“RECTIFYING THE ERROR IN THE POSITION TITLE OF THE DEPARTMENT HEAD OF

THE PROVINCIAL EDUCATION DEPARTMEN AS PRINTED IN THE PERSONNEL
SCHEDULE WHICH FORMED PART OF THE APPROVED ANNUAL BUDGET FOR FY 2014
OF THE PROVINCIAL GOVERNMENT OF ALBAY, FROM PROVINCIAL GOVERNMENT
DEPARTMENT HEAD (PROVINCIAL EDUCATION OFFICER) TO PROVINCIAL
GOVERNMENT DEPARTMENT HEAD.”

WHEREAS, the Sangguniang Panlalawigan ng Albay, by virtue of Provincial Ordinance No.

2009-01, created the Provincial Education Department (PED) as a department of Province of Albay, with
seventeen (17) plantilla positions, headed by a Provincial Government Department Head with salary
grade of 26;

WHEREAS, said position title was inadvertently printed in the CY 2014 Plantilla of Personnel as
Provincial Government Department Head (Provincial Education Officer) which was erroneous since the
parenthetical title “Provincial Education Officer” is not consistent with position title as created under the
above-cited Sanggunian Ordinance nor does it exist in the Revised Index of Occupational Services as
provided for in DBM LBC No. 61, series of 1996 being a unique position nor is it found in the mandatory
and/or optional positions under the Local Government Code of 1991;
 WHEREAS, it is imperative that such error be rectified as the Personnel Schedule where the
error was committed was an integral part of the Annual Budget for CY 2014 which the Sangguniang
Panlalawigan ng Albay passed and approved;

NOW THEREFORE, on motion of Hon. Richard Benjamin Imperial, jointly seconded by Hons.
Ralph Andes and Rhederick Riva,

BE IT ORDAINED, by the Sangguniang Panlalawigan ng Albay (SPA) in session assembled

that:

SECTION 1. The position title PROVINCIAL GOVERNMENT DEPARTMENT HEAD

(PROVINCIAL EDUCATION OFFICER), item #1 in the Provincial Education Office, as printed in
the Personnel Schedule of the approved Annual Budget for FY 2014, is hereby rectified to
PROVINCIAL GOVERNMENT DEPARTMENT HEAD.

SECTION 2. By virtue of such rectification, the minimum qualification standards as prescribed

by the Civil Service Commission for the said position shall be adopted by the Provincial Government of
Albay.

SECTION 3. All previous rules, orders, and issuances or parts thereof inconsistent herewith are
deemed repealed, superseded or modified accordingly.

SECTION 4. This ordinance shall take effect immediately upon the approval of the Provincial
Governor.
