AFFIDAVIT OF DESISTANCE

I, JAYMARIE G. QUINTOS, of legal age, Filipino, married, and a resident

of Dadda, Tuguegarao City, Cagayan after having been sworn to in accordance
with law, hereby depose and say, that:

1. I am the private complainant in Criminal Case No. 17136 entitled

“People of the Philippines versus Marlo Quintos y Lim” for Violation of
Republic Act No. 9262 otherwise known as Anti-Violence against
Women and their Children Act of 2004 which is pending before the
Regional Trial Court Branch 4 (Family Court), Tuguegarao City,
Cagayan;

2. After both accused and I had a recent conversation regarding the

above-case, we decided to settle the problem amicably by entering into
a Compromise Agreement and for the reason that my husband has been
conscientiously giving support to our three (3) children, two (2) of
them have already migrated to Canada and currently in my husband
parental authority while the other whose with me is currently
processing his VISA and documents for migration;

3. Due to the aforesaid developments between us, I would like to manifest

that I now completely and absolutely exonerate the accused from any
liability in connection with the above-mentioned criminal case and that
I am no longer interested, and I hereby desist, in prosecuting the said
criminal case;

4. I am executing this Affidavit of Desistance without force, intimidation,

undue influence and threats exerted upon me and to the best of my
knowledge and ability;

5. I hereby inform the Public Prosecutor of Tuguegarao City, Cagayan and

the Regional Trial Court Branch 4 that I am withdrawing the complaint
for Violation of RA 9262 (Ant-Violence against Women and their
Children Act of 2004) against Marlo Quintos y Lim docketed as Criminal
Case No. 17136 pending before the Regional Trial Court Branch 4;

6. Further, I am executing this Affidavit of Desistance to attest the

truthfulness of all the foregoing facts and for the purpose of securing a
dismissal of the above-entitled criminal complaint against the accused.
