AFFIDAVIT OF DESISTANCE
I, PERFECTO LUMICTIN, JR., of legal age, single and resident of Purok
Million, Dawis, Tandag City, Surigao del Sur, after having been sworn to in
accordance with law do hereby depose and state:

1. That I am the private complainant against my brother, VINCENT

LUMICTIN in the above-captioned case;

2. That the said conflict sprung from petty family misunderstandings;

3. That the only reason behind my filing of charges against my brother

was pure irritation and frustration;

4. That after mediations by other family members we have eventually

reconciled and settled the matter amicably between ourselves;

5. That as a result of the reconciliation I have come to realize that it will

be for the best interest of the family that I desist from pursuing this case to avoid
embarrassment and to have peace of mind;

6. That I am not interested in further prosecuting my complaint against my

brother as our conflict was purely trivial;

7. That I hereby DESIST from pursuing this case and prays that the same
be WITHDRAWN or DISMISSED immediately, as I have no more intention to
appear in the succeeding hearings, much less cooperate as it will affect family
relations;
