SCOPE OF OSHA 1994

& statutory authorities.

 Armed forces

OBJECTIVES OF OSHA 1994
1. To secure the safety, health & welfare of persons at work.
2. To protect person (other than person at work) at a workplace against risks.
3. To promote an occupational environment which is adapted to the workers physiological &
psychological needs.
4. To provide means towards a legislative system based on regulations & industry codes of
practice in combination with the provisions of the act.

DUTIES OF EMPLOYERS & SELF-EMPLOYED (SECTION 15)
As far as practicable:
▪Provide & maintain safe plant and system of work.
▪Make arrangement for safe use, operation, handling, storage and transportation
of plant and substances.
▪Provide instruction, information, training and supervision.
▪Provide and maintain safe workplace, means of access and egress from any
place of work.
▪Provide and maintain safe and healthy working environment and adequate
welfare facilities.

DUTIES OF EMPLOYERS & SELF-EMPLOYED (SECTION 16, 17)

Formulate written safety & health policy


▪To conduct undertaking in such manner to ensure other persons may not be
exposed to risks.
▪Provide information to other person on his ways undertaking may affect
their safety and health.

DUTIES OF EMPLOYEES (SECTION 24)
▪Reasonable care for safety & health of himself and others.
▪Cooperate with employer and others.
▪Wear or use at all times any protective equipment.
▪Comply with any instruction on occupational safety & health.
SAFETY & HEALTH ORGANIZATIONS
1. Medical surveillance – section 28
Carried out by occupational health doctors & nurses.
Provide medical surveillance & medical examination.
Should be done:
i. Cases of illness have occurred due to conditions of work.
ii. Use of new process or substance
iii. New employees or employees below 16 years old
iv. Employees who handle substances or materials brought to the industries to be
used or any occupations specified in Third Schedule

2. Safety & Health Officer – section 29
▪To ensure and promote safe conduct of work in the workplace and safety &
health working environment.
▪To ensure the employee obey the safety & health provisions
▪Should possess required qualifications or have received training.

3. Safety & Health Committee – section 30, 31
▪Employees are 40 and above.
▪When directed by the Director General.
▪Lead by employer and to ensure employees cooperate effectively in promoting
& developing safety & health in the workplace.
▪Employer who contravenes the provisions will be fined not more than RM 5,000
or imprison not more than 6 months or both.
