DEED OF DONATION AND ACCEPTANCE

KNOW ALL MEN BY THESE PRESENTS:

THIS DEED OF DONATION and ACCEPTANCE (the

“Deed”) is made and executed by and between:

and a resident of Kabacsanan, Iligan City, hereinafter
CELSO G. REGENCIA

referred to as “DONOR”;

The CITY OF ILIGAN, a local government unit

duly created by law with office address at Buhanginan
Hill, Pala-o, Iligan City, herein represented by CELSO
G. REGENCIA, in his capacity as a duly elected City
Mayor, as authorized by the Sangguniang Panlungsod

through Resolution No. _________ (Annex “A”),
hereinafter referred to as “DONEE”;

-WITNESSETH-

WHEREAS, the DONOR is the owner of a certain parcel of

land located at Kabacsanan, Iligan City with total area consisting of
Six Thousand Six Hundred Seventeen (6, 617) square meters covered
by Katibayan ng Orihinal na Titulo Blg. CARP2015000184 of the
Register of Deeds (ROD) of Iligan City;

WHEREAS, the DONOR desires to assist the DONEE by

donating a portion of the land for the construction of a Day Care
Center in Barangay Kabacsanan, Iligan City;

NOW THEREFORE, with the foregoing premises, parties

hereto forged the herein Deed of Donation as follows:

THAT for and consideration of a desire to contribute said

parcel of land for the construction of Day Care Center at Barangay
Kabacsanan, Iligan City subject to the abovementioned condition
which the DONEE inspires in the DONOR, and as an act of liberality
and generosity, the DONOR hereby voluntarily and freely transfers
and conveys, by way of donation to the DONEE, his successors and
assigns, all the rights, title and interest of a portion thereof
consisting of Two Thousand Eight Hundred (2, 800) SQUARE
METERS as indicated in the Approved Subdivision Plan of Land (A
COPY IS ATTACHED HEREWITH AS ANNEX “B”) which said

the buildings and improvements found therein, free from all liens,

encumbrances;

THAT THE DONEE hereby accepts said donation of the above

described parcel of land and does hereby express gratitude for the
support and kindness of the DONOR that the said lot portion
consisting of 2, 800 sq.m. shall be exclusively utilized for the said
project;

THAT THE DONOR represents and warrants to the DONEE

that it has the power and authority to execute and deliver this Deed
and to perform all the terms and conditions hereof. And, that the

DONOR has the legal right to make this donation of said property
being to free portion under the New Civil Code and other existing
laws, which he can freely dispose of;

THAT THE DONEE shall in no case sell, alienate, exchange,

mortgage or in any manner encumber the donated lot to the

government or private entity otherwise, this donation shall be
deemed ipso facto revoked;

THAT THE DONOR undertakes to cause the transfer of the

same to the name of the DONEE;

THAT THIS DEED shall be governed by and interpreted in

accordance with the laws of the Philippines;

THAT IN CASE ANY OF THE PROVISIONS contained

herein shall, for any reason, be held to be invalid, illegal or
unenforceable in any respect, such invalidity, illegality or
unenforceability shall not affect any other provision of this DEED,
and the remaining valid provisions shall be valid and enforceable to
the fullest extent.
