DRAFT RESOLUTION No. 6SP 2023- ___

1 “A RESOLUTION AUTHORIZING CITY MAYOR ALBERT D. CHUA TO SIGN A DEED OF
2 USUFRUCT FOR AND ON BEHALF OF THE LGU-CITY GOVERNMENT OF BATAC (CGB),
3 INVOLVING A PARCEL OF LAND, IN FAVOR OF THE LAND TRANSPORTATION OFFICE
4 (LTO)”

5 WHEREAS, the City Government is the owner of a parcel of land consisting of ONE
6 THOUSAND SQUARE METERS, more or less, located at the government center in Barangay Quiling
7 Sur;

9 WHEREAS, said government center is owned by the City of Batac;

11 WHEREAS, the above-mentioned land is identified as Lot No. 1 and Lot No. 12, Block 6, of
12 said government center, corresponding to the mid-portion of Cad. Lot No. 12674, and eastern portion of
13 Lot Numbers 12672,12671,12670,12669 and 12668, all of Cad 398; bounded on the North by Lot No. 2
14 and Lot No. 11 of Block 6 of the consolidation-subdivision plan; on the East by National Road, on the
15 South by Road 9 and on the West by Road 8 of said government center;

17 WHEREAS, in response to a request from the LTO, the CGB is willing to convey the above-
18 described parcel of land by way of usufruct in favor of the former, for it to use said land as site of its
19 branch office;

20 WHEREAS, the LTO shall use the said property for a period of fifty (50) years, subject to
21 renewal upon the mutual consent of the parties; provided, however, that if the grantee does not make use
22 of the land for the intended purpose, the CGB may rescind the contract;

23 WHEREAS, Section 455 (b) (1) (vi.) of RA 7160, otherwise known as the Local Government
24 Code of 1991 and Section 8 (b) (1) (vi.) of RA No. 9407 ( “An act Converting the Municipality of Batac
25 in the Province of Ilocos Norte into a Component City To be Known as the City of Batac” provides that:
26 “The City Mayor, as the Chief Executive of the City Government, shall represent the city in all its
27 business transactions and sign on its behalf all bonds, contracts and obligations, and such other documents
28 upon authority of the Sangguniang Panlungsod or pursuant to law or ordinance;

29 NOW, THEREFORE,

31 BE IT RESOLVED, AS IT IS HEREBY RESOLVED, to authorize City Mayor Albert D.
32 Chua, to sign a Deed of Usufruct for and on behalf of the City Government of Batac, conveying a parcel
33 of land in favor and for the use of the LTO;
34 RESOLVED FURTHER, that a copy of this Resolution and the draft Deed of Usufruct, which is
35 attached hereto as “Annex A” and mad e as integral part of this Resolution be transmitted to all
36 concerned for their information and appropriate action.
