QUESTION 1
In interpreting statutes, courts are guided by various rules of interpretation. With reference to
decided cases, explain the common law rules of statutory interpretation and analyse the
strengths and weaknesses of these rule.

QUESTION 2
Letchumi and Maniam have been married for 20 years and live in Kulai, Johore with their two
children, Preety aged 22 and Selvam aged 17. Two years ago, while attending a seminar in
Ipoh, Maniam met Shanty and they fell in love. They have been having an affair since.
Letchumi came to know about her husband’s affair. She was sad and furious, and decided to
leave the house.
Preety is a part time model and currently studying at a private college in Petaling Jaya,
Selangor. She met her childhood boyfriend, Aaron, who works at a company near the college.
They have been living together for one year. Recently, Preety has been hearing rumors that
Aaron has been dating a new girl at his office. Fearing that Aaron may leave her, Preety has
been pestering Aaron to marry her for the last two weeks. Two days ago, while they were
preparing for dinner, both of them got into an argument when Preety began to paster Aaron
into marriage. Aaron was very annoyed and in a heated argument, he lost control, stabbed
her with a knife causing her serious injuries.
Last week, Selvam was caught by Ah Meng for stealing an Apple AirPods at his shop. Ah
Meng handed him over to a police officer.
a) Letchumi wants to apply for a divorce. Identify the court which has the jurisdiction to hear
the application. Explain the composition and the original jurisdiction of the court.

b) Preety wants to bring Aaron to justice for causing her grievious hurt. The police
has classified the case under section 326 of the Penal Code for voluntarily causing
grievious hurt by dangerous weapons or means. This offence is punishable with
imprisonment for a term which may extend to twenty years and fine or whipping.
Which court has the jurisdiction to hear the case? Explain the jurisdiction of the court.

c) Selvam was subsequently charged for theft. Explain the composition and jurisdiction of the
court that will hear Selvam’s case. Discuss the special features of the court that distinguish
it from other courts.
