when he lost control over the risk vehicle, and it first collided into a lamp post before it hit a tree. Incident

Findings & Calculations:
• The path of travel was determined to be in a Westerly direction along REDACTED.
• The impact was found to have occurred 110 meters West from the intersection of
REDACTED and REDACTED.
o Such is a controlled intersection by means of Traffic lights (Robots).

• When factoring in reaction times and stopping distance requirements:
o At the speed limit of 60km/h the vehicle would require 45.56m to successfully stop.
• Reaction 26.67m.
• Braking 18.90m.
▪ At the speed at which the vehicle was travelling of 160km/h it needed
205.49m to successfully stop.
• Reaction 71.11m.
• Braking 134.38m.
▪ An additional 44.44m was required for reaction.
▪ An additional 115.49m was required for braking.
▪ When factoring in reaction times and stopping distance requirements, the
speed at which the vehicle travelled would require an additional 159.93m
(minimum) to bring the vehicle to a halt.
• When using more conservative coefficients we see this total
stopping distance climbing to 188m.

• When factoring in acceleration times (from stationary) with the specified vehicle -
o The vehicle requires a minimum distance of:
▪ 146m to accelerate to 100km/h.
▪ 297m to accelerate to 150km/h.
▪ 372m to accelerate to 160km/h.

Comments & Concerns:
• The vehicle was inspected on the REDACTED
• Diagnostic Data Retrieval was performed.
• The data recovered 1 event namely:
o Record 1 Frontal/rear.
• The data obtained was analyzed and successfully linked to the incident by:
o Complete file recorded – Yes
o Ignition cycles between download and event – 2
o Freeze Signal – ON
o Delta-V and Crush Damage sustained to the vehicle.
• The data shows the vehicle travelling at 160 km/h, 1.95 seconds prior to the loss.
• The data shows the driver losing control of the vehicle 1.95 seconds prior to impact.
• The data shows the brakes were not used from 5 seconds prior to impact.
• The maximum prescribed speed limit on South African roads is 120 km/h.
o The driver of the insured vehicle exceeded the speed limit by no less than
100km/h.
o The speed at which the driver of the insured vehicle was travelling was found to be
material to the loss.
• In terms of the NRTA and regulations surrounding such:
o Exceeding the speed limit in an urban/built-up area by more than 30km/h carries
an immediate charge of ‘reckless and negligent driving’.
o Exceeding the speed limit in an outer urban and/or freeway/highway area by
more than 40km/h carries an immediate charge of ‘reckless and negligent
driving’.
• Due to the speed at which the driver of the insured vehicle travelled he/she had
insufficient distance to react or bring the vehicle to a halt to avoid the incident.
o The incident could have been prevented had the incident driver travelled within
the prescribed speed limit of the road.

During the inspection, the following were noted as findings.

• Vehicle was in road worthy condition prior to loss.


• The damage to the vehicle is consistent with the description in the claim form.
• Liquid coolant level was empty.
• The brake fluid reservoir was found to be empty.
o Brakes not functional – such was due to extensive damage.
• The vehicle sustained severe all-round damage.
• Wood debris found in the damaged areas of the vehicle.

Conclusion:
Based on the above, the speed at which the vehicle travelled prior to loss was proven to be
material to the loss.
