1 AN ORDINANCE PROHIBITING URINATING AND DEFECATING IN PUBLIC


2 PLACES PROVIDING PENALTY FOR VIOLATORS THEREOF

3 WHEREAS, the Local Government Code of 1991 (RA 7160) accords every local government unit
4 power and authority to promote general welfare within its territorial jurisdiction including the
5 promotion of health and safety of its constituents;

6 WHEREAS, the City of Batac is committed to provide a healthy atmosphere to residents and
7 passers-by and to maintain a clean and sanitary environment;

8 WHEREAS, urinating and defecating in public may pose as a public nuisance or disorderly conduct
9 as it can lead to indecent exposure or public lewdness;

10 WHEREAS, urine and feces were considered to be contributory to water pollution, when rain
11 flushes it into surface water and other unprotected or broken wells or canals;

12 WHEREAS, the Local Government Unit of the City of Batac is vigilant as to the effects of
13 unsanitary disposal of human wastes in health and well-being of its citizens;

NOW THEREFORE

14 BE IT ORDAINED, by the Sangguniang Panlungsod of the City of Batac, in session duly


15 assembled, that:

16 Section I. Prohibition. It shall be unlawful and shall be a public nuisance for any person to
17 urinate and defecate in public places as enumerated in Section II hereof or other vacant public and
18 private properties not owned or controlled by the offender, other such areas open and in full view of
19 the public subject for implementation with the barangay;

20 Section II. The Selected Public Places Shall Be, But Not Limited To The Following:

21 a. The City of Batac Public Market and Barangay Talipapa (small temporary market);
22 b. Grocery Commercial Establishments;
23 c. Hospitals, Clinics, and other Medical Establishments;
24 d. Drug Stores and Medical Equipment/Facility Establishments;
25 e. Food Stores, Warehouses, Storerooms and Depots;
26 f. Barangay Checkpoints, Barangay Halls, and other Barangay Establishments;
27 g. Parks, Banks, and Churches or other Establishments of religious worship;
28 h. Terminals, Public Walkways and Sidewalks, Parking Lots, and other public queuing and
29 waiting areas;
30 i. Any Street, Highway, Road and Alley; and,
31 j. Other Places that the City Government of Batac may provide.
32 Section III. Enforcement. All authorities in uniform (Police, Traffic Enforcers), All
33 Barangay Chairmen, Kagawads and Barangay Tanods are hereby authorized to enforce and
34 implement the prohibition of this ordinance;

35 Section IV. Penalties. Any person found guilty of violating any of the provision of this
36 Ordinance shall be penalized with:

37 First Offence–––––––––––––Five Hundred Pesos ( P500.00 )


38 Second Offence–––––––––––One Thousand Pesos ( P1,000.00 )
39 Third Offence––––––––––––One Thousand Five Hundred ( P1,500.00 )

40 Section V. Separability Clause. If any provision of this Ordinance is declared


41 unconstitutional or the application thereof to any person or circumstances is withheld, other provision
42 or parts thereof not declared as such shall remain valid and enforceable.

43 Section VI. Repealing Clause. Any provision of existing ordinances contrary or inconsistent
44 with this ordinance are hereby repealed or modified accordingly;

45 Section VII. Effectivity. This Ordinance shall take effect immediately in compliance with the
46 provisions of Section 59 of RA 7160, otherwise known as the Local Government of Code 1991.
