A BILL
To regulate assault weapons, to ensure that the right to
keep and bear arms is not unlimited, and for other purposes.
1 Be it enacted by the Senate and House of Representa-

2 tives of the United States of America in Congress assembled,
3 SECTION 1. SHORT TITLE.
4 This Act may be cited as the ‘‘Assault Weapons Ban

5 of 2023’’.

1 SEC. 2. DEFINITIONS.
2 (a) IN GENERAL.—Section 921(a) of title 18, United

3 States Code, is amended by adding at the end the fol-
4 lowing:
5 ‘‘(38) The term ‘semiautomatic pistol’ means any re-
6 peating pistol that—
7 ‘‘(A) utilizes a portion of the energy of a firing
8 cartridge to extract the fired cartridge case and
9 chamber the next round; and
10 ‘‘(B) requires a separate pull of the trigger to
11 fire each cartridge.
12 ‘‘(39) The term ‘semiautomatic shotgun’ means any
13 repeating shotgun that—
15 shell to extract the fired shell casing and chamber
16 the next round; and
18 fire each shell.
19 ‘‘(40) The term ‘semiautomatic assault weapon’
20 means any of the following, regardless of country of manu-
21 facture or caliber of ammunition accepted:
22 ‘‘(A) A semiautomatic rifle that—
23 ‘‘(i) has the capacity to accept a detachable
24 ammunition feeding device; and
25 ‘‘(ii) has any 1 of the following:
26 ‘‘(I) A pistol grip.

1 ‘‘(II) A forward grip.
2 ‘‘(III) A folding, telescoping, or de-
3 tachable stock, or a stock that is otherwise
4 foldable or adjustable in a manner that op-
5 erates to reduce the length, size, or any
6 other dimension, or otherwise enhances the
7 concealability, of the weapon.
8 ‘‘(IV) A grenade launcher.
9 ‘‘(V) A barrel shroud.
10 ‘‘(VI) A threaded barrel.
11 ‘‘(B) A semiautomatic rifle that has a fixed am-
12 munition feeding device with the capacity to accept
13 more than 10 rounds, except for an attached tubular
14 device designed to accept, and capable of operating
15 only with, .22 caliber rimfire ammunition.
16 ‘‘(C) Any part, combination of parts, compo-
17 nent, device, attachment, or accessory that is de-
18 signed or functions to accelerate the rate of fire of
19 a semiautomatic firearm but not convert the semi-
20 automatic firearm into a machinegun.
21 ‘‘(D) A semiautomatic pistol that—
22 ‘‘(i) has an ammunition feeding device that
23 is not a fixed ammunition feeding device; and
25 ‘‘(I) A threaded barrel.

1 ‘‘(II) A second pistol grip.
2 ‘‘(III) A barrel shroud.
3 ‘‘(IV) The capacity to accept a de-
4 tachable ammunition feeding device at
5 some location outside of the pistol grip.
6 ‘‘(V) A semiautomatic version of an
7 automatic firearm.
8 ‘‘(VI) A manufactured weight of 50
9 ounces or more when unloaded.
10 ‘‘(VII) A buffer tube, stabilizing brace
11 or similar component that protrudes hori-
12 zontally behind the pistol grip, and is de-
13 signed or redesigned to allow or facilitate
14 a firearm to be fired from the shoulder.
15 ‘‘(E) A semiautomatic pistol with a fixed am-
16 munition feeding device that has the capacity to ac-
17 cept more than 10 rounds.
18 ‘‘(F) A semiautomatic shotgun that—
19 ‘‘(i) has the capacity to accept a detachable
20 ammunition feeding device or a fixed ammuni-
21 tion feeding device that has the capacity to ac-
22 cept more than 5 rounds; and
24 ‘‘(I) A folding, telescoping, or detach-
25 able stock.

1 ‘‘(II) A pistol grip or bird’s head grip.
2 ‘‘(III) A forward grip.
3 ‘‘(IV) A grenade launcher.
4 ‘‘(G) Any shotgun with a revolving cylinder.
5 ‘‘(H) All of the following rifles, copies, dupli-
6 cates, variants, or altered facsimiles with the capa-
7 bility of any such weapon thereof:
8 ‘‘(i) All AK types, including the following:
9 ‘‘(I) AK, AK47, AK47S, AK–74,
10 AKM, AKS, ARM, MAK90, MISR,
11 NHM90, NHM91, Rock River Arms LAR–
12 47, SA85, SA93, Vector Arms AK–47,
13 VEPR, WASR–10, and WUM.

18 ‘‘(A) means a magazine, belt, drum, feed strip,
19 or similar device, including any such device joined or
20 coupled with another in any manner, that has an
21 overall capacity of, or that can be readily restored,
22 changed, or converted to accept, more than 10
23 rounds of ammunition; and

1 ‘‘(B) does not include an attached tubular de-
2 vice designed to accept, and capable of operating
3 only with, .22 caliber rimfire ammunition.’’.
4 (b) RELATED DEFINITIONS.—Section 921(a) of title
5 18, United States Code, as amended by this Act, is
6 amended by adding at the end the following:
7 ‘‘(42) The term ‘barrel shroud’—
8 ‘‘(A) means a shroud that is attached to, or
9 partially or completely encircles, the barrel of a fire-
10 arm so that the shroud protects the user of the fire-
11 arm from heat generated by the barrel; and
12 ‘‘(B) does not include—
13 ‘‘(i) a slide that partially or completely en-
14 closes the barrel; or
15 ‘‘(ii) an extension of the stock along the
16 bottom of the barrel which does not encircle or
17 substantially encircle the barrel.
18 ‘‘(43) The term ‘detachable ammunition feeding de-
19 vice’ means an ammunition feeding device that can be re-
20 moved from a firearm without disassembly of the firearm
21 action.
22 ‘‘(44) The term ‘fixed ammunition feeding device’
23 means an ammunition feeding device that is contained in
24 and not removable from or is permanently fixed to the fire-
25 arm, but does not include an attached tubular device de-

1 signed to accept, and capable of operating only with, .22
2 caliber rimfire ammunition.
3 ‘‘(45) The term ‘folding, telescoping, or detachable
4 stock’ means a stock that folds, telescopes, detaches or
5 otherwise operates to reduce the length, size, or any other
6 dimension, or otherwise enhances the concealability, of a
7 firearm.
8 ‘‘(46) The term ‘forward grip’ means a grip located
9 forward of the trigger that functions as a pistol grip.
10 ‘‘(47) The term ‘grenade launcher’ means an attach-
11 ment for use on a firearm that is designed to propel a
12 grenade or other similar destructive device.
13 ‘‘(48) The term ‘permanently inoperable’ means a
14 firearm which is incapable of discharging a shot by means
15 of an explosive and incapable of being readily restored to
16 a firing condition.
17 ‘‘(49) The term ‘pistol grip’ means a grip, a thumb-
18 hole stock or Thordsen-type grip or stock, or any other
19 characteristic that can function as a grip.
20 ‘‘(50) The term ‘threaded barrel’ means a feature or
21 characteristic that is designed in such a manner to allow
22 for the attachment of a device such as a firearm silencer
23 or a flash suppressor.
24 ‘‘(51) The term ‘qualified law enforcement officer’
25 has the meaning given the term in section 926B.

1 ‘‘(52) The term ‘grandfathered semiautomatic as-
2 sault weapon’ means any semiautomatic assault weapon
3 the importation, possession, sale, or transfer of which
4 would be unlawful under section 922(v) but for the excep-
5 tion under paragraph (2) of such section.
6 ‘‘(53) The term ‘belt-fed semiautomatic firearm’
7 means any repeating firearm that—
9 cartridge to extract the fired cartridge case and
10 chamber the next round;
12 fire each cartridge; and
13 ‘‘(C) has the capacity to accept a belt ammuni-
14 tion feeding device.’’.
15 SEC. 3. RESTRICTIONS ON ASSAULT WEAPONS AND LARGE
16 CAPACITY AMMUNITION FEEDING DEVICES.
17 (a) IN GENERAL.—Section 922 of title 18, United

18 States Code, is amended—
19 (1) by inserting after subsection (u) the fol-
20 lowing:
21 ‘‘(v)(1) It shall be unlawful for a person to import,
22 sell, manufacture, transfer, or possess, in or affecting
23 interstate or foreign commerce, a semiautomatic assault
24 weapon.

1 ‘‘(2) Paragraph (1) shall not apply to the possession,
2 sale, or transfer of any semiautomatic assault weapon oth-
3 erwise lawfully possessed under Federal law on the date
4 of enactment of the Assault Weapons Ban of 2023.
5 ‘‘(3) Paragraph (1) shall not apply to any firearm
6 that—
7 ‘‘(A) is manually operated by bolt, pump, lever,
8 or slide action, except for a shotgun described in sec-
9 tion 921(a)(40)(G);
10 ‘‘(B) has been rendered permanently inoperable;
11 ‘‘(C) is an antique firearm, as defined in section
12 921 of this title; or
13 ‘‘(D) is only capable of firing rimfire ammuni-
14 tion.
15 ‘‘(4) Paragraph (1) shall not apply to—
16 ‘‘(A) the importation for, manufacture for, sale
17 to, transfer to, or possession by—
18 ‘‘(i) the United States, or a department or
19 agency of the United States; or
20 ‘‘(ii) a State, or a department, agency, or
21 political subdivision of a State;
22 ‘‘(B) the sale to, transfer to, or possession by
23 a qualified law enforcement officer employed by—

2 political subdivision of a State,
3 for purposes of law enforcement (whether on or off
4 duty);
5 ‘‘(C) the sale to, transfer to, or possession by
6 a campus law enforcement officer for purposes of
7 law enforcement (whether on or off duty);
8 ‘‘(D) the importation for, or sale or transfer to
9 a licensee under title I of the Atomic Energy Act of
10 1954 (42 U.S.C. 2011 et seq.) for purposes of estab-
11 lishing and maintaining an on-site physical protec-
12 tion system and security organization required by
13 Federal law, or possession by an employee or con-
14 tractor of such licensee on-site for such purposes or
15 off-site for purposes of licensee-authorized training
16 or transportation of nuclear materials;
17 ‘‘(E) the possession, by an individual who is re-
18 tired in good standing from service with a law en-
19 forcement agency and is not otherwise prohibited
20 from receiving a firearm, of a semiautomatic assault
21 weapon—
22 ‘‘(i) sold or transferred to the individual by
23 the agency upon such retirement; or

1 ‘‘(ii) that the individual purchased, or oth-
2 erwise obtained, for official use before such re-
3 tirement;
4 ‘‘(F) the importation, sale, manufacture, trans-
5 fer, or possession of a semiautomatic assault weapon
6 by a licensed manufacturer or licensed importer for
7 the purposes of testing or experimentation author-
8 ized by the Attorney General; or
9 ‘‘(G) the importation, sale, manufacture, trans-
10 fer, or possession of a firearm specified in Appendix
11 A to this section, as such firearm was manufactured
12 on the date of introduction of the Assault Weapons
13 Ban of 2023.
14 ‘‘(5) For purposes of paragraph (4)(C), the term
15 ‘campus law enforcement officer’ means an individual who
16 is—
17 ‘‘(A) employed by a private institution of higher
18 education that is eligible for funding under title IV
19 of the Higher Education Act of 1965 (20 U.S.C.
20 1070 et seq.);
21 ‘‘(B) responsible for the prevention or investiga-
22 tion of crime involving injury to persons or property,
23 including apprehension or detention of persons for
24 such crimes;

1 ‘‘(C) authorized by Federal, State, or local law
2 to carry a firearm, execute search warrants, and
3 make arrests; and
4 ‘‘(D) recognized, commissioned, or certified by
5 a government entity as a law enforcement officer.
6 ‘‘(6) The Attorney General shall establish and main-
7 tain, in a timely manner, a record of the make, model,
8 and, if available, date of manufacture of any semiauto-
9 matic assault weapon which the Attorney General is made
10 aware has been used in relation to a crime under Federal
11 or State law, and the nature and circumstances of the
12 crime involved, including the outcome of relevant criminal
13 investigations and proceedings. The Attorney General
14 shall annually submit a copy of the record established
15 under this paragraph to the Congress and make the record
16 available to the general public.
17 ‘‘(w)(1) It shall be unlawful for a person to import,
18 sell, manufacture, transfer, or possess, in or affecting
19 interstate or foreign commerce, a large capacity ammuni-

21 ‘‘(2) Paragraph (1) shall not apply to the possession
22 of any large capacity ammunition feeding device otherwise
23 lawfully possessed on or before the date of enactment of
24 the Assault Weapons Ban of 2023.
25 ‘‘(3) Paragraph (1) shall not apply to—

1 ‘‘(A) the importation for, manufacture for, sale
2 to, transfer to, or possession by—
6 political subdivision of a State;
7 ‘‘(B) the sale to, transfer to, or possession by
8 a qualified law enforcement officer employed by—
12 political subdivision of a State,
13 for purposes of law enforcement (whether on or off
14 duty);
15 ‘‘(C) the sale to, transfer to, or possession by
16 a campus law enforcement officer for purposes of
17 law enforcement (whether on or off duty);
18 ‘‘(D) the importation for, or sale or transfer to
19 a licensee under title I of the Atomic Energy Act of
20 1954 (42 U.S.C. 2011 et seq.) for purposes of estab-
21 lishing and maintaining an on-site physical protec-
22 tion system and security organization required by
23 Federal law, or possession by an employee or con-
24 tractor of such licensee on-site for such purposes or

1 off-site for purposes of licensee-authorized training
2 or transportation of nuclear materials;
3 ‘‘(E) the possession, by an individual who is re-
4 tired in good standing from service with a law en-
5 forcement agency and is not otherwise prohibited
6 from receiving ammunition, of a large capacity am-
7 munition feeding device—
8 ‘‘(i) sold or transferred to the individual by
9 the agency upon such retirement; or
10 ‘‘(ii) that the individual purchased, or oth-
11 erwise obtained, for official use before such re-
12 tirement; or
13 ‘‘(F) the importation, sale, manufacture, trans-
14 fer, or possession of any large capacity ammunition
15 feeding device by a licensed manufacturer or licensed
16 importer for the purposes of testing or experimen-
17 tation authorized by the Attorney General.
18 ‘‘(4) For purposes of paragraph (4)(C), the term
19 ‘campus law enforcement officer’ means an individual who
20 is—
21 ‘‘(A) employed by a private institution of higher
22 education that is eligible for funding under title IV
23 of the Higher Education Act of 1965 (20 U.S.C.
24 1070 et seq.);

1 ‘‘(B) responsible for the prevention or investiga-
2 tion of crime involving injury to persons or property,
3 including apprehension or detention of persons for
4 such crimes;
5 ‘‘(C) authorized by Federal, State, or local law
6 to carry a firearm, execute search warrants, and
7 make arrests; and
8 ‘‘(D) recognized, commissioned, or certified by
9 a government entity as a law enforcement officer.’’;
10 and
11 (2) by adding at the end the following:
12 ‘‘(aa) SECURE STORAGE OR SAFETY DEVICE RE-
13 QUIREMENT FOR GRANDFATHERED SEMIAUTOMATIC AS-
14 SAULT WEAPONS.—It shall be unlawful for any person,
15 other than a licensed importer, licensed manufacturer, or
16 licensed dealer, to store or keep under the dominion or
17 control of that person any grandfathered semiautomatic
18 assault weapon that the person knows, or has reasonable
19 cause to believe, will be accessible to an individual prohib-
20 ited from receiving or possessing a firearm under sub-
21 section (g), (n), or (x), or any provision of State law, un-
22 less the grandfathered semiautomatic assault weapon is—
23 ‘‘(1) carried on the person, or within such close
24 proximity that the person can readily retrieve and
25 use the grandfathered semiautomatic assault weapon

1 as if the grandfathered semiautomatic assault weap-
2 on were carried on the person; or
3 ‘‘(2) locked by a secure gun storage or safety
4 device that the prohibited individual has no ability to
5 access.’’.
6 (b) IDENTIFICATION MARKINGS FOR SEMIAUTO-
7 MATIC ASSAULT WEAPONS.—Section 923(i) of title 18,
8 United States Code, is amended by adding at the end the
9 following: ‘‘The serial number of any semiautomatic as-
10 sault weapon manufactured after the date of enactment
11 of the Assault Weapons Ban of 2023 shall clearly show
12 the date on which the weapon was manufactured or made,
13 legibly and conspicuously engraved or cast on the weapon,
14 and such other identification as the Attorney General shall
15 by regulations prescribe.’’.
16 (c) IDENTIFICATION MARKINGS FOR LARGE CAPAC-
17 ITY AMMUNITION FEEDING DEVICES.—Section 923(i) of
18 title 18, United States Code, as amended by this Act, is
19 amended by adding at the end the following: ‘‘A large ca-
20 pacity ammunition feeding device manufactured after the
21 date of enactment of the Assault Weapons Ban of 2023
22 shall be identified by a serial number and the date on
23 which the device was manufactured or made, legibly and
24 conspicuously engraved or cast on the device, and such

1 other identification as the Attorney General shall by regu-
2 lations prescribe.’’.
3 (d) SEIZURE AND FORFEITURE OF LARGE CAPACITY
4 AMMUNITION FEEDING DEVICES.—Subsection (d) of sec-
5 tion 924 of title 18, United States Code, is amended—
6 (1) in paragraph (1)—
7 (A) by inserting ‘‘or large capacity ammu-
8 nition feeding device’’ after ‘‘firearm or ammu-
9 nition’’ each time it appears;
10 (B) by inserting ‘‘or large capacity ammu-
11 nition feeding device’’ after ‘‘firearms or ammu-
12 nition’’ each time it appears; and
13 (C) by striking ‘‘or (k)’’ and inserting
14 ‘‘(k), (r), (v), or (w)’’;
15 (2) in paragraph (2)(C), by inserting ‘‘or large
16 capacity ammunition feeding devices’’ after ‘‘fire-
17 arms or quantities of ammunition’’; and
18 (3) in paragraph (3)(E), by inserting ‘‘922(r),
19 922(v), 922(w),’’ after ‘‘922(n),’’.
20 (e) APPENDIX A.—Section 922 of title 18, United
21 States Code, is amended by adding at the end the fol-

3 SEC. 4. PENALTIES.
4 Section 924(a)(1)(B) of title 18, United States Code,

5 is amended by striking ‘‘or (q) of section 922’’ and insert-
6 ing ‘‘(q), (r), (v), (w), or (aa) of section 922’’.
7 SEC. 5. BACKGROUND CHECKS FOR TRANSFERS OF GRAND-
8 FATHERED SEMIAUTOMATIC ASSAULT WEAP-
9 ONS.
10 (a) IN GENERAL.—Section 922 of title 18, United

11 States Code, as amended by this Act, is amended—
12 (1) by repealing subsection (s);
13 (2) by redesignating subsection (t) as sub-
14 section (s);
15 (3) in subsection (s), as redesignated—
16 (A) in paragraph (3)(C)(ii), by striking
17 ‘‘(as defined in subsection (s)(8))’’; and
18 (B) by adding at the end the following:
19 ‘‘(7) In this subsection, the term ‘chief law enforce-
20 ment officer’ means the chief of police, the sheriff, or an
21 equivalent officer or the designee of any such individual.’’;
22 and
23 (4) by inserting after subsection (s), as redesig-
24 nated, the following:

1 ‘‘(t)(1) Beginning on the date that is 90 days after
2 the date of enactment of the Assault Weapons Ban of
3 2023, it shall be unlawful for any person who is not li-
4 censed under this chapter to transfer a grandfathered
5 semiautomatic assault weapon to any other person who is
6 not licensed under this chapter, unless a licensed importer,
7 licensed manufacturer, or licensed dealer has first taken
8 custody of the grandfathered semiautomatic assault weap-
9 on for the purpose of complying with subsection (s). Upon
10 taking custody of the grandfathered semiautomatic assault
11 weapon, the licensee shall comply with all requirements of
12 this chapter as if the licensee were transferring the grand-
13 fathered semiautomatic assault weapon from the licensee’s
14 inventory to the unlicensed transferee.
15 ‘‘(2) Paragraph (1) shall not apply to a temporary
16 transfer of possession for the purpose of participating in
17 target shooting in a licensed target facility or established
18 range if—
19 ‘‘(A) the grandfathered semiautomatic assault
20 weapon is, at all times, kept within the premises of
21 the target facility or range; and
22 ‘‘(B) the transferee is not known to be prohib-
23 ited from possessing or receiving a grandfathered
24 semiautomatic assault weapon.

1 ‘‘(3) For purposes of this subsection, the term ‘trans-
2 fer’—
3 ‘‘(A) shall include a sale, gift, or loan; and
4 ‘‘(B) does not include temporary custody of the
5 grandfathered semiautomatic assault weapon for
6 purposes of examination or evaluation by a prospec-
7 tive transferee.
8 ‘‘(4)(A) Notwithstanding any other provision of this
9 chapter, the Attorney General may implement this sub-
10 section with regulations.
11 ‘‘(B) Regulations promulgated under this para-
12 graph—
13 ‘‘(i) shall include a provision setting a max-
14 imum fee that may be charged by licensees for serv-
15 ices provided in accordance with paragraph (1); and
16 ‘‘(ii) shall not include any provision imposing
17 recordkeeping requirements on any unlicensed trans-
18 feror or requiring licensees to facilitate transfers in
19 accordance with paragraph (1).’’.
20 (b) TECHNICAL AND CONFORMING AMENDMENTS.—
21 (1) CHAPTER 44 OF TITLE 18, UNITED STATES
22 CODE.—
23 (A) SECTION 922.—Section 922(y)(2) of

24 title 18, United States Code, is amended, in the
25 matter preceding subparagraph (A), by striking

1 ‘‘, (g)(5)(B), and (s)(3)(B)(v)(II)’’ and insert-
2 ing ‘‘and (g)(5)(B)’’.
3 (B) SECTION 925A.—Section 925A of title
4 18, United States Code, is amended, in the
5 matter preceding paragraph (1), by striking
6 ‘‘subsection (s) or (t) of section 922’’ and in-
7 serting ‘‘section 922(s)’’.
8 (C) SECTION 925B.—Section 925B of title
9 18, United States Code, is amended by striking
10 ‘‘section 922(t)’’ each place the term appears
11 and inserting ‘‘section 922(s)’’.
12 (2) BRADY HANDGUN VIOLENCE PREVENTION
13 ACT.—Section 103(l) of the Brady Handgun Vio-

14 lence Prevention Act (34 U.S.C. 40901(l)) is amend-
15 ed, in the matter preceding paragraph (1), by strik-
16 ing ‘‘subsection (t)’’ and inserting ‘‘subsection (s)’’.
17 (c) EFFECTIVE DATE.—The amendments made by
18 this section shall take effect 90 days after the date of en-
19 actment of this Act.
20 SEC. 6. USE OF BYRNE GRANTS FOR BUY-BACK PROGRAMS
21 FOR SEMIAUTOMATIC ASSAULT WEAPONS
22 AND LARGE CAPACITY AMMUNITION FEED-
23 ING DEVICES.
24 Section 501(a)(1) of title I of the Omnibus Crime

25 Control and Safe Streets Act of 1968 (34 U.S.C.

1 10152(a)(1)) is amended by adding at the end the fol-
2 lowing:
3 ‘‘(J) Compensation for surrendered semi-
4 automatic assault weapons and large capacity
5 ammunition feeding devices, as those terms are
6 defined in section 921 of title 18, United States
7 Code, under buy-back programs for semiauto-
8 matic assault weapons and large capacity am-
9 munition feeding devices.’’.
10 SEC. 7. SEVERABILITY.
11 If any provision of this Act, an amendment made by

12 this Act, or the application of such provision or amend-
13 ment to any person or circumstance is held to be unconsti-
14 tutional, the remainder of this Act, the amendments made
15 by this Act, and the application of such provision or
16 amendment to any person or circumstance shall not be af-
17 fected thereby.
