Task 1: Workers’ responsibilities in the workplace

Question 1

The accident happens because the workers were not paying attention. There is the violation of
Article 19 of C155 because the workers were not given proper trainings and there was no
competent employee to view the machine. The workers have certain responsibilities in the
workplace, and they must take care of all the things while operating the heavy machines. There is
certain obligation that must be followed under the Article 19 of C155,

Article 19 of C155

The worker while doing their work must pay close attention to the performance of the task and
fulfil all the obligations related to the task and must listen up to the managers. This was
necessary to considered to avoid the accidents.
The representative of the manager should be there to look for the employees and cooperate with
them in taking care of their safety and health.
There must be a representative of the worker that knows everything and have every information
to secure the safety of the employee working on the field. If the representative or the manager
knows about the information then the accident of machine do not happen, so there was a breach
of this clause.
The workers and their manager must be given adequate training by the employer to ensure the
safety and update of knowledge, but there is not enough knowledge about the use of machinery
is given to the temporary employees result in the accident.
The worker must report to the senior manager or to the owner if there is any type of serious
situation and there is danger to the life of employees, the manager cannot ask workers to come
back for the work until it is solved however, there is a breach and worker continue to use the
machine despite knowing that it is not performing well.

Recommendation 16 of R164

The recommendation is given in the R164 to avoid the problem arise from this type of situation,
it tends to reduce the workforce problem by following up the recommendation,
1. Lightning, ventilation, and proper cleaning of the workplace to avoid accidents.
2. Prevention of fires, explosion, and measures must take care if there are explosions.
3. The first aid treatment must be provided at the workplace.
4. The establishment of emergency plans to run away with the hazardous situations.
5. Supervision of the health of employees to ensure they are fit.
6. Check the useful life of the machines, plants, or assets.
7. Design, manufacture and maintenance of the clothes and equipment’s o the workplace to
avoid any accidents.

Task 2: Influencing health and safety culture

Question 2
The negative indicators of the safety and health cultures of the supermarket causes the accident
to take place in the workplace. They are many negative indicators that shows manager is not
engaged in retaining the employees and it is causing serious problem for both the supermarket
and employees. The negative indicators of health and safety experiences by the workers in the
supermarket are,
Communication Gap
There is a communication gap between the manager and the owners. The authorities were not
giving ear to the supermarket and the technicians were not coming up to the supermarket to
check the machine. The temporary employees were asked to stay away from the machine and
only expert can use it, however due to communication gap every person is using it until the
accident happens.
No Response of Complaints
There was no response on the complaints and the manager were not paying heed on the
complaints and they were threatening the employees that whoever bring up the complaint were
going to relieve cut on the pay. The complaints were not received in the good way and they were
not welcome by the owner as well.
Blame Culture
There was lot of blame culture in the supermarket, and everyone was blaming each other. The
manager was blaming to the owner who has not notified the authorities and the workers who
have started using the machine without competency. The owner is blaming the high authorities
because they do not send their worker to fix up the machine despite their complaint to the
authorities. Both the owners and manager were not performing in the good way.
Too much Pressure to Handle.
There is too much pressure to handle, and supermarket is eager to sell their goods and products
that they are not even care about the misfunctioning of the machine. The have strict deadlines
and order to beat up that they continue to work on the machine that is not performing right. The
use of the machine causes the accident and crushed the hand of the worker. This pressure leads to
the stress and all the worker without noticing working and supermarket is eager to open the store
because they must meet the sales.
Supply and Demand of Products
There is supply and demand of the products in the market and supermarket is the competitive
market and is selling goods to the people. It has enough revenues and is eager to sell more, there
is lot of demand in the market and to meet up those demands, they must supply more goods. So,
this high demand increases lot of pressure on the workforce, and they continue to work on the
machines that is not performing well. The accident is result of this demand and supply of the
supermarket.
Improper Concern of the Authorities
The authorities do not take concern and they are not worried about the workforce. There is no
proper first aid treatment given to the worker and he was rushed to the hospital. After the
inquiry, the authorities are eager to open the store once again and the machine is not fixed yet.
There might be chance of another accident because lack of care towards the workers and it might
end up taking the life of any other employee.

Task 3: Health and safety management roles and responsibilities

Question 3
The health and safety management roles and responsibilities were not effective in the
supermarket. They tend not to cater about their responsibilities and left everything stranded
between in the middle that results in the accident. They do not know the seriousness of the health
and safety measures. The responsibilities were not effective, and they hardly care about the
health and safety measures of the supermarket. The supermarket has not taken many actions and
their responses towards their roles were highly disgrace, the non-effective behaviour of the
supermarket is,

No emergency response
There was no emergency first aid treatment present at the supermarket and the worker is taken to
the hospital. If any type of situation like this arises again then the supermarket will not be able to
tackle the worker. There must be proper emergency treatment or first aid kit to help the worker in
the emergency. It shows the ineffectiveness of the health and safety towards the workers.
Poor Induction Process
The induction process given to the new worker were very poor, the two-minute video is shown to
them and no information related to the supermarket is given to them. The worker does not know
their roles and no detail policy of stores layout is given to them.
Communication Gap
There is communication gap between the night shift managers and the day shift managers, they
were not able to communicate the problem. The managers do not have proper conversation and
they do not convey the problem to each other, this lack of communication does not aware the
workers about the seriousness of the problem. The accident is caused due to lack of
communication.
Risk Assessment
Risk is not properly assessed by the manager and they do not know how to use tackle the
problem of misfunctioning of the machinery. They did not estimate the risk and keep on using
the machinery that result in the crushing of hands of the worker. The risk can bounce back again
and lead to some other problem.
Demand to cater.
They have capacity to fulfil the demand of the products and meet their sales by recruiting new
employees and were not able to give prior information before recruiting the new workers.

Task 4: Accident investigation and recommendations

Question 4 (a)

The scene of the accident should be secured to know everything about the accident and to avoid
these circumstances and such accidents soon. The investigation must do so, it is necessary to
secure the place so that police or the legal authorities look down into the matter. Following are
the reason to secure the place,
1. For investigation purposes
2. For the learning purpose, it is necessary to give view to the workers to avoid such
problems.
3. The reports related to the accident has to be prepared by looking on the scene.
4. To know the cause of the incident, it is necessary to know who is behind the cause of
incident.
5. To arrest the person who is behind the fault of this accident.
6. To avoid accidents and to mitigate the risk in future.
7. To run the audit over the area.
These are taken to account while securing the place where accident has occurred.

Question 4 (b)

The supermarket must arrange the training for the employees to minimize the probability of
happening this type of situation again,
Job description
The description of their job must be given, and the worker must know what type of work they are
going to do in the supermarket. They must be fully aware what type of machinery to be used and
what areas they are assigned to work in the supermarket. The information related to the job
description and structure must be conveyed to them during the training.
Induction training
The induction training of the employees must be required to give them whole overview of the
supermarket, they must know everything about the supermarket. First, the training of the job is
given, now the training of the work related to supermarket is given. The whole survey of the
supermarket is given to them and the trained employee is with them to help them and show them
the whole store. The manager pays close attention towards their training to avoid serious
problems.
Emergency response Training
Emergency training must be given to the employees in the supermarket and there must be
availability of first aid box. The employee must know how to provide medical first aid to the
person in need and how to tackle serious situation. The medical camps must be established to
give proper medical training.
Training Competent
The training is provided to the competent employees and their knowledge must be updated about
the supermarket. Their skills have to be improved and new updated knowledge has to be given to
them.

Question 5

The human factors that have negatively influenced the behaviour of injured worker and are the
contributing factors that leads to this accident. Well, there are many factors that shows worker is
not paying heed to the faultiness of the machinery and is careless about it. This leads to the
accident and result in the crashing of the worker`s hand.
Incompetency of the worker
The worker was experienced but he was not competent, there was lack of training, education and
knowledge relating to the operation of the machinery. The worker was not himself competent
enough to deal with the machinery and lacks the prior knowledge to operate the machinery.
No supervision
The worker has been working in the market and is well-aware of the situation that machinery is
not working properly. He also knows that there is no supervision related to the machinery and
manager do not pay heed and there is no training provided related to the working of the
machinery.
Attitude of the Manager
The attitude of the manager towards the seriousness of the problem is not good and he himself do
not care about it. He hardly reported it to the authorities and seems do not care about this matter.
The attitude of the manager does not seem apologetic related to the accident.
Take this thing normal.
Workers take things in a normal way; he was well-aware that machine is not working yet he does
not think it as a problem. He was used to work with that machinery and do not think that accident
might take up. He takes things for granted and do not care about the hazardous accident that
might take place in the supermarket.
Management did not give ear to problem.
Management do not give ear to the issue and was busy in their sales. They do not care about the
faulty machine and keep on running the machine despite knowing that it can cause accident to
the people. They urge that if employee would complain, they would cut off their incentives.

Task 6: Showing how the faulty compactor exposed workers to greater risk

Question 6 (a) (i)

The risk level was acceptable when the compactor risk was initially carried down because the
full training is given to the employees and worker, the safety production device related to the
machine is working and tested, the alarm sound is also attaching to the machine. Every time the
machines complete the cycle of product, it gives the alarming sound. The risk assessment is
partially conducted, and a partial information is given to the employees related to the machines
and supermarket. The hazards and risk are informed, it decreases the livelihood and risk was
carried down.

Question 6 (a) (ii)

The risk level was not acceptable when the compactor risk was carried up and reached the red
zone because it is not lead by the authorize or competent person. The person with inadequate
training is running the machinery that leads to the accident. When the machinery breaks down, it
was not shut down instead the worker themselves tries to fix it and keep running. The safety
production device failed, and it was not able to control any type of hazardous situation. The
worker keeps on operating the machine despite of no safety device. The alarm was not working
and there is no proper implementation of knowledge. It leads them in the red zone.

Question 6 (b)
The administrative first come into action and give response about this current accident taken
place due to their negligence. To avoid such situation again in the supermarket, they must
implement rules in the supermarket to avoid the accidents.
Training
The administrative must provide training to the worker on continuous basis and keeps on
updating their knowledge.
Additional supervision
Additional supervision is provided to the worker and a manager strictly pay attention on the
working of the workers and cooperate work with them in solving their problem.
Safety production device
The administrative install the safety production device in the supermarket to run the machine
with safety equipped measures. The safety device ensures the safety when running the machine.
Induction View to Workers
The induction training of the employees must be given to the employees to give them whole
overview of the supermarket, they must know everything about the supermarket. First, the
training of the job is given, now the training of the work related to supermarket is given. The
administrative must ensure the induction training of the employees. The whole survey of the
supermarket is given to them and the trained employee is with them to help them and show them
the whole store.
Emergency response Training
Administrative must pay keen attention towards the first aid and emergency training of
employees to avoid hazardous situation. Emergency training must be given to the employees in
the supermarket and there must be availability of first aid box. The employee must know how to
provide medical first aid to the person in need and how to tackle serious situation. The medical
camps must be established by the administration to give proper medical training.
Training Competent
The administrative must give competency training to the employees. The training is provided to
the competent employees and their knowledge must be updated about the supermarket. Their
skills must be improved, and new updated knowledge must be given to them.

Question 7
The financial argument uses to convince store manager to implement the safety and health rules
are,
Stoppage of work
The work has been stopped because there is safety implementation. Due to accident, the work
has stopped, and worker are not willing to work due to no safety measure. It affects the sales of
the business.
High Demand of Product
The supermarket has high demand but due to no safety measures, worker is not willing to work.
This reduces the supply of products and they are not able to meet the demand of the products.
The demand decreases and it also decreases the sales of the company leading to the financial
loss.
Worker compensation
The supermarket must give compensation to the worker for the accident incurred due to the fault
of the supermarket. It now must give wages to the employee, and he is recovering in the hospital
and supermarket tis paying compensation for the accident.
New recruitment of worker
New worker is recruit is replacing of the previous one, the additional cost is charged to carry the
recruitment process. The cost has been increasing because you must pay for the new worker and
side wise you are also paying compensation to the previous worker.
Lawyer Fees
The supermarket must pay lawyer fees to battle the court case related to the accident. This also
adds up further cost and increases the cost of the supermarket.
It is necessary to set the safety and health measures otherwise the supermarket has to pay all
these costs combined.
