certificate which I gave to the police of
__________ Police Station when they took statement
from me for initiating a case].

A20 : That is the medical certificate issued to me by the
doctor].

T21 : Oo, uyon.
 [Q21 : I wish to attach this medical certificate to your judicial

P22 : Nakahinumdum ka ba unsa ang sunod gibuhat sa mga police

kabahin sa imong reklamo batok ni _________________?
T22 : Ang police nangutana kanako ug sa akong asawa kabahin
unsay nahitabo ug sila gagama ug sinuwat nga pamahayag diin kami

[Q22 : Do you recall what did the police do in so far as your

complaint against _________________?
A22 : The police asked me and my wife about what happened
and they prepared affidavits and let us sign them and
told us that the case will be immediately filed before the
prosecutor’s office in Tagbilaran City].

Q25 : The police told me that they translated what I said to
English and let me sign the affidavit which I

[Q26 : Are the statements contained in the affidavit true and

A26 : When I discussed with my lawyer who translated to me
the affidavit that was written in English, I would say
substantially those are correct with some minor
mistranslation or misinterpretation of what I narrated to
the police. The contents of my judicial affidavit are
correct account of what transpired regarding the
incident where I was the victim of attack by
______________].

 [Q28 : You said earlier that you were hacked with a bolo by
_________________ but you were not hit because the
blade of the bolo stuck to the door jam of your kitchen
and because of the impact of the hacking, the bladed
metal was thrown off from its holder. Do you know
where now the bolo is?
A28 : I got information that the bolo was recovered and turned
over to the police. And I asked the police where was
the bolo, and they said the bolo is in the control and
possession of ___________ Police Station].

P29 : Gawas sa medical certificate, aduna ba kay dugang pruweba

T29 : Oo, naa koy larawan samtang ako naa pa sa hospital,
gipicture-ran ako sa akong bata nga si ___________ ubos sa akong

[Q29 : Aside from the medical certificate, do you have other

proofs of your wounds or injuries?
A29 : Yes, I have a picture of me while confined at the
hospital which picture was taken by our daughter
______________ upon my instruction on the day we
were brought to the hospital].

[Q33 : How much were incurred on these expenses?

A33 : Not less than PHP8,608.00]

P34 : Aduna ka bay mga resibo sa maong nabayad?

T34 : Oo, adunay akoy mga recibo.
[Q34 : Do you have proof/s of such expenses?
A34 : Yes, there are receipts].

P35 : Akong ipakita kanimo kining mga resibo sa tambal ug sa

bayad sa hospital, mao ba kini ang giingon nimo kaganina?
T35 : Oo, mao kini ang mag recibo sa tambal nga napalit ug sa
bayad sa hospital. Aduna pay wala maapil niana tungod kay adunay
mga resibo nga nawala or nawani.

[Q35 : I show to you these receipts which are for medicines

and hospital expenses, are these the ones that you
mentioned earlier?
A35 : Yes, these are the receipts for the professional fees of
your lawyer, do you conform to my action?

A37 : My expenses in hiring the services of a lawyer]

P38 : Pila man imong nabayad?

T38 : Sa akong kaso, ningbayad ko ug acceptance fee nga PHP50,
000 kay gitunga man kini sa kaso sa akong asawa, unya sa
appearance fee kada hearing nga PHP6,000.00 sa ako lang nga
kaso. Mokabat na ug dili momenus sa PHP150,000.00 og
magpadayon pa sa paggasto sa sunod nga mga adlaw hangtod
mahuman ni nga kaso.

[Q38 : How much did you incur?

A38 : For my case, I paid acceptance fee in the amount of
PHP 50,000 being half of the amount actually paid for
this case and for my wife’s case and other expenses as
well as appearance fees in the amount of PHP 6,000.00
for my case alone; For total of not less than
PHP150,000.00 and I will continue to incur more until
the end of this case].

putting in place your case, did you expend any
amount and how much, if any?
A41 : Yes, I incurred amount not less than PHP10,000.00]

out from the intentional acts of the accused, can you tell
me what was your feeling?
A42 : I was physically in pain, emotionally in fear and suffered
sleepless nights and wounded feelings because I was
subjected to such violent acts by the accused when I
have not wronged him].
