SUBJECT SUSPENSION OF APPREHENSIONS OF MOTORCYCLES WITH

TOP BOX OR SADDLE BAGS

Conside ring the ongoing review of LTO Memorandum dated 15 March 2016 en titled
"GUIDELINES ON INSPECTION AND APPREHENSION RELATIVE TO
MOTORC YCLE TOP BOXES AND SADDLE BAGS", all LTO law enforcers in cluding
LTO deputized agents are hereby directed to refrain from apprehending motorcycles
with top boxes and saddle bags until further notice.

SUBJECT: GUIDELINES ON INSPECTION AND APPREHENSION RELATIVE TO MOTORCY CLE TOP

BOXES AND SADDLE BAGS

After a series of consultation s with stakeho ld ers, the fo llowing rul es and regu lations a e hereby
promu lgated to gove rn t he insp ectio n and use o f m o t orcycle or scooter top boxes and saddle bags.

l. A TOP BOX is a sto rage compartm ent fitted behi nd t he seat of a motorcyc le or scoo t er and is
conside re d a motorcycle accessory. A top box that is specifically designed for m otorcyc les
and scooters and approved by DTI may no t be subject for inspection, reg ist ration o r
apprehension provided tl1 at it conforms to the fol lowin g:

a. It must be sec urely attached to the motorcycle .

b. It ha s a maximum capacity of t w o (2 ) fu ll-faced he lm ets.

2. CUSTOM-MADE TO P BOXES (e.g ., fast food delivery boxes) must conform to the fo ll ow in g
and are subject to inspect ion and registration :

a. It must be securely attac hed to th e motorcycle.

b. The dime ns ions mu st not exceed two (2) f eet in length by two (2) fe et wit It h by t wo
(2) feet in heigh t (2ft x 2ft x 2ft).
c. It mu st no t impede or obstru ct th e view o f t he ri der of the road from tl1e side
m irrors .

Prov ided that the abovementioned requ ire ments are complied wi th , a Pl 00 .00 re gi strat ion
f ee ~;hal l be collected .

Unregistered custom-made TO P BOXES are subject to apprehension with a pennlly of

PS,000.00 pursuant t:o DOTC joint Administrative Order UAO) 2014-01 Section 11-0, Motor
Vehicle Operating Without or With Defective/ lmprope1/Un authorized Accessories Devices
Equipment and Parts. ' '

acce ssories. Sadd le bags tha t are spec ificall y designed for motorcyc le s and scooters and
a oproved by DTI may not be subject for in spe ct ion, regist rati on or ap pre hens ion prov id ed
that it co nfo rms t o the fo ll ow in g:

b. Installation of saddle bags must not be higher than the sea t of th e m o torcycle or
scooter .

4. CUSTOM -MADE SADDLE BAGS or BOXES must conform to the following and arE subject to
inspection and regist rati on:

d. In stallat ion of sadd le bags must not be higher than the sea t o f th e mo to rcyc le or
scoo ter.
e. They shal l not exceed four t een (14} inches from the sides .
f. Length mu st ne t exceed the tail end of the motorcycle or scooter.

Prov ided t hat the abovementioned req ui1·ements a1·e comp li ed w it h, a Pl00.00 re gistrati on
fee shal l be collected .

Unregistered custom -m ade SADDLE BAGS or BOXES are subject: to apprehensio n with a
penalty of PS,000.00 pursuant to DOTC joint Admin istra tive Order GAO) 2014-01 Section 11-0,
Motor Vehicle Operating Without or With Defective/Improper/Unauthorized Accessories,
Devices, Equ ipment and Parts.

Only LTO Law Enforcement Offi ce rs and Agents deputized by LTO to enforce the provisions of R.A. No.
4136 and other related land t ransportation laws, rule s and regu la t ions, are authorized / all owed to
apprehend v io lators of the provis ions of this Memorandum. Agents deputized by LTO specifically fo r R.A.
No. 10586 (An t i-Drunk and Dru gged Driving Act), Section 46 of R.A. 8749 (.i\nt i-Smoke Belch ing Ac t ) and
R.A. No . 8794 (Anti -Overloading Law) are barred in enforcing the prov isions of this Memorand um .

All motorcycle owners wit h unr egistered custom -made TOP BOXES or SADD LE BAGS or BOXES ar e given
ninety (90} days from th e date of this Memorandum to register the same with the LTO .

Previous issuances or orders in cons istent herewi th are deemed re vo ked or supe rseded.
