ICAO- International Civil Aviation Organization


The International Civil Aviation Organization (ICAO) is a UN specialized agency, established by
52 States in 1944 to manage the administration and governance of the Convention on
International Civil Aviation (Chicago Convention).

• Chicago Convention 1994: Established the core principles permitting international


transport by air and led to the creation of ICAO.

• Tokyo Convention 1963: Applicable to offences against penal law and to any acts
jeopardizing the safety of persons or property on board civilian aircraft while in-flight.

• Hague Convention 1970: Is a multilateral treaty by which states agree to prohibit and
punish aircraft hijacking.

• Montreal Convention 1971: Is a multilateral treaty by which states agree to prohibit and
punish behaviour which may threaten the safety of civil aviation (Acts of sabotage).

Applicability (Part 2)
• Annex 6 (Part 2) is applicable to International
General Aviation operations with aeroplanes.

– It specifically excludes aerial work activities.

• General Aviation: An aircraft operation other


than a commercial air transport operation or an

• Aerial Work: An aircraft operation in which an


aircraft is used for specialized services e.g.
agriculture, construction, photography,
observation and patrol, SAR, aerial
advertisement, etc.

Alternate AD, Take-off Alternate


• Alternate Aerodrome:

An aerodrome to which an aircraft may proceed when it becomes either impossible


or inadvisable to proceed to or to land at the aerodrome of intended landing.

• Take off Alternate:

An alternate aerodrome at which an aircraft can land should this become necessary
shortly after take-off and it is not possible to use the aerodrome of departure.

En-Route, Destination Alternate


• En-route Alternate: En-route alternate is an aerodrome to which an aeroplane
can safely proceed and land while flying en-route, considering weather and
aerodrome conditions after experiencing a deviation from planned conditions, an
abnormal or emergency condition.

• Destination Alternate: Alternate to be used when unadvisable to land at the


destination.

ETOPS En-Route Alternate


ETOPS En-route Alternate: An alternate aerodrome at which an aeroplane would be
able to land after experiencing an engine shutdown or other abnormal or emergency
condition while in an ETOPS operation.

Flight time - Aeroplanes: The total time from the moment an aeroplane first moves
for the purpose of taking off until the moment it finally comes to rest on the
designated parking position and all engines or propellers are shut down.

Operational Control, Maintenance Release


Operational Control: The exercise of authority over the initiation, continuation,
diversion or termination of a flight in the interest of the safety of the aircraft and the
regularity and efficiency of the flight.

Maintenance Release: A document which contains a certification that the


maintenance work has been completed, either in accordance with the approved data
and the procedures described in the maintenance organization’s procedures manual
or under an equivalent system.

Maintenance Release
• A maintenance release shall be completed and signed to certify that the
maintenance work was performed. It shall contain a certification including:
– Basic details of the maintenance actions carried out;
– The date such maintenance was completed;
– When applicable, the identity of the approved maintenance organization;

– The identity of the person or persons signing the release.

Compliance
• All operator employees when abroad must know that they must comply with the
laws, regulations and procedures of the states they are in.

• Pilots must be familiar with the laws, regulations and procedures, pertinent to
the performance of their duties, prescribed for the areas to be traversed, the
aerodromes to be used and the air navigation facilities relating there to.

Violation of Local Regulations


• If an emergency requires violation of local regulations in the interest of safety,
the PIC shall notify the local authority without delay.

• If required by that state, the PIC shall submit an incident report that shall also be
submitted to the state of the operator.

• Such reports shall be submitted ASAP and normally within 10 days.

Safety and Documents Programme


• States shall establish a safety programme in order to achieve an acceptable level
of safety in the operation of aircraft.

– The acceptable level of safety to be achieved shall be established by the


State(s) concerned.

• An operator shall establish a flight safety documents system, for the use and
guidance of operational personnel, as part of its safety management system.

OPS Applicability
• [Air Operations] Operators shall only operate an aircraft for the purpose of
commercial air transport (hereinafter ‘CAT’) operations as specified in Annexes III
(Organization Requirements for Air Operations) and IV (Commercial Air Transport
Operations).

[Air Operations] CAT operators shall comply with the relevant provisions of Annex V
(Specific Approvals) when operating aeroplanes used for:

– Operations using Performance-based Navigation (PBN);

– Minimum navigation performance specifications (MNPS) Operations;

– Operations in airspace with Reduced Vertical Separation Minima (RVSM);

– Low Visibility Operations (LVO);

– The transport of Dangerous Goods (DG);

– Extended Range Operations (ETOPS) in CAT operations.

OPS Applicability
[Subject Matter and Scope] This Regulation lays down detailed rules for:

1) Air transport operations with aeroplanes and helicopters, including ramp


inspections of aircraft of operators under the safety oversight of another State
when landed at aerodromes located in the territory subject to the provisions of
the Treaty.

2) Issuing, maintaining, amending, limiting, suspending or revoking the certificates


of operators of aircraft engaged in CAT operations, the privileges and
responsibilities of the holders of certificates as well as conditions under which
operations shall be prohibited, limited or subject to certain conditions in the
interest of safety.

OPS Applicability
• [ORO.GEN.005 Scope] - This Annex establishes requirements to be followed by an
air operator conducting commercial air transport operations.

• [CAT.GEN.100 Competent Authority] - The competent authority shall be the


authority designated by the Member State in which the operator has its principal
place of business.

(EC) No 216/2008 - Scope


1. This regulation shall apply to:

a) The design, production, maintenance and operation of aeronautical products,


parts and appliances, as well as personnel and organisations involved in the
design, production and maintenance of such products, parts and appliances;

b) Personnel and organisations involved in the operation of aircraft.

2. This Regulation shall not apply when products, parts, appliances, personnel and
organizations referred to in paragraph 1 are engaged in military, customs, police, or
similar services.

[ORO.GEN.105] Competent Authority

• For the purpose of this Annex, the competent authority exercising oversight over
operators subject to a certification obligation shall be for operators having their
principal place of business in a Member State, the authority designated by that
Member State.

[ORO.GEN.110] Operator Responsibilities

a) The operator is responsible for the operation of the aircraft in accordance with
Annex IV (Essential requirements for air operations) to Regulation (EC) No.
216/2008, the relevant requirements of this Annex and its certificate;

b) Every flight shall be conducted in accordance with the provisions of the


Operations Manual;

c) The operator shall establish and maintain a system for exercising operational
control over any flight operated under the terms of its certificate;

[ORO.GEN.110] Operator responsibilities

d) The operator shall ensure that its aircraft are equipped, and its crews are
qualified as required for the area and type of operation;

e) The operator shall ensure that all personnel assigned to, or directly involved in,
ground and flight operations are properly instructed, have demonstrated their
abilities in their particular duties and are aware of their responsibilities and the
relationship of such duties to the operation as a whole.

[ORO.GEN.110] Operator responsibilities

f) The operator shall establish procedures and instructions for the safe operation of
each aircraft type, containing ground staff and crew member duties and
responsibilities for all types of operation on the ground and in flight. These
procedures shall not require crew members to perform any activities during
critical phases of flight other than those required for the safe operation of the
aircraft.

g) The operator shall ensure that all personnel are made aware that they shall
comply with the laws, regulations and procedures of those States in which
operations are conducted and that are pertinent to the performance of their
duties.

[ORO.GEN.110] Operator responsibilities

h) The operator shall establish a checklist system for each aircraft type to be used
by crew members in all phases of flight under normal, abnormal and emergency
conditions to ensure that the operating procedures in the operations manual are
followed. The design and utilisation of checklists shall observe human factors
principles and consider the latest relevant documentation from the aircraft
manufacturer.

[ORO.GEN.110] Operator responsibilities

i) The operator shall specify flight planning procedures to provide for the safe
conduct of the flight based on considerations of aircraft performance, other
operating limitations and relevant expected conditions on the route to be
followed and at the aerodromes or operating sites concerned. These procedures
shall be included in the operations manual.

j) The operator shall establish and maintain dangerous goods training programmes
for personnel as required by the technical instructions which shall be subject to
review and approval by the competent authority. Training programmes shall be
commensurate with the responsibilities of personnel.

Management System
[ORO.GEN.200] The operator shall establish, implement and maintain a
management system that is appropriate to the size of the operator and complexity of
its operations. It shall include:

1) Clearly defined lines of responsibility and accountability throughout the


operator, including a direct safety accountability of the accountable manager;

2) A description of the overall philosophies and principles of the operator with


regard to safety, referred to as the safety policy;

3) The identification of aviation safety hazards entailed by the activities of the


operator, their evaluation and the management of associated risks, including
taking actions to mitigate the risk and verify their effectiveness;

4) Maintaining personnel trained and competent to perform their tasks;

5) Documentation of all management system key processes, including a process for


making personnel aware of their responsibilities and the procedure for amending
this documentation

6) A function to monitor compliance of the operator with the relevant


requirements. Compliance monitoring shall include a feedback system of findings
to the accountable manager to ensure effective implementation of corrective
actions as necessary; and

7) Any additional requirements that are prescribed in the relevant Subparts of this
Annex or other applicable Annexes.

Contracted Activities
[ORO.GEN.205]

Contracted activities include all activities within the operator’s scope of approval
that are performed by another organisation either itself certified to carry out such
activity or if not certified, working under the operator’s approval.

The operator shall ensure that when contracting or purchasing any part of its activity,
the contracted or purchased service or product conforms to the applicable
requirements.

The contracting organisation shall ensure that the competent authority is given
access to the contracted organisation, to determine continued compliance with the
applicable requirements.

Record-keeping
[ORO.GEN.220] Record-keeping

a) The operator shall establish a system of record-keeping that allows adequate


storage and reliable traceability of all activities developed, covering in particular
all the elements indicated in ORO.GEN.200;

b) The format of the records shall be specified in the operator’s procedures;

c) Records shall be stored in a manner that ensures protection from damage,


alteration and theft.

[ORO.AOC.130] Flight Data Monitoring – aeroplanes

a) The operator shall establish and maintain a flight data monitoring system, which
shall be integrated in its management system, for aeroplanes with a maximum
certificated take-off mass of more than 27 000 kg;

b) The flight data monitoring system shall be non-punitive and contain adequate
safeguards to protect the source(s) of the data.

Carriage of Persons
[CAT.GEN.MPA.165] The operator shall take all measures to ensure that no person is
in any part of an aircraft in flight that is not designed for the accommodation of
persons unless temporary access has been granted by the commander:

a) For the purpose of taking action necessary for the safety of the aircraft or of any
person, animal or goods therein; or

b) To a part of the aircraft in which cargo or supplies are carried, being a part that is
designed to enable a person to have access thereto while the aircraft is in flight.

[CAT.GEN.MPA.140] Portable Electronic Devices

The operator shall not permit any person to use a portable electronic device (PED)
on board an aircraft that could adversely affect the performance of the aircraft’s
systems and equipment, and shall take all reasonable measures to prevent such use.

The operator shall take all reasonable measures to ensure that no person enters or is
in an aircraft when under the influence of alcohol or drugs to the extent that the
safety of the aircraft or its occupants is likely to be endangered.

[CAT.GEN.MPA.175] Endangering Safety

The operator shall take all reasonable measures to ensure that no person recklessly
or negligently acts or omits to act so as to:

a) Endanger an aircraft or person therein; or

b) Cause or permit an aircraft to endanger any person or property.

carried on each flight, as originals or copies unless otherwise specified:

1) The Aircraft Flight Manual (AFM), or equivalent document(s);

2) The original Certificate of Registration;

3) The original Certificate of Airworthiness (CofA);

4) The noise certificate, including an English translation, where one has been
provided by the authority responsible for issuing the noise certificate;

5) A certified true copy of the Air Operator Certificate (AOC);

aerodrome or operating site instead:

• Noise certificate; Aircraft Radio Licence; Journey Log, or equivalent; Aircraft


Technical Log; NOTAMs and AIS briefing documentation; meteorological
information; notification of SCPs and special loads, if applicable; and Mass and
Balance documentation.

Information Retained on Ground


[CAT.GEN.MPA.185]

The operator shall ensure that at least for the duration of each flight or series of
flights:

1) Information relevant to the flight and appropriate for the type of operation is
preserved on the ground;

2) The information is retained until it has been duplicated at the place at which it
will be stored; or, if this is impracticable, the same information is carried in a
fireproof container in the aircraft.

1) A copy of the Operational Flight Plan, where appropriate;

2) Copies of the relevant part(s) of the Aircraft Technical Log;

4) Mass and balance documentation if required; and

5) Special loads notification.

[CAT.GEN.MPA.190] The commander shall, within a reasonable time of being
requested to do so by a person authorised by an authority, provide to that person
the documentation required to be carried on board.

[ARO.OPS.100] The competent authority shall issue the air operator certificate (AOC)
when satisfied that the operator has demonstrated compliance with the elements
required in ORO.AOC.100.

Application for an Air Operator Certificate


[ORO.AOC.100] Prior to commencing commercial air operations, the operator shall
apply for and obtain an air operator certificate (AOC) issued by the competent
authority.

The operator shall provide the following information to the competent authority:

1) The official name and business name, address, and mailing address of the
applicant;

2) A description of the proposed operation, including the type(s), and number of


aircraft to be operated;

3) A description of the management system, including organisational structure;

4) The name of the accountable manager;

5) The names of the nominated persons required by ORO.AOC.135(a) together with


their qualifications and experience; and

6) A copy of the Operations Manual required by ORO.MLR.100;

been verified by the applicant and found in compliance with the applicable
requirements.

Personnel Requirements
[ARO.GEN.210]

a) The operator shall appoint an accountable manager, who has the authority for
ensuring that all activities can be financed and carried out in accordance with the
applicable requirements.

b) The accountable manager shall be responsible for establishing and maintaining


an effective management system.

c) A person or group of persons shall be nominated by the operator, with the


responsibility of ensuring that the operator remains in compliance with the
applicable requirements. Such person(s) shall be ultimately responsible to the
accountable manager.

d) The operator shall have sufficient qualified personnel for the planned tasks and
activities to be performed in accordance with the applicable requirements.

e) The operator shall maintain appropriate experience, qualification and training


records to show compliance with point (c).

procedures relevant to the exercise of their duties.
