UET Jalozai Campus

University of Engineering and Technology is being constructed at Jalozai near Peshawar

consisting of both infrastructural facilities and building construction components. The cost of the
mega project is PKR 6.1 billion. The total area of the project is 400 acres. The client was
struggling in acquiring the land due to encroachments by locals, however, eventually succeeded.
Moreover, the soil strata of the project site is varied. The contract for construction of 2x
academic buildings was awarded to Hamza Construction (Pvt.) Ltd. The contractor failed to
complete the construction project in time and has entered into a delay in work completion.

Keeping in view the existing situation, the client has claimed liquidated damages. The contractor
has raised his concern over the liquidated damages and states that it is unjustified. The contractor
intends to raise a claim and take the matter to the court.

1. Discuss the common sources of contractors claims on construction projects.

2. Propose the most appropriate justifications for the contractor’s concern over the
liquidated damages.
