MOUNTAIN DEW TROPA POWER UP PROMO

 
MOUNTAIN DEW TROPA POWER UP PROMO (“Promo”) is organized by Pepsi-Cola Products Philippines Inc.
(“Organizer”). By participating in this Promo, participants represent and confirm they are qualified to participate and
further acknowledge that they have read, understood, and unconditionally agree to comply with and abide by these
Terms and Conditions. The decisions of the Organizer for all matters relating to the Promo shall be final and binding in
all respects.
 
1. Contest period:
The Promo begins 1 MAY 2022 at 12:00 A.M. and ends on 15 JULY 2022, 11:59 P.M. (Philippine Standard
Time)(“Promo Period”). The Organizer’s computer will be the official clock of the Promo. Any entries
received before or after will not be valid and will not be entertained into this Promo.

2. Who are qualified to join:

a. The Promo is open to all legal residents of the Philippines, and who are at least eighteen (18) years old
at the time of entry in the Promo (“Participants”).
b. The Promo is NOT open to all employees and relatives up to the second degree of consanguinity or
affinity of the Organizer, Pepsi Partners: EDS and Distributors, BBDO Guerrero Inc., Mindshare
Philippines, Pillar Digital E-commerce, and their respective subsidiaries and suppliers.
c. Participants shall be responsible in ensuring their eligibility to participate in the Promo.
d. Participants must possess or shall have legal access to an electronic device (e.g. a smartphone, tablet,
Laptop, or Computer) compatible with the Android/iOS operating systems. Participants shall also be
connected to the internet at all times while using the Website/App in order to be eligible for
participation in this Promo.
e. The Organizer will not be responsible for internet and/or data charges incurred by joining this
Promo. Participants must check with their respective provider.
f. The Organizer believes in responsible consumption of their products. Please do not purchase more
products than you can reasonably use or consume just to participate in this Promo.

3. How to join the promo:

a. STEP 1: Buy any of the following products from any retail outlets with specially marked PET bottles,
collectively referred to as “Participating Products”. Mountain Dew: 295mL, 600mL, 850mL, 1L,
1.25L, 1.5L, and 2L. Each bottle carries Mobile Legends: Bang Bang (“MLBB”) or Call of Duty
Mobile (“CODM”) label designs, collectively referred to as (“Gaming Title”).
b. STEP 2: Peel the label to find the 8-character unique alphanumeric code (“Promo Code”). Keep
promo label as proof of purchase as this will be required if a prize is won, for validation and in order
for the winners to receive their prize.
c. STEP 3: Visit www.dewpowerup.com (“Promo Website”) and register. A participant must register
once with their name, mobile number and email address. A One-Time-PIN (OTP) will be sent to the
mobile number indicated to bind it to the promo system. A mobile number and email can be
registered to one person only.
d. STEP 4: After a successful registration, participants may now submit promo codes for a chance to
win prizes.
e. STEP 5: For every unique Promo Code submitted, Participants will be prompted to choose a Gaming
Title as marked on the bottle purchased. He/she will automatically earn one raffle entry and a chance
to win an in-game reward based on the Gaming Title selected. Refer to list of available in-game
rewards in respect of each Gaming Title in section 4 below. In-game rewards based on MLBB is
referred to as “MLBB In-Game Rewards” and In-game rewards based on CODM is referred to as
“CODM In-Game Rewards”. “In-Game Rewards” means both MLBB In-Game Rewards and
CODM In-Game Rewards. For list of prizes to be won in respect of the Raffle (“Raffle Prizes”),
please refer to section 5 below.
f. For subsequent entries, Participant will only need to sign in using the registered mobile number.
g. Each unique Promo Code is equivalent to one raffle entry. The more Promo Codes sent, the higher
chances of winning either In-Game Rewards or Raffle Prizes.
4. How to earn a raffle entry and redeem in-game rewards:
a. Once logged in to the Promo Website, Participant must enter the Promo Code on the field provided,
and confirm the captcha as security check and then click submit. Once successfully submitted,
Participant must choose the Gaming Title as marked on the bottle purchased. , Participant will
automatically earn one (1) raffle entry and a chance to win one (1) in-game reward instantly based on
the Gaming Title selected. For In-game Reward winners (“In-Game Reward Winners”), depending on
the Gaming Title selected, a fourteen (14) character unique alphanumeric redemption code for
CODM (“CODM Redemption Code”) to redeem one (1) CODM In-Game Reward or a seventeen
(17) character unique alphanumeric redemption code for MLBB (“MLBB Redemption Code”) to
redeem one (1) MLBB In-Game Reward will be provided and the following steps must be followed to
redeem either the CODM In-Game Reward or the MLBB In-Game Reward.
b. For CODM:
i. In-Game Reward Winner must have access to the internet, be able to download the game
title CALL OF DUTY MOBILE on his/her smartphone/tablet, which is available free of
cost on the Android (Google Play) / iOS (AppStore) platform. Once the App is downloaded
and installed on the In-Game Reward Winner’s smartphone/tablet, he/she shall register
himself/herself as per the self-guided process available on starting the App. The Organizer
will not be responsible for any data/internet charges.
ii. In-Game Reward Winner will be redirected to a page showing the instructions on how the
in-game items can be redeemed.
iii. In-Game Reward Winner needs to follow the steps as stated:
1. Open the CODM app on mobile or tablet device.
2. On the home screen go to “events” and click “featured”.
3. On featured, Click “redemption center”.
4. On the redemption center, type in the (14) character unique alphanumeric CODM
redemption code.
5. Check your CODM app’s inbox and click “claim”.
iv. One (1) CODM In-game Reward comprises one (1) crate containing any one (1) of
the in-game items from the list below, distributed to the In-Game Reward Winner on a
random basis. Such in-game item will be added to the user’s CALL OF DUTY MOBILE in-
game inbox. Each such in-game item may vary in validity and can only be won once. In the
event that an In-Game Reward Winner wins the same in-game item in succeeding entries,
this will be automatically converted to in-game credits/coins.

c. For MLBB:
i. In-Game Reward Winner must have access to the internet, be able to download the game
titled MOBILE LEGENDS:BANG BANG on his/her smartphone/tablet, which is
available free of cost on the Android (Google Play) / iOS (AppStore) platform. Once the
App is downloaded and installed on the In-Game Reward Winner’s smartphone/tablet,
he/she shall register himself/herself as per the self-guided process available on starting the
App. The Organizer will not be responsible for any data/internet charges.
ii. In-Game Reward Winner will be redirected to a page showing the instructions on how the
in-game items can be redeemed.
iii. In-Game Reward Winner needs to follow the steps as stated:
1. Open the MLBB website, www.mobilelegends.com
2. On the home screen go to “more” and click “redeem”.
3. Enter the seventeen (17) character unique alphanumeric MLBB redemption code
and your MLBB account gaming ID, then click “send”. A verification code will be
sent to the your in-game mailbox (valid for 30 minutes).
 4. Return to the website, input the verification code, then click “Redeem”.
5. Check your MLBB’s in-game mailbox and click “claim”.
iv. One (1) MLBB In-Game Reward comprises five (5) MLBB Diamonds. These will
be added to the user’s MOBILE LEGENDS:BANG BANG in-game mailbox. These items
may have different validity.

d. Not all Participating Products are eligible to receive In-Game Rewards. The In-Game Rewards are
distributed randomly. But, all Participating Products can earn a Participant (1) one raffle entry.
e. Redemption Code per gaming title varies in character length and can only be used in its respective
redemption page.
f. Each unique CODM Redemption Code and MLBB Redemption Code can only be redeemed once
during the entire Promo Period.
g. It is clarified that the In-Game Rewards are only in-game merchandize and not physical in form.
h. The In-Game Rewards are personal to the Participant and are not transferrable and cannot be sold
under any circumstances.
i. No cash payment will be made in lieu of the In-Game Rewards.

5. How to win the raffle:

a. A lucky draw through automatic software will determine the winners of the raffle (“Raffle Winners”).
There are Daily Prizes, which will be drawn on a daily basis during the entire Promo Period (76 days),
and there are Grand Prizes (together with Daily Prizes, the “Raffle Prizes”), which will be drawn on
the last day of the Promo Period.
b. A Participant can win a maximum of one daily prize and one grand prize throughout the Promo
Period. There are no limits on the CODM/MLBB In-Game Rewards, participant may redeem as
much as they can.
c. Except for Dew Merch (one of the Daily Prizes) and the Silver Package (one of the Grand Prizes),
five (5) back-up Raffle Winners will be drawn in case the original Raffle Winner is non-responsive or
fails the verification.
d. If the Raffle Winner does not respond within 7 days of initial contact, the Organizer will proceed with
the back-up Raffle Winner (in the order of who gets drawn first). In the event that all the back-up
Raffle Winners do not respond within 7 days of initial contact, the relevant Raffle Prize will be
forfeited, the Organizer reserves the right to forfeit the prize.

 f. All Raffle Prizes will be allocated at random. Raffle Winners will not have a choice of which Prize
they win.
g. All Raffle Prizes are tax-free, non-transferrable and non-convertible to cash. The picture of the prizes
depicted on the press ads/posters/ digital materials etc. are only representative and actual Raffle
Prizes may vary from depictions.
h. One valid unique Promo Code is equivalent to one raffle entry. All accumulated entries collected
throughout the Contest Period will be eligible for the Daily Prize and Grand Prize draws.
i. A Raffle Winner can only win Snk Attack Merch and the Pro-team virtual meet ‘n greet specific to the
Gaming Title on their bottle label design. Winning label must be provided to the Organizer as part of
the verification process. Failure to submit the winning label will result to disqualification.
j. All potential Raffle Winners will be announced daily on the Mountain Dew Philippines Facebook
page. Each must go through verification process to be conducted by the fulfillment agency and must
submit requested requirements before he/she can be awarded the relevant Raffle Prize.
k. All decisions made by the Organizer in concurrence with the FDA shall be final.

8. Verification of Raffle Winners:

a. Potential Raffle Winners will be notified via phone call and email by an authorized representative
within 7 working days from the announcement date directing them to provide their verification
requirements within 7 days of initial contact. In the event that a potential Raffle Winner does not
respond to the initial contact within 7 days, the Organizer reserves the right to disqualify that Raffle
Winner. If a Raffle Winner is disqualified, the Organizer reserves the right to call the next back-up
Raffle Winner. In the event that all the back-up Raffle Winners do not respond within 7 days of
initial contact, the relevant Raffle Prize is forfeited, although the Organizer also reserves the right not
to forfeit the relevant Raffle Prize.
b. Potential Raffle Winners will be asked to send a clear image of the winning Promo label showing the
8-digit alphanumeric code used to enter the Promo and submit one (1) valid government ID as part of
the verification process.
c. Details submitted by the Raffle Winner will be validated by a representative of the Organizers.
d. The Organizer reserves the right, at any time, to verify the validity of entries and participants
(including an participant’s identity, age, place of residence and social media presence) and reserves the
right, in its sole discretion, to disqualify any individual who the Organizer has reason to believe has
breached any of these Terms and Conditions, tampered with the entry process, engaged in any
unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the
Promo. Errors and omissions may be accepted at the Organizer's sole discretion. Failure by Organizer
to enforce any of its rights at any stage does not constitute a waiver of those rights.
e. Participants must complete their details using their legal name. Organizer reserves the right to
disqualify any participant who uses multiple names or email addresses and to require them to return
any Raffle Prize they may have won. Organizer will verify the eligibility of participants. Organizer
will require such information as it considers reasonably necessary for this purpose and the relevant
Raffle Prize may be withheld unless and until the Organizer is satisfied with the verification.

9. Prize fulfillment for Physical Raffle Prizes like Merch, Mobile Phone, Laptop, and Pro-Team Jersey:
a. The Merch, Mobile Phone, Laptop, and Pro-Team Jersey will be couriered directly to the Raffle
Winners upon complete verification.
b. The Organizer will endeavor to fulfil the delivery of the physical Raffle Prizes within 60 days after
the close of the Promo Period. Raffle Winners will be communicated with via email, and or his/her
mobile number, as soon as a delivery date can be confirmed, and asked for their delivery address for
their physical Raffle Prize. If for any reason the physical Raffle Prize cannot be fulfilled within this
timeframe, the Organizer will contact the Raffle Winners who will be given the choice of either
waiting for their Raffle Prize that they originally won or accepting a specified alternative Raffle Prize
which will be of equal value.
 c. All other Prizes will be fulfilled within 60 days after the close of the Promo Period. In the unlikely
event that a winner of any other Raffle Winner doesn’t receive his/her Raffle Prize within 60 days
after the close of the Promo Period, the Raffle Winner will have a further 30 days to inform the
Organizer by emailing support@dewpowerup.com. In the event that the Raffle Winner does not
inform the Organizer within this time frame, the Organizer will reserve the right to forfeit the Raffle
Prize.

10. Mechanics for the Pro-Team Meet ‘n Greet Raffle Winners

a. All verified Raffle Winners will be shared the details of the meet ‘n greet including the following:
i. Location (online)
ii. Schedule
iii. Other precautionary measures and notes
b. Raffle Winners must possess or shall have legal access to an electronic device (e.g. a smartphone,
tablet, Laptop, or Computer). Raffle Winners shall also be connected to the internet at all times during
the virtual meet ‘n greet session.
c. The Organizer will not be responsible for internet and/or data charges incurred by joining this
Promo. Raffle Winners must check with their respective provider.
d. The Schedule of the virtual meet ‘n greet, once announced by the Organizers, are already deemed
final. In the event that the Raffle Winner is unavailable to attend, their prize will be forfeited but can
only claim the exclusive team jersey.
e. No cash payment or any other form of payment will be made in lieu of the Pro-team meet ‘n greet
session.

11. Other conditions:

a. In the event that the Promo is not capable of running as planned for reasons including but not
limited to tampering, unauthorized intervention, fraud, dishonesty, technical failures, or any other
causes beyond the control of the Organizer which corrupt or affect the administration, security,
fairness, integrity or proper conduct of this Promo, the Organizer reserves the right to disqualify any
individual who tampers with the entry process or does not comply with these Terms & Conditions
and to cancel, modify or suspend the Promo or invalidate any affected entries.
b. No responsibility can be taken for entries which are lost, delayed, corrupted, damaged, misdirected
or incomplete or which cannot be delivered for any technical, delivery or other reason. Proof of
sending will not be accepted as proof of receipt. The Organizer does not guarantee continuous or
secure access to the Promo Website.
c. Organizer together with any associated agencies and companies will not be liable for any loss
(including, without limitation, indirect, special or consequential loss or loss of profits), expense or
damage which is suffered or sustained (whether or not arising from any person’s negligence) in
connection with this Promo or accepting or using a Prize, except for any liability which cannot be
excluded by law.
d. An entry must be made directly by the individual entering the Promo via their mobile number and
unique email address. Bulk entries from trade, consumer groups or third parties will not be
accepted. Incomplete or illegible entries and entries submitted by macros or other automated means
together with entries which do not satisfy the requirements of these Terms & Conditions in full will
be disqualified and will be not be counted. If it becomes apparent that an participant is using a
computer(s) to circumvent this condition by, for example, the use of ‘script’, ‘brute force’, masking
their identity by manipulating IP addresses, using identities other than their own or any other
automated means in order to increase that participant’s entries into the Promo in a way that is not
consistent with the rules of the Promo, that participant’s entries will be disqualified and any Prize
awarded will be withdrawn.
e. The Organizer will not be liable for any failure to comply with its obligations or any delay in
performing its obligations within these terms and conditions. If an act, omission, event or
circumstance occurs caused by (but not limited to) global or regional health crises, weather
conditions, fire, flood, strike, hurricane, industrial dispute, war, terrorist activity, hostilities, political
unrest, riots, civil commotion, epidemic, pandemic, famine, plague or other natural calamities and
acts of God, or any other circumstances beyond the reasonable control of the Organizer.
 f. The Organizer may refuse to award a Prize in the event of any participant’s fraud, dishonesty, breach
or non-entitlement under these Terms & Conditions or seek recovery of its value if a Prize has been
awarded.
g. Any and all personal data provided by you in connection with this Promo will be used solely by the
Organizer (or its appointed agents) to: (i) assist with running the Promo; and/or (ii) conduct analytics
to improve the Organizer’s promotions, products or services. The Organizer (or its appointed
agents) will not contact you for reasons other than this Promo unless you have provided your

h. If any provisions of these Terms & Conditions are judged to be invalid, illegal or unenforceable, this
will not affect or impact the continuation in full force and effect the remainder of the provisions.
i. By entering this Promo, you will be deemed to have agreed to be bound by these Terms &
Conditions. In the event of a discrepancy between these Terms & Conditions and the details in any
promotional material, the details in the Terms & Conditions will prevail.

12. By entering the Promo, each participant agrees:

a. To be bound by these Terms & Conditions and by all applicable laws and by the decisions of
Organizer which shall be binding and final;
b. By downloading the App, the Participant agrees to comply with the terms of use of Android/iOS
platform and of the CALL OF DUTY MOBILE and MOBILE LEGENDS:BANG BANG game
owner and developer applicable on such applications available on its platform. The Participants agree
that they will comply with such changed requirements of the App, including but not limited to
updating it, or re-installing it, or playing as per the amended rules of the game, in case he/she is
required to do so to continue their participation in the Promo, as required by the Organizers.
c. To waive any rights to claim ambiguity with respect to these Terms & Conditions.
d. To waive all his or her rights to bring any claim, action or proceeding against any of the Released
Parties in connection with the Promo; and
e. That all personal details submitted by each user must be accurate, complete and are subject to
provision of proof upon request of the Organizer. Any inaccurate or incomplete information found in
a submission will result in disqualification of the user
f. That the Organizer has the sole discretion to disqualify any photograph or screenshot determined by
the Sponsor to be obscene, profane, lewd, defamatory, threatening, harassing, libelous, deceptive,
invasive of another’s privacy, offensive or inappropriate in any manner whatsoever
g. That the Organizer reserve the right to change/ modify terms and conditions and/ or criteria of the
Promo and / or the Prize for the Promo and/ or the duration/ timing of the Promo, at any time at
their own discretion and without any prior notice and without assigning any reason
h. To grant the Organizer irrevocable consent in perpetuity, free of charge, to the use his/ her name,
photographs, video submitted and/or taken during the Prize distribution in connection with the
Promo, in any and all applications including but not limited to advertising, commercials, promotion,
stories, text, articles and commercial exploitation, in any and all media forms, including but not limited
to radio, broadcast and television, newspapers and magazines at any time without the Participants’
further knowledge or consent.
i. To forever and irrevocably agree to release, defend, indemnify and hold harmless each of the Released
Parties from any and all claims, lawsuits, judgments, causes of action, proceedings, demands, fines,
penalties, liability, costs and expenses (including, without limitation, reasonable outside attorneys’
fees) that may arise in connection with:
i. the violation of any third-party privacy, personal, publicity or proprietary rights;
ii. typographical or printing errors in these Official Rules or any Promo materials;
iii. acceptance, attendance at, receipt, travel related to, participation in, delivery of,
possession, defects in, use, nonuse, misuse, inability to use, loss, damage, destruction,
negligence or willful misconduct in connection with the use of a Prize (or any component
thereof);
 iv. any change in the prizing (or any components thereof) due to unavailability or due
to reasons beyond the Released Parties control, including but not limited to by reason of any
acts of God, any action(s), regulation(s), order(s) or request(s) by any governmental or quasi-
governmental entity (whether or not such action(s), regulation(s), order(s) or request(s)
prove(s) to be invalid), equipment failure, threatened or actual terrorist acts, earthquake, war,
fire, flood, explosion, unusually severe weather, hurricane, embargo, labor dispute or strike
(whether legal or illegal), labor or material shortage, transportation interruption of any kind,
work slow-down, civil disturbance, insurrection, riot or any other cause beyond any of the
Released Parties’ control, or as otherwise permitted in these Terms & Conditions Rules;
v. any interruptions in or postponement, cancellation or modification of the Promo;
vi. human error;
vii. incorrect or inaccurate transcription, receipt or transmission of any part of any
entry (including, without limitation, the registration information or any parts thereof);
viii. any technical malfunctions or unavailability of the Page or any telephone network,
computer system, computer online system, mobile device, computer timing and/or dating
mechanism, computer equipment, software, or Internet service provider, or mail service
utilized by any of the Released Parties or by an Participant;
ix. interruption or inability to access the Promo, the Page or any other Promo-related
websites or any online service via the Internet due to hardware or software compatibility
problems;
x. any damage to participant’s (or any third person’s) equipment used to access the Promo
and/or its contents related to or resulting from any part of the Promo;
xi. any lost/delayed data transmissions, omissions, interruptions, defects, and/or any
other errors or malfunctions;
xii. any late, lost, stolen, mutilated, misdirected, delayed, garbled, corrupted, destroyed,
incomplete, undeliverable or damaged entries;
xiii. any wrongful, negligent, or unauthorized act or omission on the part of any of the
Released Parties;
xiv. lost, late, stolen, misdirected, damaged or destroyed prizing (or any element
thereof);
xv. the negligence or willful misconduct by Participant; and/or
xvi. violation on any rule, regulation, law announced by the Department of Health and
Covid-19 Inter Agency Task Force regarding Covid-19 prevention and safety.
j. Warranty: Without limiting the foregoing, everything regarding this Promo, including the Page and a
Promo Prize and/or all Prize component(s), are provided “as is” without warranty of any kind, either
express or implied, including but not limited to the implied warranties of merchantability, fitness for a
purpose or non-infringement.

13. DISPUTES: Except where prohibited, participants agree that: a) any and all disputes, claims and causes of
action arising out of or connected with this Promo or any Prize awarded shall be resolved individually,
without resort to any form of class action; b) any and all claims, judgments and awards shall be limited to
actual out-of-pocket costs incurred, including costs associated with entering this Promo, but in no event
attorneys’ fees; and c) under no circumstances will participant be permitted to obtain awards for, and
participant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and
any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages
multiplied or otherwise increased. Participants agree that the statute of limitations for asserting any claims
shall be a period of one (1) year from the time the cause of action accrued, or the cause of action shall be
forever barred.

14. PRIVACY POLICY: Any personally identifiable information collected during an participant’s participation in
 the Promo will be collected by the Organizer or its designee and used by Organizer’s, its affiliates, designees,
agents and marketers for purposes of the proper administration and fulfillment of Promo as described in these
Terms & Conditions and in accordance with the Privacy Policy as stated at www.dewpowerup.com .

15. WINNER WAIVER OF CLAIMS: By accepting a Promo Prize, a winner agrees to voluntarily waive,
release and relinquish any and all claims, damages, losses, expenses, remedies, demands, debts, obligations,
causes of action and/or claims for relief (collectively “Claims”) that a winner may have against the Released
Parties and agrees to discharge, to indemnify and hold harmless the Released Parties from all Claims arising
out of or relating to the Promo and/or a Promo Prize, including but not limited to Claims for bodily injury,
personal injury, emotional distress, property damage, or death and/or dismemberment (collectively
“Damages”) occurring to a winner or others. In addition, by accepting a Prize, a winner agrees to be
responsible to research the details about a Prize including any inherent dangers associated with a Prize and as
a result agrees to accept personal responsibility for any such dangers and any resulting Damages.

CAUTION AND WARNING: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE, THE PAGE,
OR TO UNDERMINE THE LEGITIMATE OPERATION OF THIS PROMO IS A VIOLATION OF
CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES
THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON(S) RESPONSIBLE
FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW. In the event of any conflict with any
Promo details contained in these Official Rules and Promo details contained in any Promo promotional
materials/notifications, the details of the Promo as set forth in these Terms & Conditions shall prevail. The Terms are
governed by the laws of the Philippines. Any dispute shall be subject to the jurisdiction of the Courts in the Philippines
