Environmental Quality Act 1974 is a legal framework that regulated and emphasizing the
harmony in the quality of the environment in Malaysia in order to protect nature of the
country that is vital for the society’s healthy living. In Malaysia, the cases of environmental
pollutions are really concerning many parties and Nestle is one of the largest companies that
is well known for their environment pollution especially in water pollution that caused by their
factories. Based on Nestle RM 90,000 fined article, the company has been convicted under
regulation 11(1)(b) of Environmental Quality Act 1974 which clearly stated that no one shall
release industrial effluent containing any indicator in concentrations above the limitations set
forth in standard b. The allowable criteria for disposal of industrial liquid waste or mixture raw
sewage of standards A and B are listed in the Fifth Schedule.

In Fifth Schedule have been listed all the liquid waste and their acceptable parameter to be
release in water to avoid and prevent any water pollution that clearly can resulting into many
bad impacts to the society and nation. This indicator is categorized into two types of
standards which are standard A and standard B. Due to Nestle has been convicted for
breaching the standard B in Fifth Schedule, it showed that Nestle is unethical in managing
their factory’s waste because their action will impact on the cleanliness of the water and not
being considerate in surroundings environment.

Based on New Straits Times article regarding to majority river in Selangor have been
polluted by the licensed companies and factories, ‘Lembaga Urus Air Selangor (LUAS)’ is a
vital government agency that protects Selangor's water supplies. LUAS plays a big role in
ensuring all the water supply in Selangor stay clean and can be used continuously. Not only
that, LUAS is an authoritative agency that will overcome any issues relating to water
pollution in Selangor. LUAS is also responsible in conducting the inspection in all factories
and companies in Selangor to ensure all the factories and companies follow the guidelines
and criteria in disposing liquid waste into the water. The officer of LUAS that involved in
conducting the inspection to all factories and companies must implement their inspection
thoroughly so that water supply cut issues in Selangor can be quickly addressed. In addition
to that, Department of Environmental (DOE) is a public authority that also have the same
function as LUAS but DOE covers all types of environment pollution meanwhile LUAS only
emphasized and focus in pollution in terms of water. These public agencies are responsible
in ensuring the nature and water in Selangor and Malaysia are in protected and safe level.
As in the article, LUAS and DOE are the main agencies involved in overcome the issues
related to nature and water in Selangor and in charge in ensuring all the companies and its
factories are disposing all the liquid waste in ethical parameter so it will not be causing water
pollution.

Based on the both of the articles, Nestle, the other companies and factories involved should
really practice ethics in business decision which is under chapter 7. It is because when the
companies and the businesses put ethics as a priority for their businesses, it will prevent the
company to do any unethical action that will give huge impact on the society and the
company’s image. There are many ways to practice ethics in every business decision but the
companies involved also can implement two pillars of ethical leadership in their
management. It is because this standard calls for someone who not only has a set of
essential ethical principles and follows them, but also creates platforms and a work
environment that encourages those values among his followers. This implementation
encourages the company to become moral person and moral manager. This standard can
establish discuss the ethical values of the company on a regular basis, acts as a good role
model and ethically behaved employees and management. Not only that, the issues in both
of the article also can be related with chapter 8 which is under current ethical issues in
international business. Water pollution in Selangor caused by Nestle and other companies
are the perfect example of pollution under environmental pollution. Even though it is a
common issue happened in this modernity era, the company should be more aware of the
surroundings and act ethically since there are lots of approaches for companies to practice
ethics in their management and work environment.

Conclusion (Based on the overall discussion)

To sum it all up, water pollution that caused by irresponsible companies is the example of
lack in practicing ethics in their company’s management and example of unethical company.
Nestle and the other companies involved must put ethics as a priority in their businesses to
prevent this water pollution actions from happening again. By practicing ethics in the
company also can enhance the company’s reputation and can prevent the company from
performing any misconduct action that will not only give impact to the society but also will
give a huge impact to the company. For instance, two pillars of ethical leadership can help
the company generate more ethical employees and managers. It also indirectly influence the
company in making business decision wisely and ethically.
