● 1933 Montevideo Inter-American Convention on the Rights and Duties of States
● Qualifications for statehood:
○ Population (least important)
○ Territory
○ Government
○ Capacity to interact w/other states
● When do problems arise in definitions of statehood?
○ Large states break up into smaller ones
○ One part of a state secedes (We no longer are a part of this state; Cataluna)
○ Foreign powers control the state (Cold War; Soviet Union controlled most of areas
declared as “states”)
● Statehood:
○ What are the qualifications for statehood?
○ How can states change?
● Sovereignty
○ What’s happening to the state?
○ Why do we care about failed sovereignty:
■ Criminals (huge trafficking)
■ Conflict can spill over into neighboring states
● Humanitarian Intervention:
○ We should never do it because it’s illegal!
○ We have a moral obligation to do it!
Three Different types of Sovereignty:
● International: Must have territory
● Westephalia: No intervention in other state’s affairs
● Domestic: Authority within state to control activity

● Krasner Reading (2004)

○ What is krasner’s overall argument? What problem is he addressing?
■ Krasner states, we have failing states and we need to care about them because
of internal conflicts and impact neighboring states. How do we deal with
failing states with the current restriction on sovereignty. Where states are
failing is due to the failure of the “domestic sovereign) Should we or do we
have responsibility to do something about this?

■ Shared Sovereignty & Trusteeship: Have another state help the failing state
(violation of Westphalian) but not long term, and teaches a failing state to
cope with it’s rough patch. (partnership, official agreement)
■ ex. ) United States help give money aid to West Germany to help it get back on
its feet (how to write a constitution, set up electoral college)
