Dear Sir:

This refers to the above captioned wherein we respectfully request your good office to allow
us to take delivery of the loaded import containers from pier zone to our warehouse located at
2091 PEDRO GIL ST., ST . Ana, Manila City and shall be transferred by our authorized
brokerage/forwarder, CARLO MAGNO D. ADAP

TOKAGA GLOBAL CORPORATION (indicate authorized broker or Consignee) will


process the shipment. TOKAGA GLOBAL CORPORATION (broker or Consignee) will be
posting the cash bond on our behalf and shall likewise be entitled to receive the refund,
subject to the fulfillment of our obligations/undertakings hereunder, otherwise, the bond shall
be applied to the full or partial satisfaction of our obligations/undertakings.

We shall also instruct our trucker to perform physical inspection and checking of the container
to note if there are any damages or exceptions prior to trucking out from the Pier zone. Any
exceptions will be noted on the EIR issued by the terminal operator. It is understood that after
the inspection was made by the trucker within the pier zone and no exceptions were reported
in the EIR, we hereby guarantee that the container(s) is/are free of any damages and defects.
That any damages and defects noted shall be the responsibility of our company. Likewise, our
company further warrants that it will pay and reimburse your company for any damages it
incurred as a result of the defects in the containers.

We and our broker will assure the safe return of the mentioned container(s) in good order
condition and free from any damages to your designated depot WITHIN 5DAYS/DRY

returning

the unit(s) to your yard, we shall instruct the trucking company to secure the BEN LINE
INTERCHANGE RECEIPT before it is delivered back to your yard.

It is further understood that if we and/or our broker fail to return the container/s as scheduled
for whatever reason, or in case of loss of or damage to the container/s even without our fault,
we and our broker unconditionally hold ourselves jointly and severally liable to pay your
company detention charges, penalties, damages, and related fees and expenses, without
prejudice to our right to go after the offending third party, if any. In light of Bureau of
Customs rules and regulations, we hereby confirm that we and/or our broker shall hold
ourselves jointly and severally liable for penalties that will be assessed for failure to return the
empty container/s within 90 days from the date of discharge from the carrying vessel to the
Port of Discharge.

Likewise, we hold your company free and harmless from any liability that may arise from
your doing so. We obligate ourselves to settle and pay all demands and charges immediately
if any.

The Electronic scanned copy of this guarantee shall have immediate effect and be
deemed to have the same effect as the Original.
