Minimum documentary requirements for the posting of the different kinds of bail bonds
A. Cash Bail Bond.
1. Certified True Copy or Official Court Copy of the Information;

2. Four (4) sets of the accused's picture showing his/her front, left and right profiles,
with the name and signature of the accused at the back of each picture;

3. Accused's left and right handprint;

3. Barangay Certification intended for bail purposes, reflecting accused's real


name and residence; (NOTE: THIS IS NEW)

Q: Regarding sa Barangay Certification, paano po kung ang Complainant ay


ang Mismong Barangay Captain?

Bench: Doon na mismong papasok ang First Kagawad. Siya mismo ang acting as
Captain under the law, then he/she issues the Barangay Certification. (for
practicality)

5. Location plan or house sketch of the accused as certified by the barangay

4. In case the accused is detained, Certificate of Detention showing the name,


designation and signature of the personnel authorized to issue the said
certificate where accused is detained;
(NOTE: This is NEW)

7. Accused's notarized Undertaking and Waiver of Appearance in accordance with


Rule 114;

8. Bail amount recommended or imposed

B. AM No. 04-7-02-SC- Corporate Surety Bonds


Bench: “Wala pang accredited surety in Laoag at Batac City that’s why we
haven’t accepted surety bond”

C. Property Bond- Accepted pa din siya. (madalas discouraged)


-Requirements:
A. Transfer Cert. of Title of the Property
B. Real Property’s attest Tax Declaration

Q: Paano kung nacharge sa Ilocos Norte pero sya ay taga Mindanao?


A: Kukuha ng Barangay Certificate from Residence. Doon sa Mindanao. (Strict
Compliance)

Q: What if dual residence siya? Like, Nung chinrage ay Mindanao ang residence pero
noong magfile na for bail ay matagal nang nakatira sa Ilocos Norte or resident na sya
doon?

A: Follow the residence alleged in the complaint.


(NOTE:
EXCP. Allowed na kukuha sa new residence at hindi sundin what was alleged in the
information as long as he/she presents convincing evidence to that effect.
Q: RTC Barnch 14 in La Union granted an accused’s Motion to Quash a Search warrant
issued by the RTC Exec. Judge in Bauang La union.
Ground: Failure to comply with Sec. 2, Rule 126. ---Lack of compelling reason to secure
Search Warrant while operational sa Ilocos Norte.

Bench’s Comment:
a. Found on Records na unavailable ang mga judges sa Ilocos Norte.
Why do the judges allow police officers’ applicationfor search warrant kahit na
hindi nirerequire to present Certification from Clerk of Court stating therein na all
courts in Ilocos Norte are unavailable? Nagtataka ako.
b. If you were the counsel for the respondent under inquest proceeding, ask for the
Transcripts of RTC Bauang la Union imeediately.
c. Ask a practical advise. You will not quash the search warrant sa mismong judge na
nag-issue nito.
d. You will file it immediately sa branch 14 once the Information is filed.
e. Nasa Vigilance din ng Lawyer iyan.
f. Ask Certification from the judge and also the Vice Executive Judge kung talaga
bang absent on unavailable on that day.
g. That Certification is a good basis for Quashal na.

Upon filling ng Motion for postponement, pay the postponement fee.

Ladies: Below the Knee or on the Knee and skirt, with blazer
Getlemen: Coat, Necktie, slacks, or barong long sleeves

Judicial Affidavit Rule- AM No. 12-8-8-SC


a. Lahat ng ifa file na initiatory pleadings, kailangang may Judicial Affidavit.
b. JA- 5 days before hearing
c. Sa pending cases prior to the 2019 amendment, either the judge orders to submit all
Jas of the parties’ witnesses or the judge goes to the Judicial Affidavit Rule.
Q: Allowed ba ang JA via VideoCon pag nasa abroad ang witness? Witnes will testify
on that place.
A: Yes. Comply with the rules. Dapat notarized.

NOTE: Those testifying abroad, follow the request sa DFA including cross examination.
Jas testimony ay taken sa Philippine Embassy.

Q: Kelangang bang irecord ang pagkuha ng JA dun?


A: No need.
