PART B

QUESTION 1

Pee Sang is a 17-year-old university student who has recently been arrested and charged
under Section 2 of the Undergraduate Act 2020 (fictitious) for his involvement in the activities
of gambling and alcohol use. Pee Sang did not agree that gambling and alcohol use is illegal
and wrong because these acts do not harm another person and it is a voluntary act. The
university believe that such law is morally right in order to discipline the students. Pee Sang is
to be tried soon in the court, and if convicted, the penalty for the offence will be dismissal from
the university and a jail term or a fine.

From the perspective of morality, discuss whether Pee Sang can challenge the validity of
Section 2 of the Undergraduate Act 2020.

QUESTION 2

Amilia is a 17 years old teenager who was raped by a stranger. She discovered that she is
now 3 months pregnant. Amilia and her mother would like to abort the unwanted baby
because this will jeopardize her bright future, as she is a brilliant student who are currently
study at a private college. They went to the hospital to abort the baby. However, the doctor
refused to terminate the pregnancy because it considered as an offence under the law.

Discuss Amilia’s position from the perspective of Naturalist and Positivist schools of thought.
