This Petition is filed under section 439(1)(b) of Code of Criminal Procedure,

seeking relaxation of the condition imposed on the petitioner in Crl.M.P.No.452/2023
dated 03.02.2023.
This petition is coming on this day for hearing before this Court in the presence
of Tr.R.Narayanan, Counsel for petitioner and Tr.M.Vishwabharathi, Public
Prosecutor for the respondent. After perusing the petition averments, upon hearing both
side arguments, this Court pronounces the following:
ORDER
Heard on both sides.
1. This petition is filed by the petitioner/accused U/S.439(1)(b) of Cr.P.C
seeking relaxation of the condition imposed on the petitioner in Crl.M.P.No.452/2023
dated 03.02.2023.
2. The learned Counsel for the petitioner has submitted that bail was granted to
the petitioner by this Court in Crl.M.P.No.452/2023 dated 03.02.2023 with a condition
to sign before the respondent/police daily at 10.00 am., until further orders. As per the
orders passed by this Court, the petitioner had been complying with the condition for
the past 14 days without any violation. Now, the petitioner has prayed to relax the
condition totally.

3. The Learned Public prosecutor has submitted that the petitioner is complying
the condition regularly.
4. In view of the substantial period of compliance, and considering the nature of
offence and also considering the other circumstances of the case, this Court is inclined
to relax the condition (c) which is already imposed on the petitioner in
Crl.M.P.No.452/2023 dated 03.02.2023. Further, the petitioner is directed to appear
before the Court concerned on all the hearing dates without fail.

In fine, this petition is allowed.
