MR. BARILOFUL LETURA SUNDAY KPAI of Chief Sunday Kpai
Compound of Gokana Local Government Area of Rivers State (hereinafter
called “the Donor” which expression shall where the context so admits
include his heirs, executors, administrators and assigns) of the one part

AND
KESI PRESENCE OF GOD CHURCH through the Trustee and General
Overseer, PASTOR BARIDON VICTOR BORNWN of Kegbara Dere
Community in Gokana Local Government Area of Rivers State (hereinafter
called “the Donee” which expression shall where the context so admits
include his heirs, executors, administrators and assigns) of the other part.

WHEREAS:
1. The Donor is the absolute beneficial owner in possession of the parcel
of land lying at, known and called “Barabeedom Kpene, Kegbara
Dere” in Gokana Local Government Area of Rivers State.

2. The Donor became seised of the parcel of land by reason of inheritance

from his forebears in accordance Gokana Native Law and Custom free
from all encumbrances whatsoever. Pursuant to the provisions of the
Land Use Act, 1978, the Dodor have continued to hold the said portion
known and called “Barabeedom Kpene, Kegbara Dere” in Gokana
Local Government Area of Rivers State as if a holder of a
statutory/customary right of occupancy granted under the Act.
3. The Donor of the parcel of land herein described is desirous of
conveying the said parcel of land to the Donee by way of outright gift.
4. The Donee has accepted the gift and is desirous of building a Church
auditorium and other accompanying property on the said parcel of land
for the exclusive use of Christian religious worship and for the use of
members of the Church, Kegbara Dere Community or sister churches.
NOW THIS DEED WITNESSES AS FOLLOWS:
In consideration and appreciation of the contributions of the Donee towards
the worship and service of God, the Donor hereby conveys unto the Donee
all that parcel of land lying and situate at “Barabeedom Kpene, Kegbara
Dere” in Gokana Local Government Area of Rivers State, measuring
approximately three plots of Land, TO HOLD the same unto the Donee as
the beneficial owner free from all encumbrances customary or otherwise.

THE VENDORS HEREBY COVENANT WITH THE PURCHASERS AS

FOLLOWS:

1. That the vendor has not previously given any conveyance, assignment
or assent in respect of property herein before described and conveyed
any part therefore to any person or group of persons.
2. That the purchaser shall be entitled to immediate, quiet and
undisturbed possession of the said land.

3. That the land is free from all charges, encumbrances, claim and
demand under customary law or otherwise.
4. That this agreement now concludes the final, absolute and outright gift
of the land herein described to the purchaser free from all
encumbrances whatsoever.
5. The Donor covenants for vacant possession and hereby puts the Donee
in full peaceable and exclusive possession of the said land.
