RULES OF SUCCESSION
 Decedent – general term applied to the person whose property is transmitted through
succession
 Succession may be:
Testamentary – made in a will executed in the form prescribed by law
Legal/Intestate – operation of the law; without a will
Mixed – effected party by will and operation of the law
 Heir – a person called to succession either by the provision of will or by operation of
the law
Widowed Spouse – ½ of the inheritance
Legitimate Child – ½ of the inheritance
Illegitimate Child – ½ of the share of the share of the legitimate child

CITIZENSHIP PRINCIPLES:
 Jus-soli/s – the citizenship of a person shall be based on the location where he/she is
born
 Jus-sanguinis – the citizenship of a person shall be based on the nationality/citizenship
of its parents

PROPERTIES OWNED BY SPOUSES


 Paraphernal Property – property of a wife
 Capital Property – property of a husband

TYPES OF EASEMENT
 Dominant Estate – a parcel of land which does not have access to a public road and is
given a right of way easement through an adjoining land
 Servient Estate – a parcel of land that is subject for easement and benefits another
parcel of land

Definition of Terms:
 Patrimonial Property – properties owned by the State
 Judicial Order – a notice given by court upon the request of the spouses to have a
legal separation of property AFTER marriage
